A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE APPROVING A ONE-YEAR TIME
EXTENSION FOR VESTING TENTATIVE TRACT MAP NO.
04-006 AND PLANNED UNIT DEVELOPMENT NO. 04-005;
APPLIED FOR BY RUSSEL SHEPPEL FOR PROPERTY
LOCATED ON OAK PARK BLVD. AND JAMES WAY (OAK
PARK PROFESSIONAL PLAZA)
WHEREAS, the City Council approved Vesting Tentative Tract Map No. 04-006 and
Planned Unit Development No. 04-005 on May 9, 2006; and
WHEREAS, the City Council of the City of Arroyo Grande has considered a request for a
one-year time extension for Vesting Tentative Tract Map No. 04-006 and Planned Unit
Development No. 04-005 to subdivide a 1.8-acre site into nineteen lots resulting in
twenty-four (24) density equivalent town homes and condominiums as a mixed use with
existing fitness club and medical offices; and
WHEREAS, the City Council finds, after due study and deliberation, that there have been
no significant changes in the General Plan, Municipal Code or character of the area within
which the project is located that would cause the approved project to be injurious to the
public health, safety, or welfare.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo
Grande approves aone-year time extension for Vesting Tentative Tract Map No. 04-006
and Planned Unit Development No. 04-005, with the above findings and subject to the
conditions as set forth in Exhibit "A" attached hereto and incorporated herein by this
reference. Vesting Tentative Tract Map No. 04-006 and Planned Unit Development No.
04-005 shall now expire on May 9, 2009.
On motion of Council Member Costello, seconded by Council Member Guthrie, and by
the following roll call vote, to wit:

VESTING TENTATIVE TRACT MAP NO. 04-008 AND
PLANNED UNIT DEVELOPMENT NO. 04-005
OAK PARK BLVD. AND JAMES WAY (OAK PARK PROFESSIONAL PLAZA)
GENERAL CONDITIONS
This approval authorizes aone-year time extension for Vesting Tentative Tract Map No.
04-006 and Planned Unit Development No. 04-005, which was originally approved by the
City Council on May 9, 2006, to subdivide a 1.8-acre site into nineteen lots resulting in
twenty-four (24) density equivalent town homes and condominiums.
The applicant shall ascertain and comply with all Federal, State, County and City
requirements as are applicable to this project.
2. The applicant shall comply with all conditions of approval for Vesting Tentative
Tract Map No. 04-006 and Planned Unit Development No. 04-005.
3. Vesting Tentative Tract Map No. 04-006 and Planned Unit Development No. 04-
005 shall automatically expire on May 9, 2009. The applicant may apply for two
(2) additional one-year time extensions, pursuant to Development Code Section
16.12.140.
4. For all building permits issued in the subject development, the applicant shall pay
those development impact fees that are in effect at the time the building permits
are issued.

Obispo, State of California, do hereby certify under penalty of perjury, that the attached
Resolution No. 4108 is a true, full, and correct copy of said Resolution passed and
adopted at a regular meeting of the City Council of the City of Arroyo Grande on the 24tH
day of June 2008.
