CC 2017-11-14_09d Strother Park Play Structure MEMORANDUM TO: CITY COUNCIL FROM: BILL ROBESON, PUBLIC WORKS DIRECTOR BY: JILL MCPEEK, CAPITAL IMPROVEMENT PROJECT MANAGER SUBJECT: CONSIDERATION OF THE PURCHASE AND INSTALLATION OF A REPLACEMENT PLAY STRUCTURE AT STROTHER PARK, PW 2017- 10 DATE: NOVEMBER 14, 2017 SUMMARY OF ACTION: The proposed purchase will provide for an updated play structure at Strother Park. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The Capital Improvement Program Budget includes $60,000 of Park Improvement funds for the project. City Public Works staff will provide coordination for the project. RECOMMENDATION: It is recommended the City Council: 1. Waive formal bidding and allow use of the Cooperative Purchasing process consistent with the City's Municipal Code; and 2. Authorize the City Manager to approve the purchase and installation of a play structure at Strother Park. BACKGROUND: The existing large play structure at Strother Park was installed in the 1990’s and is beyond its useful life and in need of replacement. ANALYSIS OF ISSUES: Section 3.08.020 of the Arroyo Grande Municipal Code, requires that supplies and services in excess of $10,000 be acquired through a formal bid process and awarded by the City Council. Section 3.08.060 of the Arroyo Grande Municipal Code, permits this procedure to be waived when a purchase can be made cooperatively with one or more units of government. The National Joint Powers Alliance (NJPA) is a government agency offering competitively solicited contracts for use by governments such as the City of Arroyo Grande. As a government agency, NJPA establishes and provides nationally leveraged and competitively solicited purchasing contracts under the guidance of the Uniform Item 9.d. - Page 1 CITY COUNCIL CONSIDERATION OF THE PURCHASE AND INSTALLATION OF A REPLACEMENT PLAY STRUCTURE AT STROTHER PARK, PW 2017-10 NOVEMBER 14, 2017 PAGE 2 Municipal Contractor Law. Joint Powers laws enable members to legally purchase through NJPA’s contracts. NJPA’s vendors offer a wide variety of products including parks and recreation equipment. NJPA contract number 030117-LTS is for playground equipment through Miracle Recreation Company-PlayPower Inc. City staff contacted Miracle to obtain pricing from the NJPA contract and was given a contract price of $52,629.65 for the purchase and installation of the play structure, and to repair the existing poured in placed rubber surfacing adjacent to the structure. Features of the structure include three different slides, a jax riser staircase, a crawl through tube, and a kids perch with fun fone that communicates with another fun fone for individuals who may be limited to the ground level. It is estimated that delivery of the play structure will occur six to eight weeks from time of order. ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Approve staff’s recommendations; 2. Do not approve staff’s recommendations; 3. Modify staff’s recommendations and approve; or 4. Provide direction to staff. ADVANTAGES: The project will improve overall play structure safety at Strother Park. DISADVANTAGES: There will be no access to a play structure for elementary age children at Strother Park during the construction period. ENVIRONMENTAL REVIEW: The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15302 regarding replacement of an existing structure where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. Attachments: 1. Notice of Exemption 2.
