DEVELOPMENT BLOCK GRANT (CDBG) PROJECTS FOR YEAR 2018

SUMMARY OF ACTION:
Preliminary 2018 CDBG funding recommendations include allocating $65,294 to Family
Care Network, Inc. for a housing rehabilitation project, and $10,906 for administration
costs. Preliminary funding recommendations from the City will assist the County of San
Luis Obispo with its 2018 Action Plan process.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The County has estimated that $76,200 in CDBG funds will be available to the City in
the Fall of 2018. This estimate is equal to the final adjusted figure for the 2017 fiscal
year plus an approximate 1% increase. Overall, the amount of CDBG funding the City
has received over the last fifteen (15) years has consistently decreased due to Federal
budget cutbacks to the CDBG program. Similar to last year, the County will help
administer the CDBG program for the City which will reduce City staff time involved.
County staff will be paid through the CDBG program funds allocated to the City. Per the
Cooperation Agreement between the County and the City entered into on July 11, 2017
(Attachment 1), 65% of the total available administration funds, or $9,906, will be
deducted by the County to meet its obligations under the terms of the agreement for
administrative costs. Based on Council action last year, it is recommended that the
City not allocate the remainder of its administrative funds ($5,334), and instead allocate
$1,000 for City administration with the difference ($4,334) allocated to a proposed
Housing Rehabilitation project.
RECOMMENDATION:
It is recommended the City Council provide preliminary approval of proposed projects to
be funded with the City’s allocation of Community Development Block Grant (CDBG)
funds for the Year 2018 as shown in Table 1 below. Final City approval of the CDBG
allocation will tentatively occur in March 2018.

BACKGROUND:
As mentioned above, the City Council approved a Cooperation Agreement with the
County in July 2017 for the joint participation in the CDBG Program for fiscal years 2018
through 2020. The City, as a participant in the Housing and Urban Development (HUD)
designated Urban County program, receives an annual formula-based allocation of
CDBG funds. These funds are available for a variety of Community Development
activities as long as the activities meet at least one of three national objectives. The
objectives are:
1. Benefit low- and moderate-income persons;
2. Aid in the prevention or elimination of slums or blight; or

3. Address urgent community development needs that pose a serious or immediate
threat to public health or welfare.
The County distributed a Request for Proposals (RFP) and notified the public that the
County and participating cities would accept applications for funding until October 20,
2017. In addition, County staff held a “Needs Assessment Workshop” on September 6,
2017 to gather input from the public regarding the allocation of CDBG funds. The
second CDBG public workshop will be scheduled sometime within the next two (2)
months in South County.
ANALYSIS OF ISSUES:
The following criteria set forth by the County in the RFP are used to make funding
recommendations:
1. Consistency with Federal regulations and laws;
2. Community support (for example, approval of project by a City Council);
3. Seriousness of community development need proposed to be addressed by
project;
4. Degree to which project benefits low-income and very low-income families or
persons;
5. Feasibility of the project to be completed as budgeted and by December 31,
2018;
6. Cost effectiveness of funds requested and leveraging of other funds; and
7. Organization's experience or knowledge regarding CDBG or HOME
requirements.
The Cooperation Agreement between the County and the City gives discretion
regarding allocation of funds. Unless the City’s recommendation to the County for
funding is clearly in conflict with CDBG regulations, the County will approve the
recommendation. The County Board of Supervisors will make its final decision for
funding priority in the spring of 2018.
Public Services
The competitiveness for public service funds, which is capped at 15 percent, has
historically been strong with requests far exceeding available funds. As discussed in
recent years regarding CDBG allocations, HUD has significantly increased its
monitoring efforts of jurisdictions participating in the CDBG program, which means that
local jurisdictions must increase their monitoring efforts of recipients as well. As stated
in the Cooperative Agreement, only activities that can either individually or cumulatively
receive more than $8,000 in CDBG funding will be considered due to the staff cost of
processing such awards in compliance with federal requirements.

Because public service organizations are more aware of the stricter CDBG regulations,
as well as the funding opportunity through the City’s Jim Guthrie Community Service
Grant Program (JGCSGP), the City has received very few applications over the past
several years for CDBG funding. This year, the City received one (1) CDBG public
service application from the 5Cities Homeless Coalition (5CHC) for a program that
provides subsistence payments for eviction prevention and security deposits
(Attachment 2). This program would assist those who are homeless and those at risk of
homelessness by developing a housing stability plan and providing short-term
emergency eviction prevention grants or move-in deposits. The program will be
augmented by other services provided by 5CHC. The total amount of CDBG public
service funds that 5CHC has requested from local agencies is provided in Table 2
below.

For reference, the City has funded 5CHC in the past through the JGCSGP for various
homeless related services as provided in Table 3 below.

Based on previous City Council direction and action to fund public service programs
through the JGCSGP, it is not recommended that the City allocate CDBG public service
funds to 5CHC. It is assumed that other non-profit organizations did not apply for
CDBG funding in good faith, knowing that the City offers public service funding instead
through the JGCSGP. Additional information about the JGCSGP is provided on Page 7
of this staff report.
Public Facilities
One of the City’s highest priorities is addressing Americans with Disabilities Act (ADA)
accessibility deficiencies. During the last several years, the City Council has allocated
the majority of CDBG funds to help pay for disabled access barrier removal projects
throughout the City. These projects include Hoosegow Park ADA improvements, mid-

block crosswalk ADA improvements, the Arroyo Grande Woman’s Club building barrier
removal project, and various barrier removal projects at the Soto Sports Complex. In an
effort to prioritize future ADA compliance projects, City staff is pursuing financial
assistance through the California Joint Powers Insurance Authority (JPIA) to update the
City’s ADA Transitions Plan in 2018. In light of this effort, staff recommends that 2018
CDBG funding for ADA projects be deferred until this plan is complete.
Housing Rehabilitation
Family Care Network, Inc. (FCNI) submitted an application for $70,000 under the
housing rehabilitation category of the CDBG program to perform energy upgrades to
their existing facility located on South Elm Street (Attachment 3). This facility provides
much needed housing for youth aging out of the foster care system that are homeless
or at imminent risk of becoming homeless. The existing heating system of the facility is
highly inefficient, resulting in extremely high heating costs, some of which are passed
on to clients or otherwise shifted to the agency. The result is that funding is shifted
away from direct client services. The proposed on-site solar system would effectively
eliminate utility costs for this property, allowing funding to instead be spent on services
to ensure that participants successfully graduate from FCNI programs and move to
independence.
As background, FCNI was founded as a California public benefit corporation in 1987
and has facilities in both San Luis Obispo and Santa Barbara counties. According to
their website (www.fcni.org), this agency has a 93% success rate, served 1,865 children
and families in FY 16-17, and allocates 89% of its revenues to programs. FCNI has
experience with using federal, state and local funding sources to operate programs and
complete capital improvements, demonstrating the capacity to implement and
administer the proposed project.
This project falls under national objective number one: “benefit low- and moderate-
income persons”, and is consistent with the Cooperation Agreement special provisions
Section IV(J)(1), which states:
To affirmatively furthers fair housing and implement the Analysis of Impediments
to Fair Housing Choice or better known as the Fair Housing Plan, the cities are
encouraged to contribute CDBG funds to affordable housing projects when there
is an eligible CDBG component in the proposal that is located within the city’s
jurisdiction.
Similar to the public facilities category, there is no funding cap for the housing
rehabilitation category. Staff therefore recommends that a total of $65,294 be allocated
to this project, which includes $4,334 of the City’s administration funds ($1,000 would
be retained for the City’s administration of this project). The Council may wish to
formally request that the County allocate $4,706 of its administrative funds to this

project as well to meet the $70,000 request. This would still provide the County with
$5,200 to administer this one project.
Although the City has not received an application for housing rehabilitation during the
last eighteen (18) years since the City joined the Urban County CDBG program, the
FCNI application illustrates a critical need that can be met through the requested
allocation of funds, meets the seven (7) criteria listed above to assist with funding
recommendations, and the agency has demonstrated the capacity to fulfill CDBG
project implementation requirements. The FCNI project was also submitted at a time
when the City is pursuing funding from the California JPIA to assist with preparing an
ADA transitions plan, which will help guide future CDBG funding decisions for City ADA
projects.
FCNI received funds through the City’s JGCSGP as shown in Table 4 below. Staff does
not recommend using JGCSGP funds for the FCNI energy upgrade project since the
cost of this project ($70,000) exceeds the amount of annual funding available through
JGSCGP ($20,000).

Economic Development
The City did not receive any requests for economic development projects.
Area Benefit
Projects qualifying under the area benefit category are limited to a 30 percent cap
($22,860). Area benefit refers to activities that are available to benefit all residents of an
area that is primarily residential where at least 51 percent of the residents are low or
moderate income persons. In the past, the City considered efforts to eliminate slums
and blight, such as code enforcement activities to remove illegal signs and providing
funds for façade improvements, as valid activities. HUD determined in 2013 that the
City’s code enforcement and façade improvement programs are invalid based on the
lack of blight, and therefore these programs have been discontinued. The City did not
receive any funding requests for this category.

Jim Guthrie Community Service Grant Program (JGCSGP)
In response to CDBG funding limitations and restrictions, the City established the
Arroyo Grande Community Service Grant Program in 2014 separate and apart from the
CDBG program (the City Council renamed this program as the “Jim Guthrie Community
Service Grant Program” last March to recognize former Council Member Jim Guthrie,
who initially envisioned the program). This local grant program provides $20,000 to
eligible non-profit organizations that offer specialized social service, educational,
cultural, beautification and recreational programs and projects benefitting Arroyo
Grande citizens. Last year, the City received a total of thirteen (13) applications totaling
$36,100. The deadline this year to submit a completed application is Friday, December
15, 2017.
A six-member Community Service Grant Review Panel is established each year
consisting of one member from each of the City’s boards, commissions and committees.
This panel will convene early next year to review the applications, and a
recommendation for funding will be brought to Council at the same time as the final
CDBG allocations are considered, which will likely be in March 2018.
ADVANTAGES:
The recommended 2018 CDBG allocations fund important City priorities and are
consistent with the Cooperation Agreement between the County and City. The City’s
JGCSGP provides a funding opportunity, separate from CDBG, for local public service
programs that address unmet needs in the community.
DISADVANTAGES:
Providing CDBG funding for FCNI to perform energy upgrades to their existing facility
takes CDBG funding away from potential architectural barrier removal projects under
the public facilities category, and from 5CHC under the public services category.
ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
1. Approve preliminary funding for the CDBG programs for the year 2018 as
proposed;
2. Modify and approve preliminary funding for the CDBG programs for the year
2018; or
3. Provide other direction to staff.
ENVIRONMENTAL REVIEW:
The allocation of CDBG funds is not considered a project under the California
Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA).
Specific projects that may have environmental impacts will be reviewed under CEQA
and NEPA prior to implementation.

A COOPERATION AGREEMENT BETWEEN THE COUNTY OF SAN LUIS
OBISPO AND THE CITY OF ARROYO GRANDE FORJOINT PARTICIPATION
IN THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM, THE
HOME INVESTMENT PARTNERSHIPS PROGRAM, AND THE EMERGENCY
SOLUTIONS GRANT PROGRAM FOR FISCAL YEARS 2018 THROUGH 2020.

2017, by and betweenthe County of San Luis Obispoi a political subdivision of
the State of California, hereinafter called "County," and the City of Arroyo
Grande, a municipal corporation of the State of California, located in _the County
' of San Luis Obispo, hereihafter.called i'City;" jointly referred to as "Parties."
WITNESSETH
WHEREAS, in 1974, the U.S. Congress enacted and the President signed
a. law entitled, The Housing and Community DevelopmentAct of 1974; herein
called the "Act." The Act is omnibus legislation relating to federal involvement in
a wide range of housing and community development activities and contains ·
eight separate titles; and
WHEREAS, Title I of the Act is entitled "Community Development" and
governs programs for housing and community develop_ment within metropolitan
cities and urban counties or communities by providing financial assistance
annually for area-wide plans and for housing, public services and public works
programs; and
WHEREAS; the Community Development Block Grant Program
(hereinafter referred to as "CDBG"), the HOME Investment Partnerships Act
Program (hereinafter referred to as "HOME"), and the Emergency Solutions
Grant Program (hereinafter referred to as "ESG") are consolidated under Title. I of
the Act; and
WHEREAS, the County has requested of the federal Department of
Housing and Urban Development, hereinafter referred to as "HUD," designate
the County as an "urban county;" and
WHEREAS, the County needs to requalify as an urban county and will be
eligible to receive CDBG funds provided that the County's entitled cities defer
their entitlement to the County to enable both the County and the entitlement
cities to jointly participate: in the program; and
WHEREAS, the City de$jres to participate. jointly with the County in said
program; and

WHEREAS, if HUD redesignates the County as an urban cm,mty, thenthe
County may also be eligible to receive funds from the HOME Program and the
ESG Program; and
WHEREAS, the CDBG Regulations issued pursuant to the Act provide
qualified urban counties must submit an application to. the HUD for funds, and
cities and smaller communities within the metropolitan area not qualifying as
metropolitan cities may join the County in said application and thereby be.come· a
part of a more comprehensive County effort; and
WHEREAS, as the urban county applicant, the County must take
responsibility and assume all obligations of an applicant under federal statues,
including: the analysis of needs, the setting of objectives, the development of
community development a11d housing assistance plans, the ·consolidate<::! plan,
and the assurances of certifications; and
WHEREAS, by executing this Agreement, the Parties, hereby give notice
bf their intention' to participate in the urban county CDBG, HOME, and ESG
Programs.
NOW THEREFORE, in consideration of the· mutual promises~ recitals and
other provisions hereof, the Parties agree as follows:.
SECTION I. General.
A. Responsible Officers. The Director of the County. of San Luis Obispo
Department of Planning and Building (hereinafter referreq to as "Director")
is hereby authorized to act as applicant for the CDBG, HOME, arid ESG
Programs and to administer funding and activities under the programs.
Tile City Manager is hereby authorized to act as the responsible officer of
the City under the programs.
B. Full Cooperation. Parties agree to fully cooperate and to assist each
other i'n undertaking ~ligible grant programs or projects, including but not
limited to community renewal and lower income housing assistance
activities, specifically urban renewal and publicly-assisted housing;. public
services; and economic development.
C. Term of Agreement-Automatic Renewal Provision. The term of this
Agreement shall be for a period of three @) years commencing July 1,
2018 through June 30, 2021. In' addition, th.is Agreement provides for
automatic renewal for participation in successive three.;.year qualification
periods, unless the. City provides written notice at least 60 days prior to the
end of the term that it elects not to participate in a new qualification period.
Before· the end of the firstthree-year term, the County will notify the City in

writing of its right not to participate in the. urban county for a successive.
three'-year term. ·
The Parties agree to adopt amendments to this Agreement incorporating
changes necessary to meet the requirements for cooperation agreements
s.et forth in an Urban County Qualification Notice by HUD for a subsequent
three-year urban County qualification period, prior to the subsequent
three-year extension of the term. Any amendment to this Agreement shall
be submitted to HUD as required by the regulations and any failure to
adopt required amendments will void the automatic renewal of this
Agreement for the relevant qualification period.
This Agreement remains in effect until the CDBG, HOME, and ESG
Program funds arid income received with respect to the three-year
qualification period, and the subsequent three.,.year renewals are
expended and the funded activities are completed. The Parties may not
terminate or withdraw from this Agreement while this Agreement remains
in effect. ·
D. Scope of Agreement. This Agreement covers the following formula
funding programs administered by HUD where the County is awarded and
accepts funding directly from HUD: the. CDBG Program, the HOME
Program, and the ESG Program.
SECTION II. Preparation and Submittal of CDBG Funding Applications.
A. Inclusion of City as. Applicant. _The Parties agree the City shall be
included in the application the County shall. submit to HUD for Title I
Housing and Community Development Block funds-under the Act.
B. Consolidated Plan. The City shall assist the County by preparing a
community development plan, for the period of this Agreement, which
identifies community development and housing needs, projects and
programs for the City; and' specifies both short and long.:.term City
objectives, consistent with requirements of the Act. County agrees to:
(1) include the City plan in the program application, arid (2) include
City's desired housing and community development objectives,
policies, programs, projects and plans as submitted by the City in the
County's consolidated plan.
C.. Application Submittal. The County agrees to commit sufficient
resources to completing and submitting the Consolidated Plan and
supporting documents to HUD in time for the Parties to be eligible to
receive 'funding beginning July 1, 2018, and to hold public hearings as
required to meet HUD requirements.

D. County Responsibility. Parties agree the County shall, as applicant,
be responsible for holding public hearings and preparing and
submitting the CDBG funding application and supporting materials in a
timely and thorough manner, as required by the Act and the federal
regulations established by HUD to secure entitlement grant funding
beginning July 1, 2018.
E. Grant Eligibility. In executing this Agreement, the Parties understand
they shall not be eligible to apply for grants under the Small Cities or
State CDBG Programs for appropriations for fiscal years during the
period in which the Parties are-participating ih the urban county CDBG
entitlement program; and further, the City shall not be eligible to
participate in the HOME, or ESG Programs except through the urban
county.
SECTION Ill. Program Administration.
A. Program Authorization. The Dire_ctor is hereby authorized to carry out
activities that will be funded from the annual CDBG, HOME, and ESG
Programs from fiscal years 2018, 2019, and 2020 appropriations and
from any program income generated from the expenditure of such
funds.
B. Responsibmties of Parties. The Parties agree the County shall be
the governmental entity required to execute any grant agreement
received pursuant to the CDBG, HOME, and ESG applications, and
subject to the limitations set out in this Agreement, the County shall
thereby become liable and responsible thereunder for the proper
performance of the plan and CDBG, HOME~ and ESG-under County
programs. County agrees to perform program administrative tasks
such as environmental clearance under the National Environmental
Policy Act (NEPA), subrecipient agreements and monitoring of
subrecipients. The City agrees to act in good faith and With due
diligence in performance of the City obligations and responsibilities
under this Agreement and under all subrecipient agreements. The City
further agrees that it shall fully cooperate. with the County in all things
required and appropriate to comply With the provisions of any Grant
Agreement received by the County pursuant to the Act and its
Regulations.. ·
C. City' Assistance. The City agrees to undertake, conduct, perform or
assist the. County in performing the essential community development
and housing assistance activities identified in the City's community
development plan. Pursuant to the Act and pursuant to 24 CFR
570.501 (b), the City is subject to the same requirements applicable to
subrecipients; including the~ requirement of a written agreement with
the County as set forth in 24 CFR 570.503.

SECTION IV. Use of Program Funds.
A. Allocation of CDBG funds. All funds received by the County
pursuant to this Agreement shall be identified and allocated, as
described below, to the specific projects or activities set out in the
application, and such allocated amounts shall be expended exclusively
for such proj~cts or aetivities; provided, however, that a different
distribution may be made when required by HUD to comply with Title I
of the Housing and Community Development Act of 1974, as
amended. ·
1) Metropolitan Cities' AHocation. The Parties agree the County
shall make available to the City a total amount of CDBG funds
equal to' that which the City would have been entitled had it .applied
separately as a "metropolitan city," using HUD allocation formulas
as applied by the Co.unty, except that an amount equal to thirteen
(13) percent of the Metropolitan Cities' allocations of CDBG funds
will be· deducted by the County to meet its· obligations under the
terms of this Agreement and/or HUD requirements for
administrative costs. Further, with respect to the availability of the
funds, the County agrees to fully cooperate and assist the City in
expending such funds.
2) Non-Metropolitan Cities' Allocation. The County agrees to
allocate a portion of CDBG program funds to the non-Metropolitan,
incorporated cities participating in the program. The amount of
allocation per city shall be equal to that which the urban county
formula award from HUD increases as a result of the HUD
allocation formulas as applied by the County, except that an
amount equal to thirteen (13) percent of the Non-Metropolitan
Cities! allocations of CDBG funds will be deducted by the County to
meet its obligations under the terms of this Agreement and/or HUD
requirements foradministrative costs.
3) Urban County~ Parties shall not recommend a CDBG award of less
than $8,000 for any one project or program due to the staff cost of
processing such awards in compliance with federal requirements.
A project or program recommended to receive an amount less
$8;000 can still receive an a.ward if any other Party or Parties make
an award, which is aggregated to be greater than $8,000.
B.. Availability of Funds. The County agrees to make CDBG funds
available to all participating incorporated cities as set out here when
HUD makes the CDBG funds available to it. The County shall
immediately notify the participating incorporated cities of the availability
of the funds.

It is understood by the Parties, hereto, the CDBG funds'. being used for
the purposes of this Agreement are funds furnished to the County,
through HUD, pursuant to the provisions of the Act. Notwithstanding
any other provision of this Agreement, the liability of the County shall
be limited to CDBG funds available for the Project. The _City
understands that the County must wait for release of CDBG funds from
HUD before CDBG funds may be advanced or reimbursed. The
County shall incur no liability to the City, its officers, agents,
employees, suppliers, or contractors for any delay in making any such
payments.
C. Administrative and Public Services Costs. The County hereby
acknowledges the City, as subrecipient, incurs certain administrative
costs in preparing housing and economic development plans, program
planning, management and ~ccounting, professional support services,
and other reasonable and necessary expenses to carry out the City's
plan; and further, the County agrees that after the availability of CDBG
program funds to the City, the County shall not use its remaining
balance of funds in any way that would limit the City's ability to use its
CDBG funds to the maximum extent allowed by HUD for
administrative, public service, or program purposes.
D. Income Generated. The City shall notify the County of any income
generated by the expenditure of CDBG funds received by the City.
Such program income may be retained by the City subject to the
provisions of this Agreement, the Act and its Regulations.. Any
program income retained must only be used for eligible activities in
accordance with all CDBG requirements as. they apply.
E. Use of Program Income. The County shall monitor the use of any
program income, requiring appropriate record-keeping and reporting by
the City as may be needed for this purpose, and shall report the use of
such program income to HUD. In the event of close-out or change of
status of the City, all program income on hand or received by the City
subsequent to the close-out or change of status shall be paid to the
County. In the event that the City withdraws from the urban county to
become an entitlement grantee, as provided under 24 CFR 570.504,
all program income on hand or received by the City from urban county
;::ictivities shall be retained by the City to be used as additional CDBG
funds subject to all applicable requirements governing the use of
CDBGfunds.
F. Change. in Use of Property. The City shall notify the County of any
modification or change in the use of real property acquired or improved
ih whole or in part using CDBG funds that is within the control of the

City, from that use planned at the time of acquisition or improvement
including disposition. Such notification shall be made within thirty (30)
calen·dar days of such change of use and comply with the provisions of
24 CFR 570.505.
G. Fair Housing Implementation. The Parties agree no urban county
funding shall be allocated or expended for activities in or in support of
any cooperating unit of general local government that does not
affirmatively further fair housing within its own jurisdiction or that
impedes the County's actions to comply with its fair housing
certification.
H. Conflict Resolution. In tile event of disagreement between the
County and the City as to the alrocations, disbursement, use, or
reimbursement of GDBG funds, the Parties agree to accept HUD's
writ:ten determination as to the appropriate resolution or disposition of
funds to the extent HUD is willing to resolve such disagreement.
I. Consolidated and Further Continuing Appropriations. Act. The City
may not sell, trade, or otherwise transfer all of any portion of CDBG
funds to another metropolitan city, urban county, unit of general local
government, or Indian tribe, or insular area that directly or indirectly
receives CDBG funds in exchange for any other funds, credits or non-
Federal considerations, but must use such funds for activities eligible
under Title I of the Act.
J.. Special Provisions for the Urban County.
(1) To affirmatively further fair housing arid implement the Analysis of
Impediments to Fair Housing Choice or better known as the Fair
Housing Plan, the cities are encouraged to contribute CDBG funds to
affordable housing projects when there is an eligible CDBG component
in the proposal that is. located within the city's jurisdiction.
(2) The County will enforce remedies for noncompliance pursuant to 2
CFR Part 200.338 and allowed per 2 CFR Part 200.207 by pulling
CDBG funds for underperforming projects or programs not
implemented during agreed timeframe identified in the subrecipient
agreement.
SECTION V. Amendment or Extension of Agreement.
A Subrecipient Agreement. For each fiscal year during the term of this
Agreement, the County and the City shall enter into a Subrecipient
Agreement, prepared jointly by the County and the City, which
identifies a project or program that the County will administer with the
City's CDBG entitlement funds during that program year. The

Subrecipient Agreement will set forth the project changes, time
schedule for completion of the project(s), deliverable checklist, and
additional funding sources, if any. If substantial compliance with the
completion schedule ca·nnot be met by the City due to unforeseen or
uncontrollable circumstances, then the County may extepd the
schedule for project completion, as allowed by federal regulations.
B. Amendments, Any amendments to this Agreement shall be in writing.
Parties agree any such fully executed amendment or amendments to
this Agreement may be entered into at any time if required or
necessary to implement the plans cbntemplated hereunder, or to
comply with any grant agreement or the regulations issued pursuant to
the Act.
SECTION VI. Compliance with Federal Regulations.
A. GeneraL The Parties agree to take all actions necessary to assure
compliance with the urban county's certifications required by section
104(b) of Title I of the Housing and Community Development Act of
1974; as amended, regarding Title VI of the Civil Rights Act of 1964,
the Fair Housing Act, affirmatively furthering fair housing, Section 109
of Title I of the Housing and Community Development Act of 1974; the
National Environmental Policy Act of 1969; the Uniform Relocation
Assistance and Real Property Acquisition Act of 1970; and other
applicable laws,
B. Citizen Participation. The Parties agree to comply with federal citizen
participation requirements of 24 CFR Part 91, and provide citizens
with:
1) An estimate of the amount of CDBG funds proposed to be used for
activities that will benefit persons of low and moderate income; and
2} A plan for minimizing displacement of persons as a result of CDBG-
assisted activities and programs, and to provide assistance to such
persons.
C. Citizen Participation Plan. The Parties agree to follow a citizen
participation plan which:
1) Provide for and encourages citizen participation, particularly those
of low or moderate income who resid.e in slum or blighted areas
where CDBG funds are proposed to be used;
2} Provide citizens with reasonable and timely access to local
meetings, staff reports; and other information relating to grantee's
proposed use of funds, as required by HUD regulations related to
the actual use of funds under the Act;

3) Provides for public hearings to obtain citizen views and to. respond
to proposals and questions at all stages of the community
development program, including at least 1) formulation of needs; 2)
review of proposed grant activities; and 3) review of program
performance; for which public hearings shall be held after adequate
notice, at times and locations convenient to potential or actual
beneficiaries, and with accommodation of handicapped persons;
4) Provides for a timely written answer to written complaints and
grievances, within 15 working days where practicable;
5) Identifies. how the needs of non-English speaking residents will be
met in the case of public hearings where a significant number of
non-English speaking residents can be reasonably expected to
participate.
6) Identifies. the use of non-traditional methods of community
outreach, including the provision of CDBG documents in a user-
frlendly format, including but not limited to Braille, large print, oral
format, and delivering copies to homebound individuals.
D. The Parties hereby certify, to the best of their knowledge and
belief, that:
1) Conflict of Interest. No federar grant monies have been paid or
will be paid, by or on behalf of· the Parties, to any officer or
employee or any agency, a Member· of Congress, an officer or
employee of Congress, or an employee of a Member of Congress
in connection with the awarding of any federal contract, the making
of any federal grant, the making of any federal loan, the entering
into of any cooperative agreement, and the extension, continuation,
renewal, amendment or modification of any federal contract, grant,
loan, or cooperative agreement. ·
2) Influence. If any funds other than federally appropriated funds
have been paid or will bt;3 paid to any person for influencing or
attempting to influence an officer or employee of any agency, a
Member of Congress, an officer or employee of Congress, or an
employee of a Member of Congress in connection with this federal
contract, grant, loan, or cooperative agreement, the undersigned
shall complete and submit standard forrn LLL, "Disclosure Form to
Report Lobbying," in accordance with its instructions.
3) Certifications Disclosure. Parties agree to include this
certification in the award documents for all subawards at all tiers

(including subcontracts, subgrants, and contracts under grants,
loans, and cooperative agreements), and that all grant
subrecipients shall certify and disclose accordingly. This
certification is a material representation of fact upon which reliance
was placed when this transaction was entered into~
E. Certification Regarding Policies Prohibiting Use of Excessive
Force and Regarding Enforcement of State and local laws
Barring Entrances.
In accordance with Section 519 Public Law 101-144 (the 1990 HUD
Appropriations Act), the City certifies that it has adopted and is
enforcing.
1) A policy prohibiting the use of excessive force by law enforcement
agencies within their respective jurisdictions against any individuals
engaged in non-violent civil rights demonstrations; and
2) A policy of enforcing applicable State and local laws against
physically barring entrance to or exit from a facility or location which
is the subject of such non-violent civil rights demonstrations within
their jurisdictions.
SECTION VII. Execution of Agreement and Recordkeeping.
A. HUD Certification. The Director is hereby authorized to execute and
submit to the County the HUD Certification Form with respect to the
community development activities carried out within the boundaries: of
the City. It is further understood that th~ County will rely upon the
certification executed by the Director for purposes of executing a
certification form for submission to HUD.
B. Maintenance of Records. The City shall maintain records of activities
for any projects undertaken pursuant to the program, and said records
shall be open and available for inspection by auditors assigned by
HUD and/or the County on reasonable notice during the normal
business hours ofthe City.

5Cities Homeless Coalition has a strong history of providing outreach, rapid re-housing and homeless prevention services,
with an over 90% success rate of clients remaining housed. The Coalition has managed multiple housing support grants; in
the past three years these total more than $1,250,000. Additionally, 5CHC hosts a collaborative Supportive Services for
Veteran Families Program ($1.1 M/3 year) with Good Samaritan Shelter. Since 2015 5CHC has rapidly re-housed and
prevented homelessness for more than 300 South County households, with an exemplary housing-retention rate of greater
than 90%. Staff shares more than 40 years of experience in serving those most vulnerable in SLO County.
Clients initially are asked to complete a coordinated intake that is documented through ClientTrack. Referrals and client files
are formatted in specific order to ensure all forms are completed and accounted for, detailing client housing stability plan,
income verification, etc. All funding requests are dual tracked through the agency's financial accounting process by class
and grant and a program-based master assistance file. Lastly all enrolled clients are tracked through the County's Homeless
Management Information System (HMIS).

QUALIFYING CRITERIA (10 points)

The Community Development Block Grant program was established by Congress in 1974 with
passage of the Housing and Community Development Act and is administered by the United
States Department of Housing and Urban Development (HUD). This program provides funds to
municipalities and other units of government around the country to develop viable urban
communities. This is accomplished by providing affordable, decent housing, a suitable living
environment and by expanding economic opportunities principally for low and moderate income
f?ersons. Although local units of government develop their own programs and funding priorities,
all activities must be consistent with one or more of the following HUD national objectives:
• Principally benefits low-and moderate-income persons
• Prevents or eliminates slum or blight
• Addresses an urgent need or problem in the community (e.g., natural disaster)
As an entitlement Urban County under the CDBG program, the County of San Luis Obispo receives
annual funding allocations from the federal government to fund activities to address these
national objectives.
As a funding recipient, San Luis Obispo County is required to submit an Annual Action Plan that
describes how the Urban County will utilize federal funds to address the national objectives in a
manner that will produce the greatest measurable impact on the Urban Cou_nty communities. The
lead agency responsible for submission of this Plan to HUD is the Planning and Building
Department of the County of San Luis Obispo.

Addressing homelessness has been identified as one of the County's important goals. San Luis Obispo County is
consistently one of the least affordable housing markets in California and the nation. The National Association of Home
Builders found that this county was the 10th least affordable out of 229 metropolitan housing markets in the nation for the
fourth quarter of 2016. The 2010 Census found that 35.8% of the renters in San Luis Obispo County had a severe housing
cost burden. This was a higher percentage than in either San Francisco and Los Angeles County. Based on HUD data, our
county also had a higher incidence of homelessness than both.

Section 504 of the Rehabilitation Act of 1973: Certify that it has read JHN
and understands all of its obligations under Section 504 to prohibit
discrimination against persons with disabilities in the operation of
programs receiving federal financial assistance.
The County and cities require all grant recipients to maintain JHN
general liability, automobile and workman's compensation
insurance with limits of not less than $1 million (may vary by
jurisdiction). If you are successful in obtaining a reward, you will be
asked to provide documentation regarding your ability to provide
the required coverage.
Prior to HU D's release of grant conditions and/or funds for the JHN
CDBG-funded project, a review of the project's potential impact on
the environment must be conducted and approved by the County of
San Luis Obispo prior to obligating or incurring project costs. The
County must certify to HUD that it has complied with all applicable
environmental procedures and requirements. Should project costs
be obligated or incurred prior to the completion of the necessary
environmental review, the project shall not benefit from the federal
funds. The level of environmental review required depends on the

Any project that involves the acquisition of property, construction, JHN
and/or rehabilitation and that is funded in whole or in part with
federal CDBG funds is subject to federal relocation requirements. In
general, any property owner, commercial business, or residential
occupant who is displaced by a HUD-funded project may be eligible
for relocation benefits. A project cannot be broken into separate
"projects" in order to avoid the federal requirements connected with
property acquisition and relocation. Any questions concerning the
relocation regulations for a specific property acquisition project
should be directed to the County Housing and Economic
Development staff before any action is taken on the project.
All homeless service providers applying for CDBG funds to assist,
house, or shelter the homeless must identify and demonstrate the
capacity to participate in the County of San Luis Obispo Homeless
Management Information System (HMIS) to provide: personnel for
data entry, user licensing, and hardware and software necessary for
compatibility with HMIS. HMIS is an electronic data collection
system that stores client level information about persons who
access the homeless services system in a Continuum of Care, and
reports aggregate data for the County as per HU D's Data Standards.
HUD updated its data standards in 2014, and the new standards are
in effect as of October 1, 2014. More information can be found at

Quarterly and annual reports shall be submitted by the JHN

underserved groups.

Family Care Network owns a four unit property in the City of Arroyo Grande that provides much
needed housing for youth aging out of the foster care system that are homeless or at imminent risk
of homelessness. The Elm Street property was purchased using State Emergency Housing Assistance ·
Program -Community Development (EHAP-CD) funding in 2012. It was purchased in fair condition,
• but with the understanding that renovations and repairs would be needed within the next few years
and as the property continues to age. From the time of its purchase, FCNI has been able to provide
for basic maintenance and emergency repairs, as well as some minor upgrades to the interiors. In
2016 we received an allocation of San Luis Obispo County CDBG funds to complete exterior
improvements that addressed outdated roofing and windows that were causing interior leaking and
structural damage. The renovations also increased efficiency with low-E windows, and greatly

Family Care Network has experience using Federal, State, Local and private funding sources to
operate our programs and -complete capital improvements. In 2015, we completed our first
renovation using the Federal Home Loan Bank Affordable Housing Program and donated funds. That
renovation included upgrades to kitchens and bathrooms to ensure longevity, transition to energy
star appliances and windows, installation of water saving technologies inside and out, and the
addition of safety features such as security doors and exterior lighting. In 2016 we completed similar
work on two additional properties, including our Elm Street Transitional Housing property for youth
aging out of the foster care system. On Elm Street, FCNI utilized CDBG funding from San Luis Obispo
County to complete exterior work, correcting deficiencies that caused the property to flood, installing ••.
low-E windows, and improving curb appeal. The other project in that year used CDBG funding from
Santa Barbara County for complete rehab of five units in thE;! City of Orcutt. We have also completed
minor renovations and repairs in various years using foundation and administrative funds. FCNI -
further designed and constructed our main offices in 2012, and completed a second story build-out
in 2016 using State of California financing for health services organizations.
' Each of these projects has been completed using a combination of general contractors and our own
internal facilities staff. FCNI employs a Facilities Manager who provides oversight for all of the
J:IQ~l'lcy's capital projects, and oversees a staff of three who complete daily maintenance tasks. A :

While no new services will be provided, the suggested rehabilitation will reduce operating costs,
ensuring that FCNI retains maximal funding to address the needs of the youth who reside in the
, property. The installation of upgraded heating systems and solar power to offset costs will reduce
utility expenses at the property. Minor associated upgrades to interior and exterior surfaces
(including flooring and patio concrete) will ensure that the units remain viable for the foreseeable
' future. Overall improvements to building systems and the transition to more durable surfaces will
protect these units from future degradation and reduce maintenance and operating costs. Property •
cost reductions will ensure that FCNI can direct resources into continuing to provide the highest level
of service to the vulnerable population of Transitional Age Youth (TAY) that we serve.
'TAY often come from backgrounds in which they have never had a place to call home, let alone an
apartment for which they were responsible for care and upkeep. They have lacked the stability and
appropriate adult role-models that provide the foundation for successful independent living. These
factors may mean that building systems and units are stressed. Upgrades will ensure that stressed
systems last and operating and maintenance costs are reduced. Attention to the property also shows
our clients that we are invested in them, that they are valuable individuals. FCNI strives to provide
them with an emotionally and physically stable and appropriate environment to support and
encourage them in their efforts towards a successful and independent future. Reduced operating
costs further ensure that we are able to invest in their futures.

As our mission suggests, FCNI works in partnership with the community to meet the needs of our
clients. Homeless families and transitional age youth enter our programs via screening and referral

The Community Development Block Grant program was established by Congress in 1974 with
passage of the Housing and Community Development Act and is administered by the United States
Department of Housing and Urban Development (HUD). This program provides funds to municipalities
and other units of government around the country to develop viable urban communities. This is
accomplished by providing affordable, decent housing, a suitable living environment and by expanding
economic opportunities principally for low and moderate income persons. Although local units of
government develop their own programs and funding priorities, all activities must be consistent with
one or more of the following HUD national objectives:
•• Principally benefits low-and moderate-income persons
• Prevents or eliminates slum or blight
• Addresses an urgent need or problem in the community (e.g., natural disaster)
As an entitlement Urban County under the CDBG program, the County of San Luis Obispo receives
annual funding allocations from the federal government to fund activities to address these national
objectives.
As a funding recipient, San Luis Obispo County is required to submit an Annual Action Plan that
describes how the Urban County will utilize federal funds to address the national objectives in a
manner that will produce the greatest measurable impact on the Urban County communities. The lead
agency responsible for submission of this Plan to HUD is the Pl·anning and Building Department of the
County of San Luis Obispo.

Clients served in FCNI's Elm Street Transition Housing are youth aging out of the foster care system,
ages 18 to 26, who are homeless or at imminent risk or homelessness. They are comprised of all
different races, genders, abilities, etc. All, by definition are homeless, and are low-income.
TAY face numerous challenges. National statistics show that only half receive a high school diploma
by graduation age, and most can only obtain entry level, minimum wage jobs. Low-skilled individuals
compete with college and university students for both employment and housing. Low income and
earning potential, combined with the high rents and low vacancies along the Central Coast make it
almost impossible for these youth to find and afford housing. Consequently, many face continued
homelessness, live in over-crowded, unsafe conditions, or are forced to leave the area, jobs, friends
and their community connections. Without stable housing, the possibility that they will be able to
improve their skills and increase their income potential, and/or address other barriers to. housing and
self-sufficiency, decrease. With a safe home that instills in our participants a sense of self-worth, and
with the support of a case worker and FCNI team, the potential for the youth living in Elm Street
Transitional H_ousing to move on to successful independent increases exponentially.

FCNI's Transitional Age Youth Housing Programs serve youth ages 16 to 26 who are aging out of the
foster care system and who are homeless or at risk of homelessness. These youth are already
engaged with the County Department of Social Services or Behavioral Health when they are referred
to FCNI. By definition, they are homeless and low-income, and face significant barriers to stability
and self-sufficiency. Many have had fractured childhoods and experienced trauma. Educational
attainment is often low, and most can only obtain entry level, minimum wage jobs for which they are
often competing with local college and university students. These challenges are compounded by the
fact that there is a substantial housing shortage in San Luis Obispo County, contributing to
exorbitant rental rates, and increased competition for few units. According to-recent data from the
National Low Income Housing Coalition, a typical two bedroom apartment in San Luis Obispo
County rents for an average of $1,487 per month. Using 30% of income as a measure of
affordability, at those rates it would take a monthly income of at least $4,950 to afford a standard
. unit, or earnings of $25.19 an hour at a full time job, much more than an entry level position will
' provide. In 2016, it was reported that our County had one of the lowest multifamily vacancy rates in
1· the nation at around 1.7%-a healthy rate is considered to be close to 5%. Consequently, many of
those engaged with FCNI programs face continued homelessness; live in over-crowded, unsafe
• conditions; or are forced to leave the area, jobs, friends and community connections. FCNI's
• Transitional Age Youth Housing Programs offer an alternative; many of the youth in our programs
rely on FCNI housing as the only option available to provide them the stability needed as they

FCNI has the only programs in the area which provide housing and wrap-around services designed to
assist transitional age youth move toward self-sufficiency and independence. Services offered
include: housing, a living stipend, intensive one-on-one life skills training and guidance, case
management, counseling, education/training, job skill development and placement, access to
scholarships and community resources, mentoring, and assistance to develop of a community-based
support network. On average, 89% of participating youth are able to successfully transition to
independent living through the skills, housing and community supports gained in the program. That
percentage reached 93% in the last quarter.
Each participating household (youth and their dependents, if any) also receives lifeskills development
services. FCNI has created a comprehensive lifeskills development curriculum that we have used with
great success for over 17 years. The curriculum focuses on skill building in seven life domains:
planning and organizing, educational advancement, employment and career, community supports,;
· personal living, finance and savings, and health and safety. Our aim is to ensure that these
·households are ready to move to independent permanent housing options within two years of
program participation.

FCNI is the sole licensed service prdvider for Transitional Housing Program Services for Transitional
Age Youth (TAY) in San Luis Obispo County. FCNI's TAY programs are funded through State
mandated programs which provide housing supports for each household enrolled. TAY programs
provide a housing allowance for each participant; FCNI allocates $800 for each youth on a monthly
basis in order to cover the cost of ongoing property operations, maintenance and repairs. Program
funding enables FCNI to provide case management and wrap-around services/lifeskills training to
participating youth. These mandated funding sources are not anticipated to change, nor are they
sufficient to cover all needs. Youth transitioning out of foster care and coming out of homelessness
are new to maintaining a home. They tend to incur additional maintenance needs, and turnover is
fairly frequent; therefore, our ongoing funding is not sufficient to provide for deferred maintenance
or a capital reserve to cover larger rehab and repairs as they arise. Additional funding is needed to
complete the proposed project, including labor costs associated with Davis Bacon wage
requirements.

The County and cities require all grant recipients to maintain general
liability, automobile and workman's compensation insurance with limits
of not less thari $1 million (may vary by jurisdiction). If you are
successful in obtaining a reward, you will be asked to provide
documentation re ardinQ our ability to rovide the required coveracie.
Prior to HUD's release of grant conditions and/or funds for the CDBG-
funded project, a review of the project's potential impact on the
environment must be conducted and approved by the County of San
Luis Obispo prior to obligating or incurring project costs. The County
must certify to HUD that it has complied with all applicable
environmental procedures and requirements. Should project costs be
obligated or incurred prior to the completion of the necessary ·
environmental review, the project shall not benefit from the federal
funds. The level of environmental review required depends on the
nature of the project. 24 CFR Part 58 is available at

Any project that involves the acquisition of property, construction,
and/or rehabilitation and that is funded in whole or in part with federal
CDBG funds is subject to federal relocation requirements. In general,
any property owner, commercial business, or residential occupant who
is displaced by a HUD-funded project may be eligible for relocation
benefits. A project cannot be broken into separate "projects" in order to
avoid the federal requirements connected with property acquisition and
relocation. Any questions concerning the relocation regulations for a
specific property acquisition project should be directed to the County
Housing and Economic Development staff before any action is taken on
the ro·ect.
All. homeless service providers applying fofCDBG' furids to assist,
house, or shelter the homeless must identify and demonstrate the
capacity to participate in the County of San Luis Obispo Homeless
Management Information System (HMIS) to provide: personnel for data
entry, user licensing, and hardware and software necessary for
compatibility with HMIS. HMIS is an electronic data collection system
that stores client level information about persons who access the
homeless services system in a Continuum of Care, and reports
aggregate data for the County as per HUD's Data Standards. HUD
updated its data standards in 2014, and the new standards are in effect

Initial Lead testing found that some areas did test positive, but levels were within acceptable limits.
There was asbestos noted in the spray ceiling texture, and minimal amounts in drywall and sheet
