REGULAR MEETING OF THE CITY COUNCIL
TUESDAY, FEBRUARY 24, 1987

The City Council met in regular session with Mayor Howard Mankins
presiding. Present were Council Members Dorace Johnson, Mark M. Millis,
Gene Moots and D. G. Porter.
FLAG SALUTE AND INVOCATION
Mayor Mankins led the Pledge of Allegiance to our Flag, and the Reverend
Everett Taylor delivered the invocation.
PUBLIC APPEARANCES
-- JERRY SCHULTZ of 403 Allen Street, who is planning to hold his wedding
reception at the Community Building, referred to the City requirement that
it be named in liability insurance coverage at all events held in City buildin.gs
where alcohol will be served. Mr. Schultz said that he had been unable to
obtain affordable insurance for the event. He asked for a waiver of the
insurance requirement, and, after discussion, Mayor Mankins suggested Mr.
Schultz discuss the matter with staff and perhaps place it on a future agenda
for action.
CONSENT AGENDA
C.6. Resolution Rescinding Resolution No. 1881, Specific to Off-Street Parking
on Grand Avenue.
Council Members expressed concerns about the results of Resolution No.
1881, the need to reconsider Resolution 1546, and the need to have more discussion on
traffic signals and speed reduction on Grand Avenue.

an~ Moots and Mayor Mankins voting aye) to adopt Resolution No. 2022 Rescinding
Resolution No. 1881, Specific to Off-Street Parking on Grand Avenue.

Council Members discussed the various locations in this Agenda Item,
and Council Member Millis asked that C.5.d. be continued to the next meeting
so the need for "No Parking" could be explored.

PUBLIC HEARINGS
PROPOSED AMENDMENT TO CIRCULATION ELEMENT OF CITY'S GENERAL PLAN, SPECIFIC
TO LE POINT STREET'S PROPOSED EXTENSION AND BRIDGE-CONTINUED FROM 2/10/87-CC File 8-1-4a
City Manager Robert Mack said that Council Members had been given copies
of a circulation study conducted for the Town Center to assist them in the
determinaticn of the traffic impact on the center as well as the proposals to
eliminate the bridge connection across Tally Ho Creek from the General Plan
and eliminate the extension of LePoint Street between Nevada and Wesley Avenues
from the General Plan.
Mayor Mankins declared the public hearing open.
Speaking against the extension of Le Point and the bridge over Tally
Ho Creek and covering the issues of increased traffic, high cost of building a
bridge and noise, and supporting the conclusions of the Town Center traffic
circulation study were JEANNIE MARSHALL of 562 Le Point, BURNET POOLE of
227 Le Point, HENRY HORWEGE of 243 Larchmont Drive, EDWIN NELSON of 204
Larchmont Drive, STAN CONRAD of 109 Le Point, MICHAEL BONDELLO of 207 McKinley,
JOE MANION of 255 Larchmont Drive, BEN HORNER of 263 Larchmont Drive, BARBARA
MYERS of 610 Le Point, and ROB STRONG, consultant to Loomis/Scolari Developers.
ERNEST SARINA of 263 Le Point spoke in favor of building a bridge on
Le Point Street across Tally Ho Creek saying that increased traffic calls for
extension of the street.
Mayor Mankins closed the public portion of the Hearing.
Council Members expressed concerns about the City keeping public right
of way options open for the future, increasing traffic and the probable need
in the future for more through streets, and keeping a 25-foot wide right of
way in a parking lot at the Guidotti property ("old Catholic church") in
case a through street is ever needed.
Moved by Johnson/Porter (5-0-0, Council Members Johnson, Porter, Millis
and Moots and Mayor Mankins voting aye) to approve Resolution No. 2023 amending
the Circulation Element of the Comprehensive Ge"eral Plan to eliminate the
proposed extension between Le Point and Wesley on the West end and eliminate
the bridge connection across Tally Ho Creek on the East end.

PROPOSED AMENDMENT TO ORDINANCE NO. 221 C.S. AND 317 C.S. AND TENTATIVE TRACT
MAP NO. 1390, ROYAL OAKS ESTATES, PLANNED DEVELOPMENT, SPECIFIC TO ENVIRONMENTAL
IMPACT REPORT-CONTINUED FROM FEBRUARY 10, 1987 CC Flle 6-14-105
Mayor Mankins, who was absent at the February 10, 1987, Council meeting,
said that he had listened to the recorded tapes of that meeting and was prepared
to participate in the Hearing tonight.
Rob Strong, a planning consultant in private practice, said in this
matter he was acting as Planning Director for the City. He referred to his
memorandum of November 25, 1986, covering 1) EIR and Addendum for Royal Oaks
Estates, 2) Royal Oaks Estates Planned Development, and 3) Tentative Map Tract
1390. He recommended 1) Certification of the Final EIR and Addendum, 2} Approval
of amendments to Ordinance No. 221 and 317 regarding PD Zoning of the property,
and 3}Approval of the tentative map for Tract No. 1390, subject to t.he findings
and conditions contained in the memorandum.
Addition Council Member Porter asked the Council to abolish Ordinances 221 and Pddition to
Minutes
To Minutes 317 and put them into one ordinance. He said it is very confusing trying to Correction
read three ordinances which are amending each other. He said there has to
be a better way of handling this matter.
Mayor Mankins referred to a February 10, 1987, memo from City Attorney Art Shaw on
"Current 'Vested Rights' Status of Oak Knolls Property." Mr. Shaw's memo
includ~d a chart which traced the various development proposals for the
property over the past several years. Conclusions reached in the memo were
1) Ther'e is a final parcel map recorded in 1982 which divides the property into
seven parcels. It authorizes no improvements or development of any sort
without additional City approval, and 2} A maximum of 233 residential units
has been in effect since 1980 for the entire property.

In answer to a question from Mayor Mankins, Mr. Strong said that the
Tentative Map does not propose a cut through from the boundary of the sub-
division to Miller Way, just emergency vehicle access.
Mayor Mankins declared the Public Hearing open.
Dan Lloyd of Engineering Design Associates, a San Luis Obispo firm the
developers hired to draw up plans for the project, said his plan was to be
sensitive to the land form of the site, creating more open space and leaving
most of the trees and vegetation. He showed the Council a model of the project.
Helen Bailey, associate planner with Merriam-Fraser, who prepared the
Environmental Impact Report, said Keith Higgins prepared the Traffic Analysis
and was present to answer questions. She said issues covered in the EIR con-
cerning grading and drainage were reviewed by Pacific Geoscience and their
recommendations included in the EIR. She said mitigation measures recommended
have been carried forward to the Staff Report.
Citizens spoke on the issues of opening up access at the end of LaBarranca
Park to the Royal Daks school site, a storm retention basin, traffic impact,
density, the large estate lots and the clustered homes, water, drainage, cuts
in the hillsides and maintenance of ground cover, the oak trees and other wild
life, types of retaining walls, making Miller Way a thoroughfare, the need for
a senior care facility and the establishment of a YMCA in the tract.

Street, PATTY JOHNSON of 292 James Way, BOB RENISON of 177 Colina, JUNE HUGHES
of 282 Miller Way, ELIZABETH SCOTT GRAHAM of 312 Miller Way, JOHN MCGRATH of
273 Miller Way, BILL MCCANN of 575 Crown Hill, BETTY NOSS of 246 Miller Circle,
SANDY SYLVESTER of 197 Colina, DEBBIE HANDY of 1338 Rice Court and THE REV.
GREG WAYBRIGHT, pastor of Grace Bible Church.
GEORGE BENTON of 586 Bakeman Lane said the town is growing and this
tract is needed. WILLIAM LACKEY, developer of Royal Oaks Estates, said
only one estate lot is open, the other two will contain a church and a YMCA.
He said he would like to see the large groves of oak trees go to the City.
He said the lots for the 99 cluster homes were sold in a week and a half.
DON MCHANEY of 140 Ruth Ann Way said that YMCA officials has sent him a letter
expressing an interest in locating in the tract.
Mayor Mankins closed the public portion of the hearing.
Ms. Bailey and Mr. Strong answered some of the questions concerning
drainage and the Miller Way connection. Council Members discussed the Miller
Way connection and the need for emergency access, and the ownership and preser-
vation of the oak groves.
CLARK MOORE of 1180 Ash Street said the Plannin9 Commission tied and
did not approve Exhibit "D" Condition for Approval and Specific Exceptions for
PD Amendment and Tentative Map Tract No. 1390, Royal Oaks Estates.
Council discussed the slopes and grades in the project with Mr. Lloyd,
entineer for the developer. He said some slopes will be 3 to 1, and the intent
is to stair-step the pads to better control drainage on the lots, and make the
pads more buildable. He said regrading on the lots will be minimal. He said
pre-designed drainage plans will be offered. Also discussed was the planting of
trees on a 2 to 1 basis for the ones removed by the developers.
Mr. Strong said that it was his intent that Exhibit "E" a Draft Ordinance
of the City of Arroyo Grande amending Section 2 of Ordinance 221 C.S. and
Section 1 of Ordinance No. 317 C.S. to Modify the Planned Development of Royal
Oaks Estates (Formerly Halcyon Hills, Knollwood and Oak Knolls) be used by the
Council as an exhibit document.
Moved by Millis/Moots (3-2-0, Millis, Moots and Porter voting aye, and
Johnson and Mankins voting no) to continue this item for two weeks to the March
10, 1987, meeting.

ACTION FOR ANIMALS' RIGHTS (AFAR) REQUEST FOR SUPPORT OF AB 128, PROHIBITING
THE CARRYING OF DOGS IN OPEN VEHICLES WITHOUT PROPER RESTRAINT
BASIL PARFITT of Shell Beach asked the Council for a letter of support
on this matter. No action was taken by the Council.
SECOND READING OF ORDINANCE AMENDING CHAPTER 4, ARTICLE 26 OF ARROYO GRANDE
MUNICIPAL CODE, OFF-STREET PARKING REQUIREMENTS CC File 9-10-23
Mr. Mack said if this ordinance was adopted it would go into effect
in 30 days.
Moved by Porter/Moots (5-0-0, Porter, Moots, Johnson, Millis and Mankins
voting aye) to adopt Ordinance No. 354 C.S. Amending Chapter 4, Article 26
of the Arroyo Grande Municipal Code, "Off-Street Parking Requirements."
AWARD CONTRACT FOR INSTALLATION OF TRAFFIC SIGNAL AT COURTLAND AND GRAND AVENUE-CC File
Publ ic Works Director Paul Karp referred to his rraro of February 18, 1987, on the 11-11-6
Award of Contract - Courtland Street and Grand Avenue, Project 90-86-3. He
recommended that the City Council consider award of the contract for installation
of the traffic signal at Courtland Street and Grand Avenue to Lee Wilson of
Arroyo Grande, in the amount of $56,871. He said if the City awards the contract,
funds must be expended in the amount of $54,892.50 (including design and in-
spection) and the City will probably be reirrbursed by Lucky Stores in the amount of
$10,978.50. He said this would reduce the City's net cost to $43,914.
There was Council discussion of waiting for Joie Scolari, Citicorp
Savings and Western Commercial to contribute to the cost of the signal. Mr.
Karp said it is not possible or practical at this time.
Moved by Millis/Moots (5-0-0) to award the contract for installation of
the traffic signal at Courtland Street and Grand Avenue to Lee Wilson Electric
of Arroyo Grande, in the amount of $56,871.
ADJOURNMENT
Council adjourned at 11:30 P.M. to the meeting at 3:30 P.M. Thursday,
February 26, 1987, when a tour of City facilities was planned.
