Minutes 1986-07-22 CITY COUNCIL JUL Y 22, 1986 ARROYO GRANDE, CALIFORNIA 7:30 P.M. The City Council met in Regular Session with Mayor Pro Tem Matt Gallagher presiding. Upon roll call Councilmembers Dorace Johnson, Gene Moots and D.G. Porter were present. Mayor B'Ann Smith was absent. The meeting was held at the Community Building, 211 Vernon Avenue. PLEDGE OF ALLEGIANCE AND INVOCATION Councilmember Porter led the Pledge of Allegiance to our Flag. The Rev. Michael O'Sullivan of St. Patrick's Catholic Church delivered the invocation. RECOGNITION OF SUYEICHI "SWITCH" NAKAMURA Mayor Pro Tern Gallagher presented a proclamation and key to the City to Mr. Nakamura, retiring employee of the City of Arroyo Grande. The Mayor Pro Tern said Mr. Nakamura had worked for the City for 27 years. RECOGNITION OF DENNIS T. ALLAN Mr. Allan was not in attendance at the meeting, and Mayor Pro Tem Gallagher said he would see that he received the plaque of appreciation for his service on the Downtown Parking Advisory Board. Resolution Establishing "No Parking" Zone, Ash Street, Near Corporation Yard (Reconmend Adoption) ---- - CITY COUNCIL JULY 22, 1986 ARROYO GRANDE, CALIFORNIA PAGE TWO CONSENT ITEM NO. 8 Councilmember Moots asked about the time frame for completion of the traffic signal at Oak Park/James Way, and Public Works Director Paul Karp said it would be completed within 60 to 90 days. On motion of Councilmember Moots, seconded by Councilmember Johnson, and unanimously carrie~ to award the contract for construction of the new signal at James Way and Oak Park Boulevard to Lee Wilson in the amount of $59,988.00. STATE WATER PROJECT, COASTAL BRANCH PROCESS AND PLANNING Deputy County Engineer Clint Milne appeared before the Council to discuss the State Water Project Coastal Branch. He introduced in the audience Bill Briam, County Administrative Officer; Don Smith and Pete Vawter of the County Advisory Committee; Larry Shep of the County Planning Com[ission, and Van Laurn of the County Engineering Staff. Mr. Milne briefed the Council on the County's Water Plan, including the State Water Project Coastal Branch costs and time factors. He s ai d the cost of State Water, not includinq treatment, would be approximately $330.00 an acre foot. He estimated that additional expenditures, which would be required to expand and operate the Lopez Treatment Plan, to be $70 per acre foot. He asked what the Council's interest is in receiving State water and if it would like to be part of an EIR. Mayor Pro Tem Gallagher said the State Water Project would allow Arroyo Grande ground water to be used for agricultural purposes, and the supplemental water for urban use and growth. He said the water project offers the City a future and comes at a timely period. Mr. Karp said that current water supplies will serve Arroyo Grande's needs to the mid 1990s or the turn of the century depending on growth rates experienced. He said resources will supply a population of almost 19,000. City Manager Robert Mack referred to his July 18, 1986, memo on the State project. He said the tables therin showed that development of an additional water source such as th~ State Water PrO.iect woul d provi de enouqh water for.Jhe City well_into the next century. After Council discussion, Councilmembers decided it wanted more input from the public. On motion of Councilmember Johnson, seconded by Councilmember Porter, and unanimously carried, to consider a series of study sessions on the subject. PUBLIC HEARING-APPEAL BY CITY COUNCILMEMBER MATT GALLAGHER OF PLANNING COMMISSION APPROVAL OF ARCHITECTURAL REVIEW CASE NO. 86-367, SALES ROOM ADDITION, 300 TRAFFIC WAY, VIGKPACE FORD Mr. Mack explained the background of this appeal. He said that the Planning Commission had approved a minor buildin~ addition at Vick Pace Ford, without two Staff Advisory Committee recommendatlons. He said that Councilmember Gallagher had appealed that approval. Mr. Karp said that Fair Oaks has been designated as a major route for travel in the General Plan Circulation Element and should be eventually developed at a width of 64 feet curb to curb on an 80 foot right of way. He said Fair Oaks will be developed to that width by new development on both sides of the freeway between Halcyon and Traffic Way. He said that if the offer to dedicate for future widening could be made now, the right of way would be available when the City Council wanted to widen Fair Oaks in front of Vick Pace Ford. He showed on the board what the Staff Advisory Committee was asking. Councilmember Gallagher said that looking at the proposal and at the width of the bridge across the freeway, taking any additional property from the dealership at this time would hinder the operation of the business. He said the road would not align with the freeway bridge anyway. CITY COUNCIL JULY 22, 1986 ARROYO GRANOE, CALIFORNIA PAGE THREE PUBLIC HEARING-APPEAL SALES ROOM ADDITION VICK PACE FORD-Continued WILLIAM WALTER, attorney representing Vick Pace, said he was at the meeting to request a two week continuance. Councilmember Gallagher said that for the reasons he gave before he was withdrawing his appeal. He said that the Planning Commission approval of building addition would stand without the added conditions. Councilmember Johnson apologized to Mr. Danny Pace for any inconvenience, and said that the Council appreciates the input he has to the community. PUBLIC HEARING-PROPOSED AMENDMENT TO CHANGE LAND USE FROM MEDIUM HIGH DENSITY RESIDENTIAL AND OPEN SPACE TO PROFESSIONAL COMMERCIAL AND LOW DENSITY RESIDENTIAL IN THE VICINITY OF HALCYON ROAD AND FAIR OAKS,JERREN E. JORGENSEN Planning Director Stanley Eisner gave a history of the various proposed development of this property located on South Halcyon Road north of the Arroyo Grande Community Hospital. He said the property was formally owned by the Grieb family. He referred to his Transmittal of Planning Commission Action on the subject saying that the Planning Commission recommends approval of the General Plan Amendment, with findings that this amendment is consistent with the goals and objectives of the General Plan and with the 7 elements of the Comprehensive General Plan. He said the Planning Commission recommends adoption of a negative declaration based on an initial environmental assessment. He said conditions recommended to mitigate any identified impacts, include (1) that an archaeological consultant be present on site during all excavation of the eastern portion of the site identified as a potential archaeological site, and (2) that a middle lane for left turns be extended to provide site access and mitigate site specific traffic impacts. He asked that Agenda Items 14 and 15 be considered together. Mayor Pro Tem Gallagher said the notice of public hearing had been duly published and all requirements governing hearings had been met and the hearing was declared open. CLIFFORD R. PIERSON of Alpine Street expressed concern about driveways in the proposed development interfering with his house. Mr. Eisner said that the City has not received the design plans for the development as yet. Councilmember Porter asked if Alpine Street would be widened, and Mr. Eisner said yes, the alignment would be changed to the full width. TOM BAUMBURGER, 106 Santa Rosa Street, San Luis Obispo, engineer for the project, said he wanted to reaffirm that Alpine would become a standard street, and the project would be in keeping with the land use of the existing properties. Mayor Pro Tern Gallagher called for others to speak, and when no one came forward, closed the public portion of the hearing. Councilmembers agreed that this was a viable plan, and had no objections. Mr. Eisner read the title of the Resolution. On motion of Councilmember Johnson, seconded by Councilmember Moots, and unanimously carried, to dispense with further reading of the Resolution. CALIFORNIA PAGE SIX WATER CONSERVATION PLAN Nr. Karp referred to his draft of the Water Conservatioo Plan for the City of Arrojl) Grande dated July 14, 1986. He said the plan was meant to be a lead off step to implementation of future measures. He summarized the plan and said that the City's Urban Water Management Plan, adopted December 18, 1985, by Resolution No. 1925, recommended continuing conservation measures and deve- lopment of new pr09rams to minimize or eliminate the per capita water demand increases. He recommended that the City Council review the plan and consider commencing its implementation by appointment of a Wat~~r Conservation A::Ivisory Carmittee. Councilmembers agreed with Mr. Karp's recommendations, and on motion of Councilmember Johnson, seconded by Councilmember Moots, and unanimously carried to ask Mayor Smith to appoint a Water Conservation Advisory Committee, which would include technical staff members, Lucia Mar Unified School District representatives, City Parks and Recreation representatives, and an advisor from agriculture whose experience could be called upon. OAK PARK SPHERE AND ANNEXATION STATUS REPORT, LAFCO HEARING POSITION, OAK PARK ANNEXATION POLICY PROPOSALS, OAK PARK ANNEXATION PREZONING Mr. Mack gave background on this issue. He said that the Local Agency Formation Commission had determined that both the Grace Bible Church/School and the 155 Oak Park Acres site should be in the City of Arroyo Grande Sphere of Influence and Sphere of Services. He said that both properties had made requests for annexation to the City (discussed in his July 17, 1986, memo) . He said the Oceano Community Services District Board of Directors had passed a resolution objecting to both properties being in the Sphere of Influence of the City and the Sanitation District. He said a July 21, 1986, letter from the City Council of Grover City said it would approve the properties coming under the City of Arroyo Grande's Sphere of Influence but not approve them coming under the City's Sphere of Service. Mr. Mack referred to his memo of July 18, 1986, and said that the City's representative at the August 21, 1986, LAFCo hearing will have to know the Council's position on Oceano Community Services District's request to remove "Oak Park Acres" from "the Service Area of the City of Arroyo Grande and the South San Luis Obispo County Sanitation District." Councilmembers asked questiuns ~bout LAFCo procedures. Councilmember Moots said the Council had previously approved by Resolution the City providing water and san itary sewer serv ices to the schoo 1. Counci lmember Ga 11 agher sai d the Sanitary District is already committed to provide services to the school. Referring to his July 14, 1986, Oak Park Annexation Policy Proposals, Mr. Mack said he had had response to these from the church and school and from Richmond Rossi Montgomery, designers and planners for Oak Park Development Company. CITY COUNCIL JULY 22, 1986 ARROYO GRANDE, CALIFORNIA PAGE SEVEN OAK PARK SPHERE AND ANNEXATION REPORT Continued R. GREGG ALBRIGHT, Grace Bible Church Building Committee Chairman said his church objected to Items 1-B and 4-A of the Policy Proposals. He said they could delay the expansion of the church to its new site. He said he.would like to see each piece of property be evaluated separately. He saId the church and school would move together in the building program, even though the school and church are two separate entities (done to broaden their support base). ROBERT ZIELINGA, Central Coast Christian Academy School development director, reiterated Mr. Albright's points. He also said the present school needs will not exceed what was asked for in the 1980 agreement. He said this issue affects a great number of people at nine churches in Arroyo Grande Nipomo and Grover City. ' City Attorney Art Shaw said the issues of the church/school site and the 155 Oak Park Acres could be discussed separately by the Council. After more Council discussion, on motion of Councilmember Johnson, seconded by Councilmember Moots, and unanimously carried, to hold a short study session on the issue of the church/school Sphere of Service, Influence and Annexation. Councilmembers asked that the 1980 agreement between the City of Arroyo Grande and Central Coast Christian Academy be available at the study session along with the Council meeting minutes. They also asked that the City Attorney be present. The Council directed that Mr. Mack coordinate the time and date with Mayor Smith. Mr. Mack said that looking at the response letter of July 21, 1986, from Grace Bible Church I he could see only two points of disagreement, 1. No annexation until the interchange is completed, and 2. No annexation until the Sanitation District says it has the line capacity to serve the church/school. He said his problem is with the 1980 agreement between the Citv and the school. and whether or not is applies and in what manner. JOHN WILBANKS of Richmond Rossi Montgomery said he was disappointed that the Council had separated the discussion and voting on the two properties. He said the 155 acres are uphill from the church/school and the two should be con- sidered together. He asked the Council to reconsider and approve Sphere of Influence and Service for both properties. He said the owners have every in- tention of preserving the oak trees on the site. There was more discussion on definitions of Sphere of Influence and Service, and Mr. Mack said the property will develop; it is just who will do and have influence over it. On motion of Councilmember Gallagher, seconded by Councilmember Moots, and unanimously carried, to put the 155 acres into the City's Sphere of Influence only, and to make Mr. Mack's Policy Recommendations conditions, with their full intent, for development. MR. WILBANKS said that with no development until the interchange is completed, there will be no EIR and.no reason to go ahead with the development of the 155 acres. RANCHO GRADE, TRACT 1132, GRADING PLAN, GRADING PLAN Mr. Karp referred to his memo of July 16, 1986, and discussed the grading plan for Tract 1132. He recommended that the Council review the grading plan in conformance with requirement of Ordinance 186 C.S. which rezoned Rancho Grande to planned development. Councilmembers said they would like to see the the site, and a tour with Mr. Karp was set up for 10 a.m. Tuesday, July 29, 1986. -.._----~---- CITY COUNCIL JULY 22, 1986 ARROYO GRANDE, CALIFORNIA PAGE EIGHT SUBDIVISION FLOOD CONTROL LIABILITY REPORT Mr. Shaw referred to his letter to the City Council about City Liability to Homeowners in Flooded Subdivision. He said the recent trend is to hold the City liable for approving a dangerous subdivision, even though the developer, the homeowners, or someone else negligently maintains protective measures or devices required for the approval of the subdivision. PLANNED OEVELOPMENT ORDINANCE REPORT Mr. Shaw recommended to the Council that it appoint two members to meet with Mr. Eisner and him to be involved in the preparation of a new planned development ordinance. Councilmembers Porter and Johnson said they would serve. CALIFORNIA MEN'S COLONY LABOR AGREEMENT Mr. Karp recommended that the Council authorize the Mayor and City Clerk to execute Amendment No. 1 to the referenced agreement. On motion of Council- member Johnson, seconded by Councilmember Moots, and unanimously carried, to approve the recommendation. RESOLUTION ADOPTING 1986/87 AND 1987/88 MEMORANDUM OF UNDERSTANDING WITH S.E.I.U. Mr. Mack said an agreement had been reached with the union, and the a9reement went into effect July 18, 1986. He read the title of the Resolution. On motion of Councillnember Johnson, seconded by Councilmember Moots, and unani- mously carried, to dispense with further reading of the Resolution. RESOLUTION NO. 1979 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AOOPTING A MEMORANDUM OF UNDERSTANDING WITH S.E.I.U. WHICH CONTAINS A SALARY SCHEDULE, POSITION CLASSIFICATIONS AND SALARY STEPS WITHIN THE RESPECTIVE RANGES OF THE SALARY SCHEDULE FOR 1986/87, 1987/88 AND REPEALING RESOLUTION 1777 On motion of Councilmember Porter, seconded by Councilmember Johnson, and on the following roll call vote, to wit: AYES: Councilmembers Gallagher, Johnson, Moots and Porter NOES: None ABSENT: Mayor Smith the foregoing Resolution was passed and adopted this 22nd day of July, 1986. PARKING AND TRAFFIC STREET COMMISSION RECOMMENDATION REGAROING LE POINT STREET EXTENSION Mr. Karp explained that the Parking and Traffic Commission reviewed the Le Point Street Commission Recommendations, and recommended their adoption with rewording of item number three. He said the Commission had changed the last sentence to read, "The ali9nment shall connect Wesley Street with Nevada Street, but should accommodate access without connection to Larchmont Drive~' After some questioning of the change by Councilmember Johnson and further Council discussion, on motion of Councilmember Porter, seconded by Councilmember Moots, and unanimously carried, to approve the Parking and Traffic Commission recom- mendations. TRAFFIC SIGNAL MAINTENANCE REPORT Referring to his memo of July 16, 1986, Mr. Karp recommended that the Council award a contract to Lee Wilson Electric Co. for the maintenance of traffic signals subject to the insurance requirements listed in the draft agreement prepared by staff. On motion of Councilmember Porter, seconded by Councilmember Moots, and unanimously carried, to approve Mr. Karp's recommendation. CITY COUNCIL JULY 22, 1986 ARROYO GRANDE, CALIFORNIA PAGE NINE PROPOSED REMODELING OF CHAMBER OF COMMERCE BUILDING Councilmember Johnson said that Bonita Homes had offered to remodel the City-owned Chamber of Commerce and Social Security Office building at its own expense. She said Bonita Homes had used the architectural guidelines for the Village, and gave the specifications to the Council. She passed around the proposed design for Councilmembers and staff to look at. On motion of Mayor Pro Tern Gallagher, seconded by Councilmember Moots, and unanimously carried to authorize the acceptance of the design and the starting of the project. CHAIRS FOR REMODELED COUNCIL CHAMBERS Councilmember Johnson asked for approval to order audience chairs for the newly remodeled Council Chambers, and other Councilmembers assented.
