Upon roll call Council Members Matt Gallagher, Dorace Johnson, Gene Moots and D. G. Porter were present. PLEDGE OF ALLEGIANCE AND INVOCATION Counci I Member Johnson led the Pledge of AI leg/ance to our flag. The Reverend Michael O'Sullivan of Saint Patrick's Catholic Church delivered the invocation. APPROVAL OF MINUTES On motion of Council Member Johnson, seconded by Council Member Gallagher, and unanimously carried, the Minutes of Meeting of June 25, 1985, were approved. .- APPROVAL OF CHECKS On mot i on of Counc i I Member Moots, seconded by Counc i 1 Member Ga 11 agher, and unanimously carried, Demand Checks No. 25,720 through 25,802 for $86,894.40, Nos. 25,803 through 25,861 for $17,175. 78, and Payroll Checks No. 30935 through 31090 for $92,465.84, with a Grand Total of $196,536.02, were approved for pay- ment as submitted by Finance Director David Bacon. PRESENTATION OF COMMUNITYSERVICE'AWARD Mayor Smith presented an award to Mary McAlister, reporter for the Times-Press-RecorJer, for her service as a reporter of City Council news for some time. j'.ayor $mith said the Council appreciated her fair reporting. Accepting for Miss. McAlister was Elaine Wohl, new City Council reporter for the newspaper. ORAL COl1MUN I CAT IONS MICHAEL WEINTRAUB, 193 Deer Trai I Avenue, said he is bui Iding a new house in this area, and has run against some major problems that he has been unable to solve. He asked the Council to give quick consideration to his bu i I ding problems when they are presented to the City Counc ill' FIRE STATUS REPORT Fire Chief Doug Hamp gave a fire status report. He said that as of 5 p.m. July 9,1985, the Las Pilitas ifire was 90 per cent contained due to higher humidity, a wind change, and a controlled burnout covering 10,000 acres. He said 64,000 acres were destroyed by the fire.and there was a $7 million water- shed and personal property loss. He said Arroyo Grande was in danger of burning only twice when the fire crossed Orcutt Road. He said the Arroyo Grande Fire Department participated in assisting fire fighters at Lopez Lake and sent an engine for a Strike Force in a San Luis Obispo residential area. He cau t i oned that the weather could be changing and we could be having electrical fires. CONSENT AGENDA Council Member Johnson withdrew Item 11 and Council Member Gallagher withdrew Item 21 from the Consent Agenda for discussion. Planning Commission Answered Agenda and/or Minutes of July 2, 1985 Council Member Johnson questioned Item No.4 of the Planning Commission minutes.and asked what the Cityls involvement was in the matter. Mr. Eisner said that the General Plan Amendment was initiated by the Planning Commission. 21. Paint Truck Award of Bid Council Member Gallagher asked if the truck went .out to bid as part of a package to get the best price. City Manager Bob Mack said no \that it is a speciality truck. Public Works' Director Paul Karp said he understood that the truck\ is fully modified and the whole package is waranteed by the person who was awarded \ the bid. \ On motion of Council Member Gallagher, seconded by Council Member Johnson, and unanimously carried, to approve Consent Agenda Items 11 and 21. \ VILLAGE AREA PARKING DISTRICT AND PRIVATE PROPERTY PARKING LOTS REVIEW Mr. Eisner said this item was a request from the Council of the Down- town Parking District. He referred to a map on the wall which outlined the district and showed parking lots which' are publicly owned and those which are privately owned. There are 202 privately owned spaces and 149 publicly owned spaces. Mr. Mack also said some private businesses also have their own parking spaces. Council Members asked questions of the Staff about the whole Parking Oistrict. . CIVIC CEtlTER DEVELOPMENT MID SITE SELECTION Mr. Hack referred to his lOCi ty of Arroyo Grande Civic Center Report to the Publ ic" and said faci 1 i ties proposed for replacement are the Pol ice Departmant Offices and Operations, the Emergency Operations Center, General Administrative and Departmental Offices. and and Cit~ Council,Chambers. He gave background on the item and said concerns about inadequacy of facilities date back to 1975. He described the proposed Regional Center Site and the proposed South Bank Site. Cost estimates for both were given. Mr. Mack presented 157 more signatures received by the City stating that the undersigned "wish the City Hall to remai n in the City Village." He said the petition total now is 1,054. Mayor Smi th said the Notice of Publ i.c. Hearing had been duly published and all legal requirements met and declared the hearing open. JAMES O'KEEFE of Bolsa Chica Mobi Ie Home Park said the city needs more pol ice officers to combat a climbing crime rate, not a new city hall. C.S. KUREK of 603 E. Cherry Ave. asked the Council if there would be enough money for construction of a new City Hall and repair the streets of the city. - ---. CORA HIGDON of 183 Fairview Drive asked the Council to put the question .- on the ballot. She said the city should improve roads and lighting before building a city hall. u)~~~ . THE REV. GREG WA. WR+GU.r, pastor of Grace Bible Church, said he supported a new civic center in the village area. . JIM SILVA of 500 Ide Street spoke in favor of a new civic Center in the village area, and said the current facilities are not equipped to house the computers which will be necessary in.the future. GORDON BENNETT of 415 Allen Street said for historic reasons the city hall should be in the village, but that he is worried about the increased traffic it would cause. MIKE ZIMMERMAN, whose office is at 227 E. Branch, said he would like to see the city hall kept in the vilJage because it is beneficial to the merchants, that the issue should not be put to a vote, that the Council Chambers could be sold to raise money, and that he. would suggest using late 1800 or early 1900 architecture on the new building. RUSS POTTER of 161 Hondonada Road asked the Council to use the quality and character of the Village in the architecture at the South Bank site. CAROL SMITH of 146 Tally Ho Road said street and traffic problems should be solved before a new city hall is bui I t. She was concerned about what would happen to the Pre-School now. located at the Parks and Recreation Center. MARIE CATTOIR of 195 Orchid Lane said there are problems such as traffic circulation, drainage, good roadways and resourCeS that should be dealt with before a new city hall is bui1t. She said practical matters sho~ld come before luxury items. CLARK MOORE of 1180 Ash Street said the city has a lot of problems such as drainage and roads, which are as important as the foundation.of a house. DORIS OLSEN of 573 Via La Barranca asked the Council. if one plan for construction of the civic center didn't call for stage development. RUSS POTTER of 161 Hondonada asked the Council if the city could pursue more than one major project at a time. Mayor Smith called for others to speak; when no came forward the public hearing was closed. Council Members further discussed the proposed civic center, taking up the issues of whether or not to build at all or remodel, where the center should be located, financing the center, and whether or not to put the issue on the ballot. Mr. Mack suggested that the cost of the civic center should be spread out over at least 20 years so that the burden rests not only on current but also future residents. On motion of Council Member Moots, seconded by Council Member Gallagher, and unanimously carried to continue discussion of the item at the next meeting. PUBLI C HEAR I NG ON PROPOSED TRAFF I C WAY UNDERGROUND UTI LI TY 0 I STR I CT NO. 4 Mr. Eisner said that approximately a year ago the Council passed a resolution with the intention of studying the possibility of an underground utility district covering the area of Traffic Way and including Bridge Street. He referred to I . , the Underground Utility Oistrict Map dated April 18, 1985 in describing the \ boundaries of the district. He said the boundaries were recommended by the utility companies and are based on the funds that are available from the "set aside" from the various uti I ity companies. He said the project area would make a major visual contribution to the community improving its overall - image. He said the utilities that are participating at this time are PG&E, the telephone company, Sonic Cable and the Gas Company as well as the City's Pub I ic Works Department. JAY CONNER, Five Cities Manager of PG&E, said the Traffic Way Undergrounding Advisory Committee was established at the.direction of the City Council May Z2, 1984. ~irection was given to do Tr.affic Way and expand to the limits possible with resources available. He said the lines on the map follows property lines. He said the project will cost each of the utilities $453,000.00. Mr. Mack said the State sets aside monies for communities to use for undergrounding. He said the utilities will be put underground in the sidewalk areas of the properties, and property owners will have to pay the cost of taking the utilities from the sidewalk areas to their structures being served. He said each property costwiJ1 be different and the City went to a private electrical contractor to get cost estimates for the owners. He referred to his July 8, 1985 letter to the property owners,explaining the proposed district, and the attached estimates sheet where properties were listed by address. Mayor Smith said the Notice of Public Hearing had been duly published and al I legal requirements met and declared the hearing open. BOB BALDWIN of 416 Allen Street said he had been in business on Traffic Way for 35 years and he ~Id not have the funds set aside for undergrounding his utilities. His businesses are at 139 and 135 Traffic Way. JAMES PENDERGRAFT of 1023 Meadow Way said the assessments were excessive. \ .Mr. Mack explained that the sheet which went to property owners included cost estimates only, not assessments. He said property owners would hire their own:contractors. BILL HART of Huasna Road, property owners on Bridge Street, said he supports the idea of undergrounding but feels'the cost estimates were high. RUSS POTTER of 161 Honorada Road, owns property at 146, 154, ZOO, 202 and 210 Traffic Way, said he supports the undergrounding because Traffic Way is the first entrance to Arroyo Grande ana it deserves to be a nice part of the Vi llage. He agreed the cost estimates were high and said owners could do the y~rk themselves or go together with other owner$ to do the job. C:'--' . . RAY SrLVESTER, representing Grace Bible Church, said he hadn't received the letter and estimate sheets, and at .this time would be against the under- grounding. JERRY BOWSER of 510 Woodland Orive spoke in favor of the project citing the beauty of Branch Street. He said it would benefit the overall area. !V(/iif"~ ... She said that accor- ding to Rule No. 20 of the Entit)ement if the Council should so decide the entire cost of the connections to the private properties could be taken from the initial amount of $453,000.00 JAMES PENDERGRAFT, 1023 Meadow Way, spoke again to say he is in favor of the project, but not the estimates. A question from the audience asked why Bob's Repair and Log Cabin Market were not on the estimate list. It was decided that both were on the list and , , that Bob's Repair.already had undergrounding. I - FREDA MARTIN of 115 Allen said asked why she was not on the list, and she was told she was not in the district. JAY CONNER of PG&E said the funds for this project have been accrued over a period of time from the entire population of the City of Arroyo Grande, and that his concern is in seeing that they are properly used. VACATION AND ABANDONMENT OF DESIGNATED PORTION OF HARDEN STREET I Mr. Mack said.the City has been unable to substantiate the ownership of Harden Street by Title Company. He said i# is his belief that Harden. street does belong to the Ci ty and the reason the ti tIe is hard to find is that. the property has not been bought and sold numerous times. Mayor Smith called for members of the public to speak; when no one came forward the-continued public hearing was closed. On motion of Council Member Gallagher, seconded by Council Member Moots, and unanimously carried to reject the request for abandonment of Harden Street until such time as firm project plans have been submitted for development of the parcels of land at the corner of East Branch Street and Mason Street. 1 ~ .~ CITY COUNCIL JULY 9, 1985 ARROYO GRANDE, CALIFORNIA PAGE SIX TALLY HO ROAO ANO WATER LINE IMPROVEMENTS AWARD OF BIDS - Mr. K~rp said that, acting on direction of the City Coun~il, the T~lly Ho Road Improvements project was rebid as a result of an ~bnormality in the original bids received for the project. Inasmuch as the City has entered into a new fiscal year, the staff elected to include in this project the second phase construction of the Tally Ho Road water line replacement budgeted for fiscal year 1985-1986, he said. Mr. Karp said that three bids were received. on July 8, .1985, "and the low bid was submitted by John Madonna Construction Co. In checking all three bids, he said, a clerical error was found in the Madonna bid and the error - is noted in the bid summary. Under bid Item 17, Fire Hydrant, Madonna did not extend the unit price of $1800.00 by the nine fire hydrants. He said. as a result, the figure listed as grand total in his proposal is approximately $15,000 lower than it would have been had he not made the error. Mr. Karp referred to a July 9, 1985, letter from Mr. Madonna acknowledging the error within his bid. On motion of Council Member Gallagher, seconded by Council Member Moots, and unanimously carried to ~ward the Tally Ho Road Improvements Project No. 60-90-85-2 to the John Madonna Construction Co. in the amount of $294,999.95. EAST BRANCH $'KEET CURB ANO SIDEWALK INSTALLATION SLIDE PRESENTATION Counc i I Member Ga II agher showed s n des of Each Branch Street at Crown Hill which he said demonstrated the need for sidewalks so that people who live on the East side of the city can walk into the Village.. He said students at Paulding .Intermediate School also need the sidewalks for walking to schoo I . He said the closing of Crown Hi \.1 street last year also created more problems for walkers. Council Members discussed whether to put in the sidewalks on the North or South side of Branch Street between Garden and Stanley streets. RUSS POTTER of 161 Hondonada said it is a dangerous situation for school children walking to Paulding School. He said he is su..prised more chi Idren have not been injured. Council Members asked Mr. Karp to return to the next meeting July 23, 1985, with figures on what it would cost to design the sidewalks. MAXIMUM BUILOING HEIGHT LIMITATIONS Mayor Smith said re~ently there have been problems with building heights and residents building their houses too high and blocking others' views. She s~id the City Ordinance now says that the bui lder..takes the high level of.'the property and the low level and goes to the middle and then builds up 30 feet.
