Minutes 1984-10-01 - . , ,. . c .~ CITY COUNCIL OCTOBER 1, 1984 ARROYO GRANDE, CALIFORNIA 7:30 P.M. The City Council met in regular session with Mayor B'Ann Smith presiding. Upon roll call, Councilmen Matt Gallagher, Mark Millis and Lawrence Vandeveer were present, Councilman Karl Hogan was absent. PLEDGE OF ALLEGIANCE AND INVOCATION Councilman Vandeveer led the Pledge of Allegiance to our Flag. Councilman Millis delivered the invocation. APPROVAL OF MINUTES On motion of Councilman Vandeveer, seconded by Councilman Gallagher, and unani- mously carried, the Minutes for the Meetings of September 11 and September 18, 1984, were approved as submitted. APPROVAL OF CHECKS On motion of Councilman Vandeveer, seconded by Councilman Gallagher, and unani- mously carried, Demand Checks No. 23455 through 23548 in the total amount of $254,343.61; and Payroll Checks No. 28626 through 28739 in the total amount of $73,297.80, were approved for payment as submitted. PRESENTATION OF CERTIFICATES OF RECOGNITION AND CONGRATULATIONS Mayor Smith congratulated Mrs. Cynthia Romain and presented a Certificate of Recognition to her, as a recently naturalized citizen of the USA. Three other Certificates have been prepared and will be hand delivered. CONSENT AGENDA Consent Agenda Items 9-b, 9-e and 10-f were withdrawn for discussion. On motion of Councilman Millis, seconded by Councilman Vandeveer and unanimously carried, all other Consent Agenda Items 8 through 12, including all subtitles, were approved as recommended. .. Planning Commission Minutes of 9/18/84. Councilman Gallagher expressed his concern regarding Architectural Review Case No. 84-315, 6 Unit Apartment Complex, 1162 Ash Street in the R-G District. He said the Planning Commission echoed his concerns in how apartment complexes are approved and the amenities that are included in the projects, which will be depicted in the pictures he planned to share with Council later in the meeting. 9. e. Zone 3 Ad'Hsory Committee Notes of 8/16/84. Mayor Smith commented on the Minutes oLthe Committee Meeting and specifi- cally on the comments of Mr. Wilkinson, regarding water control and allotted supplies to the various users. 10. f. Lucia Mar Unified School District Annual Interim School Fees Report. Councilman Gallagher questioned the expenditure made for Judkins' Physical Education Complex and Councilman Millis explained that State law requires that Phys. Ed. classes be offered and the expenditure was at District expense, and responded to the growth in student population. City Manager Mack said a discrepancy in the report was found and the City had asked for reconciliation; plus a statement from the Oistrict indicating what facilities are still inadequate. RESOLUTION ADOPTION: APPLICATION FOR STATE GRANT FUNDS FOR SOTO PARK COMPLEX Parks and Recreation Director John Keisler explained the application for State Grant Funds and read the title of the Resolution. On motion of Councilman Gallagher, seconded by Councilman Millis, and unanimously carried, to dispense with further reading of the Resolution. RESOLUTI ON NO. 1801 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING THE APPLICATION FOR GRANT FUNDS UNDER THE 1984 REGIONAL COMPETITIVE PARK AND RECREATION GRANT PROGRAM FOR THE SOTO PARK COMPLEX. On motion of Councilman Millis, seconded by Councilman Gallagher, and on the following roll call vote, to wit: AYES: Councilmen Gallagher, Millis, Vandeveer and Mayor Smith NOES: None ABSENT: Councilman Hogan the foregoing Resolution was passed and adopted the 1st day of October 1984. RESOLUTION ADOPTION: THIRTY M.P.H. SPEED LIMIT ON WEST BRANCH STREET Public Works Oirector Paul Karp read the title of the Resolution. HALCYON Mr. Karp explained the reason for the request of limited parking, and read the title of the Resolution. On motion of Councilman Gallagher, seconded by Councilman Vandeveer, and unanimously carried, to dispense with further reading of the Resolution. RESOLUTION NO. 1803 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ESTABLISHING THIRTY (30) MINUTES PARKING ZONE ON A PORTION OF NORTH HALCYON ROAD (AKA 121 N. HALCYON ROAD) ENCOMPASSING A MINIMUM OF TWO (2) PARKING SPACES. On motion of Councilman Gallagher, seconded by Councilman Vandeveer, and on the following rol1 call vote, to wi t: AYES: Councilmen Gallagher, Millis, Vandeveer and Mayor Smith NOES: None ABSENT: Councilman Hogan the foregoing Resolution was passed and adopted this 1st day of October 1984. REPORT: SIDEWALK PROJECT TO FORM DISTRICTS City Manager Robert Mack said that following discussions, Staff agrees the best way to resolve some of the sidewalk problems is through Sidewalk Assessment Districts. He said the legal steps necessary to form Assessment Districts pose a problem and advocated creating a new Staff position for a qualified engineer to work under the Public Works Director and be charged with traffic control to include the creation of sidewalk projects and districts. Council concurred and supported Mr. Mack's recommendation. On motion of Councilman Gallagher, seconded by Councilman Millis, and unanimously carried, to authorize the City Manager to advertise the position of Project Engineer, as a full time employee. REPORT: OAK PARK INTERCHANGE PROJECT Mr. Mack advised Council that no call had been received from Pismo Beach for a permit for inspection for the connection of their street onto Arroyo Grande's Oak ! Park Boulevard at James Way. An inspection of the improvements has been called for to confirm that section conforms to Arroyo Grande's construction standards. I Mayor Smith asked Mr. Mack to write a formal letter to Pismo Beach voicing , objections to the work being done without a permit and to make a concerted effort to work the problems out with neighboring cities on a staff level. Mr. Mack said he would write the letter tomorrow expressing City's concern and ask that the concern be shared with Pismo Beach City Council at their next meeting. , I I WEST BRANCH STREET PLANNING I , Councilman Gallagher said the City does not have a plan for West Branch Street, , nor where the connections will be. He said he felt this should be addressed before further development of the area. Councilman Gallagher made a motion, seconded by Councilman Millis for discussion, to move ahead with engineering plans and design study for West Branch Street before the budget sessions take place. The cos t of the study not to exceed $10,000.00. Council discussion followed regarding alternative plans of connecting West Branch Street to the Village area and the motion for a feasibility study to include cost estimates was carried unanimously. CROSS STREET DEVELOPMENt Councilman Gallagher expressed his concern with Cross Street development and using a posted map explained where sterile fill had been placed, where fences were located, and drainage ditches were planned to be located. During discussion, the Council was addressed by ED PHILLIPS, 526 Cross Street; OSCAR GRASSLE, 229 Railroad Place; ROD HOGAN, 247 Cross Street; D. G. Further discussion followed, and Council di rected the Planning and Pub I ic Works Staff to review the existing Grading Ordinance and suggest guidelines dealing with the interface between new developments and previously established neighborhood grades. Staff indicated that after work was completed a submittal would be forwarded to the City Council at a future meeting. SUNSET STORM DRAIN SAFETY Councilman Gallagher shared with Council a picture of a 36" storm drain that posed a hazardous situation because the drain had a slot in it, and ran 10 to 12 feet deep, and was of great danger to children and others in the area. Mr. Karp said the danger area had been corrected the same night that notification of the problem was received. ORDINANCE ADOPTED: AMEND ORDINANCE NO. 140 C.5. Mr. Mack read the title of the Ordinance. On motion of Councilman Gallagher, seconded by Councilman Vandeveer, and unanimously carried, to dispense with further reading of the Ordinance. ORDINANCE NO. 316 C.S. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AMENDING ORDINANCE NO. 140 C.S. TO ALLOW USES PERMITTED IN THE PROFESSIONAL COMMERCIAL (P-C) ZONE ON PARCEL 3, TRACT 604, OAK PARK ACRES. On motion of Councilman Gallagher, seconded by Councilman Vandeveer, and on the following roll call vote, to wit: AYES: Councilmen Gallagher, Millis, Vandeveer and Mayor Smith NOES: None ABSENT: Councilman Hogan the foregoing Ordinance was passed and adopted the 1st day of October 1984. WRITTEN COMMUNICATIONS None ORAL COMMUNICATIONS Councilman Gallagher said he had some slides ready for Council to view, and some photographs which will be made into slides for future presentation. He said the areas shown in the pictures are heavily populated with children living in an Elm Street project. He said the slides show the large asphalt sections, compared to the very small areas committed to grass and trees. Councilman Gallagher recommended that Council consider eliminating R-3 and R-G classifications and create a multi- development classification not. to exceed certain housing density. He also said he would like to serve on the Architectural Review Committee, and it was agreed that he could and should, but only as an observer. Councilman Vandeveer said he felt it was not a density factor but an economical factor that determines the amenities included in the housing projects. Mayor Smith suggested the matter be sent back to the Planning Commission with the concerns of Councilman Gallagher on R-G, R-2 and R-3, and let them study It first. ADJOURNMENT Mayor Smith adjourned the Regular Session to Closed Session at 10:15 P.M. RECONVENEMENT AND ADJOURNMENT The Council reconvened in Regular Session at 10:27 P.M. after Closed Session.
