ORDINANCE NO. 323 C.S.
AN INTERIM URGENCY ORDINANCE OF THE CITY OF
ARROYO GRANDE EXTENDING THE PROHIBITIONS ON
APPROVAL OF PERMITS OR OTHER ENTITLEMENTS
FOR KITCHENETTE TYPE MOTELS, AND FOR MOTELS
WITHOUT USE PERMITS, PENDING FURTHER STUDY
OF CONTEMPLATED ZONING PROPOSALS

WHEREAS, on March 12, 1985, this Council adopted Urgency Ordinance No. 319 C.S.,
effective for a 45 day period, prohibiting the issuance of permits or approvals
for kitchenette type motels, and for motels in zones without requirements for
formal use permit procedures; and
WHEREAS, the City has begun a study of zoning proposals to determine whether
or not the C"ity's zoning laws sAould be amended to better regulate such motels; and
WHEREAS, the study will take an extended period of time and the Council desires
to extend the prohibitions of Ordinance No. 319 C.S. for an additional 10 months
and 15 days as provided by Government Code Section 65858.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN
AS FOLLOWS:
Sect ion I
The prohibitions of Ordinance No., 319 C.S. are hereby extended for an addi-
tional 10 months and 15 days to March 11, 1986, namely:
"No permits, approvals, or other entitlements shall be
granted or issued during the effective period of this
ordinance (1) for any motels without formal use permit
approvals, or (2) for any kitchenette type motels."
Section 2
To avoid unnecessary delays, the Planning Commission and Planning Department
are requested to give priority attention to the study of the problems involved
in approval of motels without use permits, and in the approval of kitchenette type
motels. The Planning Department is directed to make a monthly report to this
Council concerning the progress of the study.
Section 3
After notice pursuant to Government Code Section 65856 and Public Hearing,
and upon adoption by a four-fifths vote of the Council, this Ordinance for the
proetction of the public safety, health and welfare. The reasons for this
extension of Ordinance No. 319 C.S. are the same as those set forth in Section 3
thereof, and the Council specifically finds that there is a current threat to
the public health, safety or welfare, and approvals of motels without use permits
or of kitchenette type motels without further safeguards would result in a threat
to the public health, safety or welfare.
Section 4
This Ordinance shall be in effect for 45 days after its adoPtion; provided
that the Ordinance may be further extended in accordance with Government Code
Section 65858.
Section 5
Within fifteen (15) days after its passage, this Ordinance shall be published
once, together with the names of the Council Members voting thereon, in a newspaper
of general circulation within the City, but failure to publish for any reason
shall not affect the validity of the Ordinance.
