AN INTERIM URGENCY ORDINANCE OF THE CITY OF
ARROYO GRANDE PROHIBITING APPROVALS OF PERMITS
OR OTHER ENTITLEMENTS FOR MOTELS, INCLUDING
KITCHENETTE TYPE MOTELS, PENDING STUDY OF
CONTEMPLATED ZONING PROPOSALS. i

WHEREAS, this Council desires within a reasonable time to study contemplated
zoning proposals to better regulate the issuance of permits and approvals of
motels without use permits, and of motels with kitchenette units, to protect
the public safety, health and welfare.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARROYO GRANOE DOES ORDAIN
AS FOLLOWS:

This Council hereby finds and declares that it Is necessary and appropriate
for the City ot contemplate and study zoning proposals for the better regulation
of motels with kitchenette units, and of motel approvals without formal use
permit procedures in certain zones.
Sec t ion 2
Pursuant to the authority of California Government Code 65858, and notwith-
standing the provisions of any other City ordinance, regulation, or plan, the
City Council hereby orders that no permits, approvals, or other entitlements
shall be granted or issued during the effective period of this ordinance for any
motels without formal use permit approvals, or for any kitchenette type motels.
Section 3 I
Upon adoption by a four-fifths vote of the Council, this ordinance shall
become effective immediately as an Interim urgency ordinance for the protection
of the public safety, health and welfare. The reasons for the urgency ordinance
include the fact that a proposed kitchenette motel is seeking final approval
without a use permit in an H-S zone; such motels could lead to permanent
residential usage without the City's usual amenities for residents of multi-
family type dwellings in the City; and it appears that certain portions of the
H-S zone are not appropriate for motels.
Sec t i on 4
This Ordinance shall be in effect for 45 days after its adoption; provided
that the Ordinance effectivenes~ may be further extended in accordance with
Government Code 65858.
Section 5
Within fifteen (15) days after its passage, it shall be published once,
together with the names of the Council Members voting thereon, in a newspaper
of general circulation within the City, but failure to publish for any reason
shall not effect the validity of the Ordinance.
On motion of Council Member Porter, seconded by Council Member Gallagher,
and on the following roll call vote, to wit:
AYES: Council Members Gallagher, Johnson, Moots, Porter and Mayor Smith.
NOES: None
ABSENT: None
the foregoing Ordinance was passed and adopted at this reading on the 12th day
of March 1985.
