AN ORDINANCE OF THE CITY OF ARROYO GRANDE
AMENDING THE ARROYO GRANDE MUNICIPAL CODE BY
AMENDING CHAPTER 7, SECTION 2 OF TITLE 5 OF
THE ARROYO GRANDE MUN I C I PAL CODE RELATI NG TO
NOISES WHICH DISTURB THE PEACE
THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS
FOLLOWS:
SECTION 1: The following section of Chapter 7, Title 5 of the
Arroyo Grande Municipal Code is amended to read as follows: I
Section 507.02. Disturbing the Peace. No person owning or
having the care, custody, possession, or control of any radio receiving set,
music box, player pi~no, phonograph, or other machine or devic~ for the
producing or the reproduction of s9und or for the intensification or
amplification of sound shall play, use, operate, or permit to be played,
used, or operated, such radio receiving ~et, music box, player piano,
phonograph or other machine or device in any restaurant, lunch counter,
hotel lobby, liquor establishment, cocktail bar, or any other place of
business, or any vehicle or residence~ within the City in such a manner
that the peace and good order of tneneigbborhood is dISturbed or that
any person own i ng, us i ng, or occupyi..-property . i n the- nei'ghborhood is
disturbed or annoyed.
The operation of any such radio receiving set, music box, player piano,
phonograph, or other machine or device in such manner as to be plainly
audible at a distance of fifty (501) feet from the building, structure,
or vehicle, in which it is located shall be prima facie evidence of a
violation of this chapter.
SECT! ON 2: This Ordinance shall be in full force and effect
thirty (30) days after its passage, and within fifteen (15) days after
its passage, it shall be published once, together with the names of the
Council Members voting thereon, in the Five Cities Times-Press-Recorder.
On motion of Council Member Vandeveer, seconded by Council Member
Hogan, and on the following roll call vote, to wit:
AYES: Council Members Hogan, Millis, Vandeveer, Mayor Pope
NOES: None
ABSENT: Council Member Smith
the foregoing Ordinance was passed and adopted this 8th day of December, 1981.
