A PORTI ON OF THE ZON I NG MAP OF THE CITY OF ARROYO
GRANDE REFERRED TO IN SECTION .302 OF TITLE 9.
CHAPTER 4, OF THE MUNICIPAL CODE SO AS TO REZONE
CERTAIN PROPERTY IN THE CITY OF ARROYO GRANDE
KNOWN AS GRANDE HIGHLANDS
THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS:
SECTION 1: That certain ordinance known as "ZONING ORDINANCE OF THE
[ C \TY OF ARROYO GRANDE" is herewi th amended as follows:
The "ZON I NG MAP OF THE C I TV OF ARROYO GRANDE", referred to inSect i on
.302 of Title 9, Chapter 4 of the Municipal Code is amended so the "A"
District as shown and designated on the map attached hereto, and by this
reference incorporated herein, which map is entitled "A SECTION OF THE ZONING
MAP OF THE CITY OF ARROYO GRANDE", and sa i d map and a 11 notat ions and
references shown thereon shall be as much a part of this ordinance as if
the matters shown on said map were all fully described herein, and the
Districts and zones and boundaries of the property shown therein,fnom and
after the effective date of the adoption of this ordinance. The properties
intended to be rezoned are described in Exhibit "A" attached hereto.
The referred to property is hereby rezoned from "A", Agriculture, to
"P-D" , Planned Development zone.
SECTION 2: DEVELOPMENT PROVISIONS. The following provisions
shall apply to any planned development of the property described in
Exhi bi t "A: attached hereto:
I. The:developer shall consider the following drainage policy
in final planning and engineering of the proje~t:
I
A. Permanent channel shall be constructed through the applicant's
parcels for conveyance of 100 year discharge of the area
tributary to the property.
B. Ponding for retention and retarding will be considered as
alternatives to drainage resolution subject to final engineering.
C. The developer will not concentrate or increase runoff to
downstream parcels. Downstream parcels wIll be responsible
for conveyance of drainage through their parcels with
improvements to be constructed with future proposed development.
If the developer volunteers to appropriate drainage fees toward
downstream improvements at a future date, funds collected by the
City will be placed in a special reserve for future disbursement
to developers of downstream improvements upon future City approval.
2. Planned development is hereby approved with a density of 183
'[ dwell ing units.
3. Final planning and engineering plans to be consistent with the
approved Conceptual Master Plan, Alternative #3, labelled Exhibit "A".
Provided that minor boundary and area adjustments to lots may be made, if
determined to be reasonable as part of the approval of the tentative map.
SECTION 3: This ordinance shall be in full force and effect thirty
(30) days after its passage; and within fifteen (15) days after its passage,
it shall be pUblished once, together with the names of the Council Members
vot i ng thereon, in the Five Cities Times-Press-Recorder.
