RESOLUTION NO. 2013
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARROYO GRANDE CONFIRMING
THE STATEMENT OF ABATEMENT COSTS
CONNECTED WITH 238 JAMES WAY
(Municipal Code Sec. 4-15.13)
WHEREAS, the City Council of the City of Arroyo Grande has adopted
Resolution No. 2001 confirming the existence of a Public Nuisance; and
WHEREAS, the owners of said property have not abated the nuisance
within the time limit set forth by the City Council; and
WHEREAS, the City of Arroyo Grande has caused the nuisance to be
abated, and has kept an account of the costs incurred by the City for said
abatement; and
WHEREAS, publication of the Public Hearing Notice, posting of the
Public Hearing Notice and Statement of Abatement Costs on the property,
and mailing of the Public Hearing Notice and State of Abatement Costs to
the property owners have taken place; and
WHEREAS, a public hearing has been held to consider the Statement
of Nuisance Abatement Costs incurred by the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Arroyo Grande confirms the Statement of Costs set forth in Exhibit "A";
and
BE IT FURTHER RESOLVED that the Statement of Costs shall constitute
a special assessment, and if payment in full is not made within 30 days,
a Notice of Lien shall be filed with the San Luis Obispo County Recorder.
On motion of Council Member Moots, seconded by Council
Member Johnson, and on the following roll call vote, to wit:
AYES: Council Members Moots, Johnson and Millis and Mayor Mankins
NOES: None
ABSENT: Council Member Porter
the foregoing Resolution was passed and adopted this 13th day of January,
1987.
