\ RESOLUTION NO. 1948
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE APPROVING AMENDMENTS TO THE GRADING,DRAINAGE,
AND RIGHT-OF-WAY PLANS FOR TRACT 1187 CZOGATAt; AND
ESfABLISHINGCITY POLICY FOR ROAD ACCESS FOR ADJOINING 40
ACRE PARCEL; AND FlTIURE EMERGENCY VEHICLE . ACCESS
REQUIREMENTS FROM PEAR WOOD AVENUE TO GULARTE ROAD
WHEREAS, on or about June 26, 1984, the City approved a Tentative Subdivision Map for Tract
No. 1187 for Joe Zogata; and
WHEREAS, to solve drainage problems in developing the tract, the City Engineer reconmended,
and the Council approved, grading of various streets and lots to divert a substantial amount of water to
one of the lots Mlich was to be dedicated as a retarding drainage basin, with a controlled drainage
outlet approximately six hundred feet along the easterly side of the Tract down to the existing
Pearwood Avenue, with eventual discharge as surface drainage onto Pearwood avenue; and
WHEREAS, said extensive grading would create a differential in elevation between Tract 1187
and the adjoining undeveloped Lemon property with an average vertical separation of five feet at the
eed of Gularte Road in Tract 1187, thus creating substantial access problems whenever the Lemon
property is developed; and
WHEREAS, the City has since concluded exteeded litigation and has acquired and is ilq>roving
the large Pearwood drainage pond easterly of the residences on Pearwood Avenue; and
WHEREAS, the developer of Tract 1187 has proposed, and the City Engineer has recomnended,
that the Pearwood pond, with minor modifications, can better accomnodate the drainage Mlich was to
flow into. said retarding basin, with substantial public benefit to the City, as well as private benefit to
the developer; and
WHEREAS, this Council is amenable to amending said tentative Tract Map to reduce grading,
improve drainage, and to provide for a future emergency vehicle access road from Pearwood A venue to
GuIarte Road.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande as
follows :
1. This Council approves the following amendments to Tentative Tract Map No. 1187:
A. The developer shall construct an underground drainage structure with two catch basins from
the cuI-de-sac at the easterly eed of GuIarte Street within a twenty-five foot dedicated
public right-of-way along the easterly side of the Tract to Pearwood pond northerly of
Pearwood A venue. Developer shall increase the storage capacity of said Pearwood pond to
accomnodate the additional flow into the Pearwood pond from this new drainage.
B. The subdivision grading plans shall be amended to reflect changes required in this resolution.
It shall be specifically required that the elevation of the cuI-de-sac at the easterly end of
Gularte Street shall approximate the existing elevation on the adjoining Lemon property.
C. The fifteen foot public right-of-way granted to the City along the easterly side of the
Zogata property shall be ilq>roved to include a ten foot wide asphalt drainage channel for
surface storm flow, emergency vehicle use and pedestrian use only. The asphalt channel
shall be designed to intercept storm waters from the Zogata property and channel them to the
bottom of the hill at Mlich point they shall be interrupted by a catch basin comected to
storm line constructed below. The Council desires that DUch of the sunace drainage now
going down Pearwood A venue from the Zogata property be diverted directly to the pond.
the asphalt channel shall be designed with a berm or other barrier Mlich prevents vehicle
access except at GuIarte Street and Pearwood Avenue. The Pearwood access shall be
gated and locked.
D. The developer shall also dedicate a 15' access and drainage easement from Pearwood to the
Pearwood pond along the westetly side of the present Phillip's property.
2. It is the intention and policy of this Council that:
A. there will be no general public right-of-way access for vehicular use between Pearwood
Avenue and GuIarte Road.
B. Access to the Lemon and other properties at the top of the hill for private vehicuIar use will
be made available through Gularte Road and Tract 1187. The narrow portion of Pearwood
A venue beside the bluff on the Lemon property precludes unnecessary traffic uses.
