CC 2018-09-25_09c Approval of CC Minutes_9-11-18ACTION MINUTES REGULAR MEETING OF THE CITY COUNCIL TUESDAY, SEPTEMBER 11, 2018 COUNCIL CHAMBERS, 215 E. BRANCH STREET ARROYO GRANDE, CALIFORNIA 1. CALL TO ORDER Mayor Hill called the City Council Meeting to order at 6:00 p.m. 2. ROLL CALL City Council: Council Members Kristen Barneich, Barbara Harmon and Tim Brown, Mayor Pro Tem Caren Ray, and Mayor Jim Hill were present. Staff Present: City Manager Jim Bergman, City Attorney Heather Whitham, Director of Legislative and Information Services/City Clerk Kelly Wetmore, and Chief of Police Beau Pryor 3. MOMENT OF REFLECTION Mayor Hill requested the moment of reflection be extended to a full minute in remembrance of the victims of 9/11, including the first responders, who lost their lives in New York City, rural Pennsylvania and Washington DC. 4. FLAG SALUTE Members of Boy Scout Troop 450 led the Flag Salute. Boy Scout Zachary Hall announced that on Sunday, September 9th, he unveiled his Eagle Scout project - located at Five Cities Fire Authority Station 1 - which is a memorial honoring the 2,977 civilians and responders who lost their lives in the terrorist attack that occurred on September 11, 2001. 5. AGENDA REVIEW 5.a. Closed Session Announcements. None. 5.b. Ordinances Read in Title Only. Council Member Brown moved, Council Member Barneich seconded, and the motion passed unanimously that all ordinances presented at the meeting shall be read by title only and all further readings be waived. 6. SPECIAL PRESENTATIONS 6.a. Mayor’s Commendation in Recognition of the Arroyo Grande Lions Club for its Donation to the Arroyo Grande Police Department K-9 Program. Mayor Hill presented a Commendation to the Arroyo Grande Lions Club in appreciation of its donation of $5,000 benefitting the Arroyo Grande Police Department K-9 Program, which will provide Arroyo Grande Police K-9 “Tig” with firearm detection training and certification. Steve Wilson, representing the Lions Club, accepted the Commendation. Mayor Hill acknowledged Police Officer Jeffery Corral and Police K-9 Tig who were in attendance. Item 9.c. - Page 1 Minutes: City Council Meeting Page 2 Tuesday, September 11, 2018 7. COMMUNITY COMMENTS AND SUGGESTIONS Mayor Hill invited public comment. Speaking from the public were: Sharlotte Wilson, who offered an invocation; Laura Sheehan, expressed concerns about the Planning Commission’s approval of Conditional Use Permit 18-004 (commercial project at former Kmart shopping center on W. Branch Street) and requested information on the appeal process; Dan Feldman, Atheist United of San Luis Obispo, advocated for the separation of church and state and expressed concern about the intrusion of religion in government; Mary Jane Sage, representing HealSLO - Healthy Communities Work Group, regarding the organization’s mission to increase healthy eating and regular physical activity, the need to provide safe, affordable, and adequate housing, announced a free community workshop on October 4, 2018 entitled “Health and Housing - Building the Connection” and urged the Council to attend; and Kay Gore, expressed concern about the Planning Commission’s approval of Conditional Use Permit 18-004 as it relates to parking, signage, and lack of revenue generating businesses and asked the Council to review the project. No further comments were received. City Manager Bergman responded to questions from Council regarding the appeal process and explained the project review process that is set forth in the City’s Development Code, explained the site is zoned for retail commercial, that there is a series of uses that would be allowed in the center, and that the process includes reviewing whether or not a business type is allowed based on land use impacts and whether it meets the requirements of the Development Code. He further explained that the City does not have the ability to look at what businesses are coming in or how they might affect other similar businesses in the area. 8. CITY MANAGER/DIRECTOR REPORTS City Manager Bergman referred to the City’s website and demonstrated the “Notify Me” feature available to citizens to receive automatic email or text notifications about emergency alerts, City news releases, bid openings, meetings or other events going on in the City, and also reported that staff is working on implementing an online permit portal that will enable applicants to log in and track the progress of their project applications. 9. CONSENT AGENDA City Attorney Whitham read the full title of the Ordinance in Item 9.d. entitled: “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AMENDING SECTION 5.25.070 OF TITLE 5 OF THE ARROYO GRANDE MUNICIPAL CODE TO REAUTHORIZE THE PUBLIC, EDUCATIONAL, AND GOVERNMENT (PEG) FEE ON STATE CABLE FRANCHISEES OPERATING WITHIN THE CITY”. Mayor Hill invited public comment on the consent agenda items. No public comments were received. Action: Council Member Barneich moved, and Council Member Brown seconded the motion to approve Consent Agenda Items 9.a. through 9.d., with the recommended courses of action. Consideration of Cash Disbursement Ratification. Action: Ratified the listing of cash disbursements for the period August 16, 2018 through August 31, 2018. 9.b. Consideration of Approval of Minutes. Action: Approved the minutes of the Regular City Council Meeting of August 28, 2018, as submitted. 9.c. Consideration of Resolution Declaring Surplus Property. Action: Adopted a Resolution entitled: “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DECLARING CERTAIN PROPERTY AS SURPLUS AND AUTHORIZING ITS DISPOSAL/SALE”. 9.d. Consideration of Adoption of an Ordinance Amending Section 5.25.070 of Title 5 of the Arroyo Grande Municipal Code to Reauthorize the Public, Educational, and Government Access Fee on State Cable Franchises Operating within the City. Action: Adopted an Ordinance entitled: “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AMENDING SECTION 5.25.070 OF TITLE 5 OF THE ARROYO GRANDE MUNICIPAL CODE TO REAUTHORIZE THE PUBLIC, EDUCATIONAL, AND GOVERNMENT (PEG) FEE ON STATE CABLE FRANCHISEES OPERATING WITHIN THE CITY”. 10. PUBLIC HEARINGS None. 11. OLD BUSINESS None. 12. NEW BUSINESS None. 13. COUNCIL COMMUNICATIONS Council Member Barneich announced tickets for sale for the upcoming Empty Bowls fundraising event at St. Patrick’s Church to benefit the 5Cities Homeless Coalition. Mayor Hill stated he has observed traffic violations in the Berry Gardens neighborhood and around Harloe Elementary School, expressed concern for public safety, and requested an item regarding traffic calming measures be placed on a future agenda. Council Member Brown concurred. 14. COMMUNITY COMMENTS AND SUGGESTIONS Mike, Arroyo Grande resident, expressed concern about speeding on Le Point Street; and Coleen Kubel, expressed concern about traffic issues in the Berry Gardens neighborhood, supported putting an item on a future agenda for discussion, and also stated she was glad to hear about the public portal for checking on status of project applications.
