GRAND AVENUE (FORMER APPLEBEE'S); APPLICANT: FIGUEROA MOUNTAIN ENTERTAINMENT, LLC; REPRESENTATIVE: TERRY BOTTENFIELD DATE: JUNE 16,2015 RECOMMENDATION: It is recommended the Planning Commission adopt the resolution for substantial conformance for fa~ade treatment and sign installation with the approved plans on May 6, 2014. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: None. BACKGROUND: PLANNING COMMISSION SUBSTANTIAL CONFORMANCE REVIEW OF CONDITIONAL USE PERMIT CASE NO. 14- 005 & PLANNED SIGN PROGRAM CASE NO. 14-001 JUNE 16,2015 PAGE 2 The subject property is zoned Gateway Mixed-Use (GMU), is part of the Arroyo Town and Country Square (more commonly known as the Smart-and-Final Center), and currently contains an approximately 6,300 square-foot commercial building previously used as a restaurant (Applebee's). The Planning Commission approved the microbrewery and restaurant with fa~ade modifications to the existing building on May 6, 2014. A building permit for the tenant improvements and faqade modifications was issued on October 9.2014. On May 22, 2015 an inspection of the construction site revealed potential faqade modifications from the approved building plans. The contractor then requested that these changes from the plans be approved. The Architectural Review Committee reviewed the treatment and sign modifications on June 1, 201 5 and made the following recommendations for substantial conformance with the approved treatment design: 1) The existing stone wainscot contains gray tones that complement the gray stucco color and is acceptable to remain; 2) The new awning locations over all windows and at the height installed is acceptable; 3) Not installing the Corten awning over the entry is acceptable; 4) Keeping the existing windows on the east and north elevations is acceptable; 5) Painting the existing electrical cabinet the same color as the adjacent metal storage fence and adding an awning is acceptable; 6) Explore a solution for applying a weathering treatment to the installed silo; 7) Plant a vine on the screen fencing at the silo base for screening; and 8) Reduce the northern sign to the approved size of 64.92 square feet. ANALYSIS OF ISSUES: Proiect Description The proposed conformance review is to assess modifications made during construction for substantial conformance with the original approval. Revisions to the project are comprised of architectural treatments to the existing structure. A review of the signs is included due to an increase in square-footage of the northern wall sign from the original approval. Architecture The approval included painting the existing stucco in a medium charcoal gray finish, painting the cornice in a dark charcoal gray finish, covering the existing stone fa~ade with weathered corrugated steel, flat Corten steel plate cladding on the tower element, and new awnings made of weathered corrugated steel and reclaimed lumber frames. The plans also included replacing all windows and doors. The three windows on the E. Grand Avenue elevation were to be replaced with roll-up doors and a protruding railing resulting in a more inviting and interactive feature for pedestrians and customers. The north elevation was approved with four new roll up doors; the existing access doors on the north faqade were to be relocated. The approved building plans show the existing PLANNING COMMISSION SUBSTANTIAL CONFORMANCE REVIEW OF CONDITIONAL USE PERMIT CASE NO. 14- 005 & PLANNED SIGN PROGRAM CASE NO. 14-001 JUNE 16,2015 PAGE 3 electrical panel closet doors to be 'reskinned' with corrugated metal siding and painted to match the adjacent covered enclosed trash area. A prominent feature of the project is a 20' tall functional grain silo seen primarily from the south and west elevations. The silo was conceptually approved to be constructed from weathered corrugated steel to match the remainder of the building. The modifications to the approved plans include maintaining the existing stone on the wainscot instead of the corrugated metal siding, maintaining existing windows, and installing only one rolling door on the north side. The window awnings on the north and east side are installed at the level that would have been the top of the new windows. Now, because the existing windows are remaining, there is a gap between the window top and the awning. On the tower entry, the awning over the door is no longer proposed to be installed. The silo was installed as a shiny metal structure and raised above the ground with a mesh screen instead of mounted to the ground. Landscaping The approval shows existing landscaping to remain with the exception of the removal of the trellises on the south elevation which were included in the Applebee's project to reduce building massing on the long segment of stucco. Removal of the trellises provided a cleaner facade and the ARC determined that the additional architectural details proposed, including siding, awnings, and silo, were adequate to add visual interest to the building elevation. PLANNING COMMISSION SUBSTANTIAL CONFORMANCE REVIEW OF CONDITIONAL USE PERMIT CASE NO. 14- 005 & PLANNED SIGN PROGRAM CASE NO. 14-001 JUNE 16,2015 PAGE 4 ALTERNATIVES: The following alternatives are provided for the Planning Commission's consideration: * Adopt the attached Resolution finding the project modifications and additional requirements to be in substantial conformance with Conditional Use Permit Case No. 14-005 and Planned Sign Program Case No. 14-001; Modify and adopt the attached Resolution finding the project modifications and additional requirements to be in substantial conformance with Conditional Use Permit Case No. 14-005 and Planned Sign Program Case No. 14-001; e Do not adopt the attached Resolution, find the project modifications to not be in substantial conformance with Conditional Use Permit Case No. 14-005 and Planned Sign Program Case No. 14-001, and direct staff to schedule a public hearing for the reconsideration of Conditional Use Permit Case No. 14-005 and Planned Sign Program Case No. 14-001; or e Provide direction to staff. ADVANTAGES: Finding the project modifications with the additional requirements to be in substantial conformance will allow the finalization of the building permit and continue moving the project forward to completion. It will also allow flexibility to applicants and contractors to make appropriate modifications to approved conceptual plans as projects are constructed, without allowing for complete modification of approved projects. DISADVANTAGES: Providing flexibility to applicants and contractors to make modifications to approved projects during construction can result in significant modifications without City review. Some of these modifications may be so severe that it results in projects drastically different than that approved or result in large expenses to applicants and contractors to correct modifications not deemed acceptable. ENVIRONMENTAL REVIEW: The Community Development Department reviewed the project in compliance with the California Environmental Quality Act (CEQA) and determined that the project is categorically exempt per Section 15301(a) of the CEQA Guidelines regarding existing facilities. PUBLIC NOTIFICATION AND COMMENTS: The agenda and staff report were posted at City Hall and on the City's website on June 12,2015. No comments have been received by staff. ATTACHMENTS 1. GRAND AVENUE; APPLIED FOR BY FIGUEROA MOUNTAIN ENTERTAINMENT, LLC WHEREAS, the Planning Commission approved Conditional Use Permit 14-005 and Planned Sign Program 14-001 on May 6, 2014 for a commercial building located at 1462 E. CONSIDERATION OF CONDITIONAL USE PERMIT NO. 14-005 AND PLANNED SIGN PROGRAM 14-001; ESTABLISHMENT OF A MICROBREWERY AND RESTAURANT; LOCATION: 1462 EAST GRAND AVENUE; APPLICANT: FIGUEROA MOUNTAIN ENTERTAINMENT; REPRESENTATIVE: TED MOORE Staff Contact: Matthew Downing Assistant Planner Matthew Downing provided the staff report for the project. ARC MINUTES APRIL 7,2014 PAGE 4 Committee members asked questions regarding calculation of sign area, and clarification on faqade modifications. Ted Moore and David Ferdinandi, applicant representatives, were available to answer questions from the Committee. Committee members commented on the silo, its function, and stated they felt it brought interest to the west side of the building. Committee members also provided support for the project in general, stating that they were all excited to see this type of use and their appreciation of the painting, lighting and motif. Committee members provided discussion on the proposed signs, including intensity of illumination, size, and design. Barbara Harmon made a motion, seconded by Chuck Fellows, to recommend the Planning Commission approve the project with the following conditions: 1. Sign B be reduced proportionally to a total of seventy (70) square-feet using the trapezoidal and triangular measurement technique 2. The applicant shall work with staff to ensure the lumens are in compliance with City code The motion carried on a 4-0 voice vote. 6.d. CONTINUED CONSIDERATION OF CONDITIONAL USE PERMIT NO. 13-004; CORPORATION YARD RENOVATION PROJECT; LOCATION: 1375 ASH STREET (PUBLIC WORKS CORPORATION YARD); APPLICANT: CITY OF ARROYO GRANDE- GEOFF ENGLISH, PUBLIC WORKS DIRECTOR Staff contact: Aileen Nygaard Assistant Planner Aileen Nygaard provided the staff report for the project. The committee had questions about the size of the planters and the number of trees to be planted. Additionally, Committee Member Harmon wanted to know if the trees would be drought tolerant. Ron Simpson, Public Works Supervisor was present to answer questions, as was project architect Kyle Harris. Mr. Harris stated that unfortunately they were not able to provide natural lighting in the men's locker room because of a lack window space. The proposed use of a microbrewery and restaurant would not impair the integrity or character of the Gafeway Mixed-Use (GMU) zoning disfn'cf, as if is consistenf with the stated purpose of the GMU zoning district per Municipal Code Section 16.36.020jE). The proposed sign conforms to applicable development standards and provisions of this title and will not be detrimental to the public health, safety and welfare. The proposed signage, as reviewed by the Architectoral Review Committee, complies with all applicable development standards for restaurants idenfified in the Municii~al Code. COMMUNITY DEVELOPMENT DEPARTMENT PLANNING DlVlSlON GENERAL CONDITIONS 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project 2. The applicant shall comply with all conditions of approval for Conditional Use Permit Case No. 14-005 and Planned Sign Program 14-001. 3. Development shall occur in substantial conformance with the plans presented to the Planning Commission at the meeting of May 6, 2014. 4. The applicant shall agree to indemnify and defend at hislher sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in any way relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of hislher obligations under this condition. 5. All conditions of approval shall be printed on construction plans. 6. This approval shall expire on May 6, 2016 unless a building permit is issued for the project prior to that date. AESTHETICS 7. Ensure that all roof-mounted equipment cannot be viewed from public areas or from the nearby neighborhood by use of architectural features and prudent placement of equipment subject to the approval of the Community Development Director. All electrical panel boxes shall be installed inside the building or in a manner that is screened from view subject to the approval of the Community Development Director. 9. All public safety equipment such as double detector check valves or fire department connections shall be screened from view but in manner that ensures its proper use and function as approved by the Community Development Director. 10. Prior to building permit: issuance, appropriate brewery operation odor control measures shall be included in the project, subject to the approval of the Community Development Director. DEVELOPMENT CODE 11. Development shall conform to the Gateway Mixed Use zoning requirements except as otherwise approved. 12. Signage shall be subject to the requirements of Development Code Chapter 16.60 and as approved per the Planned Sign Program Case No. 14-001. LIGHTING 13. All lighting for the site shall be downward directed and shall not create spill or glare to adjacent properties. POLICE DEPARTMENT 14. Prior to issuance of a building permit, the applicant shall submit an exterior lighting plan for Police Department approval. BUILDING AND LIFE SAFETY DIVISION BUILDING CODES 15. The project shall comply with the most recent editions of ail California Codes, as adopted by the City of Arroyo Grande. DISABLED ACCESS - 16. Provide co~nplete compliance with State and Federal disabled access reauirements. FIRE LANES 17. All fire lanes must be posted and enforced, per Fire Depariment guidelines SECURITY KEY BOX 18. Prior to Occupancy, applicant must provide an approved "security key vault," per Building and Life Safety Division and Fire Department guidelines. RESOLUTION NO. 14-2206 PAGE 6 FIRE SPRINKLERS 19. Prior to Occupancy, all buildings must receive a 5-year Certification per NPPA 20. Provide Fire Department approved access or sprinkler-system per National Fire Protection Association Standards. ABANDONMENTINON-CONFORMING 21. Prior to map recordation, issuance of a grading permit or building permit, whichever occurs first, applicant shall show proof of properly abandoning all non-conforming items such as septic tanks, wells, underground piping and other undesirable conditions. OTHER APPROVALS 22. Prior to issuance of a building permit, County Health Department approval is reouired for food service establishments. 23. Any review costs generated by outside consultants, shall be paid by the applicant. PUBLIC WORKS DEPARTMENT 24. The applicant shall refresh rock in the exterior landscaping areas. 25. The applicant shaii repair the damaged curbing on the west side of the building adjacent to the gas station parking lot. 26. Prior to the issuance of a building permit, the applicant shall verify the sizing of the grease trap & interceptor. 27. The applicant shall repaint the handrail on the ADA ramp to the sidewalk on the east side of the building. GENERAL CONDITIONS 28. Clean all streets, curbs, gutters and sidewalks at the end of the day's operations or as directed by the Director of Community Development or the Director of Public Works. 29. Perform construction activities during normal business hours (Monday through Friday, 7 A.M. to 5 P,M,) for noise and inspection purposes, The developer or contractor shall refrain from performing any work other than site maintenance outside of these hours, unless an emergency arises or approved by the Director of Public Works.
