SUBJECT: CONSIDERATION OF ADOPTION OF RESOLUTIONS DIRECTING THE
LEVY OF THE ANNUAL ASSESSMENTS FOR THE PARKSIDE
VILLAGE ASSESSMENT DISTRICT, GRACE LANE ASSESSMENT
DISTRICT AND LANDSCAPING AND LIGHTING ASSESSMENT
DISTRICT NO. 1, WITHIN TRACT 1769, FOR FISCAL YEAR 2019-2020

SUMMARY OF ACTION:
Adoption of the associated Resolutions directing the levy and collection of assessment
fees for maintenance and landscaping for the Parkside Village and Grace Lane
Assessment Districts and the Landscaping District No. 1, within Tract 1769. No changes
to the assessment fee amounts are proposed nor are any new improvements or
substantial changes in existing improvements proposed for Fiscal Year 2019-20.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
By adopting the Resolutions, $56,298 will be collected for Fiscal Year 2019-20 for the
three assessment districts to provide landscaping and other specified maintenance. The
assessments are placed on the affected property owner’s tax roll each year.
RECOMMENDATION:
It is recommended the City Council:
1. Conduct a public hearing for the levy and collection of assessments for the
Parkside Village Assessment District, Grace Lane Assessment District, and
Landscaping and Lighting Assessment District No. 1, within Tract 1769;
2. Adopt a Resolution directing the levy of the annual assessment for the Parkside
Village Assessment District pursuant to the Landscaping and Lighting Act of 1972
(Streets and Highways Code Sections 22500 et. seq.) for Fiscal Year 2019-2020;
3. Adopt a Resolution directing the levy of the annual assessment for the Grace Lane
Assessment District pursuant to the Landscaping and Lighting Act of 1972 (Streets
and Highways Code Sections 22500 et. seq.) for Fiscal Year 2019-2020; and
4. Adopt a Resolution directing the levy of the annual assessment for the
Landscaping and Lighting Assessment District No. 1 pursuant to the Landscaping
and Lighting Act of 1972 (Streets and Highways Code Sections 22500 et. seq.)
within Tract 1769, for Fiscal Year 2019-2020.

BACKGROUND:
At the June 11, 2019 City Council meeting, the Council approved the Engineer’s Reports
and adopted Resolution Nos. 4926, 4927, and 4928 declaring its intention to levy and
collect assessments for the Parkside Village Assessment District, Grace Lane
Assessment District, and Landscaping and Lighting Assessment District No. 1, within
Tract No. 1769, and setting a public hearing for June 25, 2019 at 6:00 P.M. for the
Parkside Village Assessment District, Grace Lane Assessment District, and Landscaping
and Lighting Assessment District No. 1, within Tract 1769.
For the Parkside Village Assessment District, the proposed annual assessments
are $446 or $734 per parcel for a total of $43,966 annually.
For the Grace Lane Assessment District, the annual assessments are $460 or
$608 per parcel for a total annual assessment of $9,332.
For the Landscaping and Lighting Assessment District No. 1, within Tract 1769,
the total assessment is $100 per parcel for a total annual assessment of $3,000.
ANALYSIS OF ISSUES:
The California Streets and Highways Code Sections 22500 et seq., (California Landscape
and Lighting Act of 1972) (Act), contain the process by which local governmental agencies
form assessment districts for the purpose of financing the costs and expenses of
landscaping and lighting public areas. The final process includes a public hearing, which
affords all interested parties the opportunity to hear and be heard. At the conclusion of
the public hearing, the Council may adopt Resolutions confirming the assessments, which
constitute the levy of the assessments for the 2019-20 fiscal year. Upon fulfillment of
these requirements, the City must submit the assessments to the County of San Luis
Obispo for inclusion on the Fiscal Year 2019-20 property tax roll.
ADVANTAGES:
Adoption of the Resolutions will be in compliance with the Act and allow the City to move
forward with the process to collect assessments.
DISADVANTAGES:
No disadvantages for the proposed actions have been identified for this fiscal year.

ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
1. Adopt Resolutions approving the levy to collect assessments for the Parkside
Village Assessment District, Grace Lane Assessment District and Landscaping
and Lighting Assessment District No. 1, within Tract 1769, for Fiscal Year 2019-
20; or
2. Request changes or clarification to the Resolutions and approve as modified; or
3. Provide staff other direction.
ENVIRONMENTAL REVIEW:
No environmental review is required for this item.
PUBLIC NOTIFICATION AND COMMENTS:
The Resolutions adopted by the City Council on June 11, 2019 declaring its intention to
levy and collect annual assessments for all three (3) Assessment Districts in Fiscal Year
2019-20 were published in The Tribune on Friday, June 14, 2019. The Agenda was
posted at City Hall and on the City’s website in accordance with Government Code
Section 54954.2.

OF ARROYO GRANDE DIRECTING THE LEVY OF THE
ANNUAL ASSESSMENTS RELATED TO THE PARKSIDE
VILLAGE ASSESSMENT DISTRICT PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972 (STREETS
AND HIGHWAYS CODE SECTIONS 22500 ET. SEQ.) FOR
FISCAL YEAR 2019-2020
WHEREAS, on November 8, 2005, the City Council of the City of Arroyo Grande
adopted Resolution No. 3888 ordering the formation of the Parkside Village Assessment
District under Part 2 of Division 15 of the California Streets and Highways Code 22500-
22679 (Landscape and Lighting Act of 1972), which allows local governmental agencies
to form assessment districts for the purpose of financing the costs and expenses of
landscaping and lighting public areas; and
WHEREAS, the City Council, at its meeting of June 11, 2019, approved Resolution No.
4926 approving the Engineer’s Report and declaring its intention to levy and collect
annual assessments for the Parkside Village Assessment District for Fiscal Year 2019-
2020 and set a public hearing for June 25, 2019 for the Parkside Village Assessment
District; and
WHEREAS, a public hearing to levy the annual assessment of the Parkside Village
Assessment District was held June 25, 2019 at the City Council Chambers, 215 E.
Branch Street, Arroyo Grande, California, 93420 and the City Council took public
testimony from all interested persons as to the levy of the annual assessment for the
Parkside Village Assessment District; and
WHEREAS, pursuant to Streets and Highways Code Section 22130, the City Council is
authorized to levy this assessment; and
WHEREAS, pursuant to Streets and Highways Code Section 22646, the assessments
herein confirmed by the City Council shall be collected on the secured property tax roll
and collected at the same time and in the same manner as County taxes are collected.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo
Grande, as follows:
1. The foregoing recitals are true and correct and are incorporated herein.
2. The annual levy for the maintenance of Parkside Village Assessment District,
located as shown in the approved Engineer’s Report for the Parkside Village
Assessment District is hereby ordered and the assessment of $446 or $734 per

and incorporated herein by this reference, is hereby confirmed.

the County of San Luis Obispo Auditor.

the purpose of financing the costs and expenses of landscaping and lighting public
areas; and

annual assessments for the District for Fiscal Year 2019-2020 and set a public hearing
