R 4330 RESOLUTION NO. 4330
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE INCREASING PARKING
CITATION FINES TO COVER NEW STATE SURCHARGE
WHEREAS, California Vehicle Code Section 40203.5 provides that cities establish
parking penalties, fees and assessments for parking violations; and
WHEREAS, State law authorizes the City to recover administrative fees, parking
penalties, fee and collection costs related to civil debt collection, late penalties, and
other related charges; and
WHEREAS, pursuant to State law the City of Arroyo Grande currently transmits a
$10.00 surcharge to the Treasurer for each parking citation collected; and
WHEREAS, on October 8, 2010 the State of California passed the Budget Act of 2010
containing language that includes an additional mandatory $3.00 surcharge on all
parking fines, increasing the mandatory surcharge to $13.00; and
WHEREAS, staff recommends that all parking violation fine assessments be increased
to meet the new State of California mandates as set forth in Exhibit A, a copy of which is
attached hereto and incorporated herein by this reference.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Arroyo
Grande does hereby approve and establish the parking violation assessments and fines
set forth in Exhibit A, and repeals all prior inconsistent parking violation assessments
and fines.
On motion of Council Member Costello, seconded by Council Member Brown, and on
the following roll call vote, to wit:
AYES: Council Members Costello, Brown, Guthrie, Ray, Ferrara (Mayor)
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 14 day of December 2010.
