SUMMARY OF ACTION:
Approval of the summary vacation of an excess portion of a public utility easement that
is not needed, pursuant to California Streets and Highway Code Section 8330.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
There is no financial impact in vacating the easement.
RECOMMENDATION:
It is recommended the City Council of the City of Arroyo Grande adopt a Resolution
vacating a portion of a public utility easement at 1271 James Way as excess public utility
easement (the “Easement”).
BACKGROUND:
Parcel Map AG 95-108 was recorded on September 2, 1998. As part of the Parcel Map,
Public Utility Easements (PUE), water and sewer pipeline easements were recorded
across various portions of the property. (Attachment 1).
ANALYSIS OF ISSUES:
On August 30, 2019, the property owner’s civil engineer requested that the public utility
easement be modified and the excess portions of the easement, located at 1271 James
Way, be vacated to allow the construction of a memory care and assisted living facility.
The legal description of the property, legal description of the area of the easement to be
vacated and the plat of easement to be vacated, as well as the plat of the easements on
the property to remain were prepared by Ashley & Vance Engineering, Inc. and were
reviewed by MNS Engineers for technical correctness.

Non-objection letters to the proposed easement vacation were received from the following
utilities: Charter Communications, Southern California Gas Company, PG&E and AT&T
(Attachment 2).
During the City’s review of the request, it was determined that the remaining portions of
the easement were sufficient. California Streets and Highways Code Section 8330 et seq.
authorizes the City to summarily vacate an excess public utility easement if it is not
required.
ALTERNATIVES:
The following alternatives are provided for the Council's consideration:
1. Approve staff’s recommendation;
2. Do not approve staff’s recommendation;
3. Modify as appropriate and approve staff’s recommendation; or
4. Provide direction to staff.
ADVANTAGES:
By vacating the easement, the owner of the overlying properties would be able to utilize
this portion of the property and construct the proposed memory care facility.
DISADVANTAGES:
No disadvantages have been identified.
ENVIRONMENTAL REVIEW:
Summary vacation of the Easement is categorically exempt from the requirements of the
California Environmental Quality Act pursuant to Title 11 California Code of Regulations
Section 15305.
PUBLIC NOTIFICATION AND COMMENTS:
The Agenda was posted at City Hall and on the City’s website in accordance with
Government Code Section 54954.2. At the time of report publication, no comments have
been received.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE SUMMARILY VACATING A PORTION OF PUBLIC UTILITY,
EASEMENT AT 1271 JAMES WAY
WHEREAS, Chapter 4 of the Public Streets, Highways and Services Easements Vacation
Law, commencing with Streets and Highways Code section 8330, provides for summary
vacation of streets and public service easements; and
WHEREAS, the subject public utility easement (the “Easement”) is a forty-foot (40’)
easement that runs across Parcels 1, 2 and 3 of the property located at 1271 James Way,
and is described and depicted in Exhibits “A,” “B,” “C-1,” and “C-2,” respectively, which
are attached hereto and incorporated herein by this reference; and
WHEREAS, Section 8333 of the Streets and Highways Code authorizes the City Council
to summarily vacate a public service easement when it has been determined to be excess
by the easement holder, and there are no other public facilities within the easement.
WHEREAS, the Easement is not needed for public utility purposes and there are no
utilities or public improvements located within the portion to be vacated; and
WHEREAS, the vacation of excess right-of-way is categorically exempt from the
requirements of the California Environmental Quality Act (“CEQA”) pursuant to Title 11
California Code of Regulations Section 15305.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Arroyo
Grande hereby:
1. Determines that the subject Easement is a forty-foot (40’) wide public utility
easement located at 1271 James Way.
2. Determines that the Easement is excess and is not required for public utility
purposes and there are no public facilities located within the Easement.
3. Determines that the public convenience and necessity do not require reservation
of this portion of the Easement.
4. Based on the findings set forth in this Resolution and the provisions of Sections
8333 of the Streets and Highways Code, the City Council does hereby order that
the Easement, as described and depicted in Exhibits A, B, C-1 and C-2,
respectively, shall be and hereby is summarily vacated.
5. Authorizes and directs the City Clerk to cause a certified copy of this Resolution to
be recorded in the Office of the County Recorder of San Luis Obispo County.

Hi Ryan,
A blanket easement over the private road shown on parcel map 31 PM 47 was reserved "for the use and benefit of the
several public utility companies (and the City of of Arroyo Grande) which are authorized to serve in said subdivision".
There is a building proposed in the blue dashed area shown on the attached map. There are several public utilities
installed in the westerly portion of this easement. There are no public utilities located within the blue dashed area, and we
would like to formally vacate PG&E's rights within that portion of the easement. I have also included a copy of a

This is regarding the proposed vacation of a portion of the Public Utility Easement
(PUE) affecting the property located at 1271 James Way, Arroyo Grande (APN’s:
007-771-053 & 007-771-062).
PG&E has no utility facilities within the proposed vacated area of (PUE) as shown
on the exhibits provided. Therefore, we do not object to the vacation.
Please be advised PG&E can only consent to the PUE’s use insofar as it pertains to

AT&T has no utility facilities within the proposed vacated area of (PUE) as shown on the exhibits
provided. Therefore, we do not object to the vacation.
