SUBJECT: CONSIDERATION OF A RESOLUTION ACCEPTING PUBLIC
IMPROVEMENTS FOR PARCEL MAP 11-0046, LOCATED AT THE
INTERSECTION OF WHITE COURT AND RIDGEVIEW WAY

SUMMARY OF ACTION:
Acceptance of public improvements for Parcel Map 11-0046 located at the intersection of
White Court and Ridgeview Way.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The estimated value of the public improvements made as part of Parcel Map 11-0046 is
$389,699.20. Maintenance of the new public improvements will add to the overall costs
of the City infrastructure maintenance program and will be incorporated into the City’s
Capital Improvements Program.
RECOMMENDATION:
It is recommended the City Council adopt a Resolution accepting public improvements
for Parcel Map 11-0046 located at the intersection of White Court and Ridgeview Way.
BACKGROUND:
The Planning Commission approved Tentative Parcel Map 11-002 and Planned Unit
Development 11-002 on June 21, 2011. The Final Parcel Map for this project was
recorded on November 9, 2016, as Parcel Map 11-0046. Located on the western corner
of White Court and Ridgeview Way, the project site is approximately 3.69 acres in size. It
is zoned Residential Rural (RR) and includes 3 residential lots.
As a condition of approval of the tentative parcel map, the applicant was required to
construct a number of public improvements. The engineer of work for the project
estimated the cost of the improvements for this project as $389,699.20. Improvements
constructed included utility connections, water and sewer mains, one (1) new fire hydrant,
curbs, gutters and sidewalks within and surrounding the development, and concrete and
asphalt repairs and replacement.

Plans for these public improvements were approved on November 10, 2016. The
improvements were then completed by the developer in May 2020. The City Engineering
Department inspected the improvements and found them to be in substantial
conformance with the approved plans on May 19, 2020.
An Operation and Maintenance (O&M) Agreement has been recorded in accordance with
City Municipal Code section 13.24.110. The O&M Agreement allows for yearly
inspections and reporting conducted by the property owner to comply with Regional Water
Quality Control Board requirements. This Agreement also gives the City the right to
inspect the stormwater system to ensure proper function of the stormwater features
installed on-site.
ANALYSIS OF ISSUES:
At the time a Final Map is recorded, any uncompleted proposed public improvements
require bonding to ensure their timely completion. The bonds are held by the City until
such point that a development’s public improvements are fully and correctly installed.
Prior to acceptance of any improvements, City staff schedules inspections with the
developer to ensure that improvements are constructed per City Standards and that all
improvements are in good condition at the time of acceptance. Staff also ensure full
compliance with the listed Conditions of Approval for each project.
Acceptance of the improvements will mean that they are now owned by the City. The date
of acceptance also begins the one-year warranty period for the improvements. Prior to
the expiration of the warranty period, City staff will conduct a final inspection of the
improvements to ensure that none need to be replaced before releasing the warranty
bond.
ALTERNATIVES:
The following alternatives are provided for the Council's consideration:
1. Approve staff’s recommendation;
2. Do not approve staff’s recommendation;
3. Modify as appropriate and approve staff’s recommendation; or
4. Provide direction to staff.
ADVANTAGES:
By accepting the public improvements, the City will have ownership of facilities in the
public right of way and within the easements.
DISADVANTAGES:
Acceptance of the improvements increases costs to the City for ongoing maintenance of
the facilities.

ENVIRONMENTAL REVIEW:
The Planning Commission reviewed the project in compliance with the California
Environmental Quality Act (CEQA), the State CEQA Guidelines, and the Arroyo Grande
Rules and Procedures for Implementation of CEQA and has determined that the project
is exempt per Section 15315 of the CEQA Guidelines.
PUBLIC NOTIFICATION AND COMMENTS:
The Agenda was posted at City Hall and on the City’s website in accordance with
Government Code Section 54954.2. At the time of report publication, no comments have
been received.

GRANDE ACCEPTING PUBLIC IMPROVEMENTS FOR PARCEL MAP
11-0046, LOCATED AT THE INTERSECTION OF WHITE COURT AND
RIDGEVIEW WAY
WHEREAS, the Planning Commission approved Tentative Parcel Map 11-002 and
Planned Unit Development 11-002 on June 21, 2011; and
WHEREAS, the project was conditioned to complete certain public improvements
pursuant to Planning Commission Resolution on No. 11-2134 adopted by the Arroyo
Grande Planning Commission on June 21, 2011; and
WHEREAS, in May 2020, the developer completed construction of the improvements
required by the conditions of approval for Tentative Parcel Map 11-002, recorded as Final
Parcel Map11-0046; and
WHEREAS, staff inspected the improvements on May 19, 2020 and found they are
constructed in accordance with the approved plans for the project.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Arroyo
Grande hereby accepts public improvements for Parcel Map 11-0046, located at the
intersection of White Court and Ridgeview Way, including public curb, gutter, storm drain
facilities, drive approach, utility connections, fire hydrant, water lines, and sewer lines.
