SUMMARY OF ACTION:
Consider appointment of officers and cancellation of the November 3, 2020 Consolidated
General Municipal Election as there are not more candidates than offices to be elected.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The estimated cost for the November 2020 General Municipal Election as provided by the
County of San Luis Obispo is $28,000. Should the Council take action to cancel the
election, it would result in a cost savings to the City of approximately $28,000.
RECOMMENDATION:
Pursuant to Elections Code 10229, as there were not more candidates than offices to be
elected as of the close of the official nomination period on August 7, 2020, it is
recommended that the City Council adopt a Resolution providing for the appointment to
the offices of the City of Arroyo Grande that were to be elected on Tuesday, November
3, 2020, and cancellation of the Consolidated General Municipal Election.
BACKGROUND:
Pursuant to Municipal Code Section 1.08.010, the City’s General Municipal Election shall
be held on the same day as, and consolidated with, the Statewide General Election. The
Statewide General Election is held on the first Tuesday after the first Monday in November
of even years. On June 9, 2020, the City Council adopted the appropriate Resolutions
calling and giving notice of the General Municipal Election to be held in the City on
Tuesday, November 3, 2020, for the election of certain officers and requesting the County

Election with the Statewide General Election.
ANALYSIS OF ISSUES:
On July 3, 2020, a Notice of Election was published in The Tribune and posted on the
City’s website for the offices of Mayor for a 2-year term, and two (2) Members of the City
Council for 4-year terms (Attachment 1). In addition, a press release was issued
announcing the nomination period for the November election and posted on the City’s
website (Attachment 2). The candidate nomination period opened on July 13, 2020, and
closed on August 7, 2020. At the close of the nomination period, only one candidate for
Mayor and two candidates for City Council Member had been nominated and qualified for
the ballot.
If no one or only one person is nominated for an elective office, appointment to the elective
office may be made as prescribed by Section 10229 of the California Elections Code.
The City Clerk is required to submit a certification to the City Council that there are not
more candidates than offices to be elected, which was completed and distributed
following the close of the Nomination Period (Attachment 3). The certification sets forth
the following courses of action that may be taken by the City Council:
1. Appoint to the office the persons who have been nominated;
2. Appoint to the office any eligible voter if no one has been nominated (does not
apply);
3. Hold the election if either no one or only person has been nominated.
The City Clerk is also required to publish a notice of these facts in a newspaper of general
circulation. The notice was published in The Tribune on Wednesday, August 12, 2020.
After the 5th day following the date of publication, the Council may, at a regular or special
meeting, make the appointments or direct the election be held. The persons appointed
shall qualify and take office and serve exactly as if elected at a municipal election for that
office. The City Council has followed this appointment process previously by cancelling
the general municipal elections in 2008 and 2012 due to the fact that there were not more
candidates than officers to be elected.
If the City Council acts to appoint the nominees in lieu of holding an election, no City of
Arroyo Grande candidates will appear in the voter pamphlet or on the ballot. The cost of
printing the ballot and voter information pamphlet and other services rendered to the City
by the County of San Luis Obispo to conduct the election varies depending on the number
of nominated candidates and other factors. The County Clerk’s estimate for conducting
the November election for the City is $28,000. Cancellation of the Consolidated General
Municipal Election for the City of Arroyo Grande would save the City these costs and
would be consistent with the Elections Code.

ALTERNATIVES:
The following alternatives are provided for City Council consideration:
1. Adopt the Resolution to appoint to the office the person who has been nominated
for each office and cancel the Consolidated General Municipal Election; or
2. Do not adopt the Resolution and hold the Consolidated General Municipal Election
on November 3, 2020.
ADVANTAGES:
Appointment of the persons nominated to each office would enable the City Council to
cancel the election, which would result in a cost savings of approximately $28,000 to the
City.
DISADVANTAGES:
If the Council makes the appointments pursuant to the Elections Code, the City Clerk
shall not accept for filing any statement of write-in candidacy submitted after the
appointments are made, pursuant to Elections Code Section 10229(c).
ENVIRONMENTAL REVIEW:
No environmental review is required for this item.
PUBLIC NOTIFICATION AND COMMENTS:
A public notice was published in The Tribune on Wednesday, August 12, 2020 stating
that at the close of the nomination period, there were not more candidates than offices to
be elected. Public correspondence received regarding this item is included as Attachment
4. The Agenda was posted at City Hall and on the City’s website in accordance with
Government Code Section 54954.2.

TO THE OFFICES OF THE CITY OF ARROYO GRANDE
THAT WERE TO BE ELECTED ON TUESDAY, NOVEMBER
3, 2020
WHEREAS, as of the close of the nomination period on August 7, 2020 for the offices of
Mayor and two (2) Members of City Council, there are not more candidates than offices
to be elected and Section 10229 of the Election Code of the State of California allows one
of the following courses of action to be taken by the City Council:

NOMINATION PERIOD FOR CITY COUNCIL CANDIDATES BEGINS JULY 13TH
ARROYO GRANDE, CALIFORNIA - The nomination period for City Council candidates for the November 3,
2020 General Municipal Election begins on Monday, July 13, 2020. This year’s election will be to fill two
(2)seats for City Council Member, each for a four-year term, and one (1) seat for directly-elected Mayor,
for a two-year term. The nomination period runs from Monday, July 13, 2020 through Friday, August 7,
2020. If an incumbent office holder does not file for re-election by 5:00 p.m. on Friday, August 7, 2020,
the nomination period for non-incumbent candidates will be extended to Wednesday, August 12, 2020 at
5:00 p.m.
To be eligible for a seat on the City Council, a candidate must be 18 years old and a registered voter
residing within the City limits of Arroyo Grande. There is no filing fee for nomination papers; however, a
deposit is required for the printing of a Candidate’s Statement of Qualifications in the voter information
pamphlet. Filing a Candidate’s Statement of Qualifications is optional. Candidates must also file a
Statement of Economic Interests (Form 700) and certain campaign disclosure statements as required by
the Political Reform Act of 1974.
All forms required for nomination and election to the Arroyo Grande City Council are issued by and filed
with the Arroyo Grande City Clerk. Due to the COVID-19 pandemic, City Hall remains closed to the public
and services are provided by appointment only during regular business hours. Therefore, an appointment
to obtain, review and file nomination documents is required to ensure safety, accessibility, and ample time
to thoroughly review the filing requirements. In accordance with guidelines provided by the California
Secretary of State pertaining to the nomination period, alternative methods for issuing, executing, and filing
certain documents are available; however, in order to be a qualified candidate for office, completed
documents with original signatures must be received by the City Clerk by the close of the nomination period.
Please contact the City Clerk’s Office at 805-473-5414 or 805-473-5418 to confirm your eligibility to run for
office and to schedule an appointment. It is recommended that candidates start the process early and file
nomination papers well before the filing deadline, as all deadlines are firm and must be adhered to pursuant
to State law.
Regular business hours are Monday – Thursday, 8:00 am to 5:00 pm, closed on Fridays; however, regular
business hours will be observed on the last day of the nomination period, Friday, August 7, 2020, for election

Dear Arroyo Grande Mayor and Council Members, As a resident of Arroyo Grande for over
27 years, I respectfully ask you do not cancel the General Municipal Election on Nov. 3rd,
2020. There are many concerned residents who are wanting change, including myself. I am
very concerned about some of the items that have been posted on line and that I have read
about.
I have a concern about the ethics in the hierarchy of the City of Arroyo Grande. No more lip
service. These issues, true or false, need to be addressed and Corrective Action Plans
(CAP) put in place so these problems do not surface again. It also seems that you need an
independent committee of citizens that can review the CAP for adherence and compliance.
We've gone thru too many City Managers and other staff - when a new employee comes on
board to a management position, it can easily take 3 to 6 months for them to orient to their
new environment. How much time has been wasted on this process???????
The deadline to file papers may have passed but the residents still want the opportunity to
write-in candidates. Several residents of AG have a desire to run and I would like to hear
there thoughts on issues facing AG and have an opportunity to 'write-in' my vote. I
understand that this will involve money, but again that is money I have contributed thru my
taxes.
Voting is my Constitutional Right as a citizen or is there a reason you don't want to hold an
election??

I believe that rules and requirements exist for a reason, namely fairness in our system. If this individual was serious
about governance of our wonderful town, she would have gotten the required signatures and filed them before the
deadline.
Further, the monies that the city would spend running this election would be much better spent providing assistance
to children, families, and the elderly during this time of crisis for so many.

To Arroyo Grande City Council:
I am pro community, this is not a party specific or political email.
To my understanding there is a debate regarding holding an election where there is not a
challenger. To my understanding, this an unnecessary political formality that comes with a
$28,000 cost to the city and people of Arroyo Grande.
As a consumer of the many desirable and valued businesses in the city of Arroyo Grande, I
would prefer the funds be spent on helping the small business and families who are falling in
the cracks of the system who need help surviving during these unprecedented times. These
businesses and families are what makes the Arroyo Grande community so inviting and
desirable. Not to mention, these are “our”people in “our”community who desperately need
help right now.
To hold an election for an uncontested position at a cost of $28,000 when there are so many
Arroyo Grande small businesses and families who are in need of financial assistance right now
is Unfathomable and not in tune with the needs of the community as a whole.
The political unrest has got to stop right now before it destroys what’s left during and after the
COVID-19 pandemic.

We utilize city services all the time. In fact, yesterday and today the AG Public Works Dept
has been working on bringing water to our new SDU. They're (public works team) great
people. We're glad they are paid well and committed to their job and the City.
With appreciation, I'm requesting we SAVE THE MONEY of an unneeded General Election
scheduled for November 3rd. Let's use those dollars for other vital things.

and cancel it. These are tough times and we need to save every dollar for the taxpayers. Last
semester during college, I missed a final for one of my classes. No matter how hard I begged
or tried to get my grade back, my professor gave me a 0 on the final and I failed the course.
This election is no different than my class, and no amount of begging or pleading should
overturn a deadline. Expectations were set long ago and with no candidates running against
the current Mayor, there should be no election.

Dear City Council,
These are difficult times for the City of Arroyo Grande and it's residents. Tourism is down, resulting in
reduced income for both the merchants and the city government. The money required to conduct an
election with only one candidate on the ballot could much better be used to provide necessary services.
Since the law allows the city to cancel the mayoral election and affirm the re-election of the sole
candidate who filed to seek that office, you are urged to avoid the significant expenditure of city funds to
conduct the election.
If others had wished to seek that office, they would have paid the filing fee, filled out the paperwork,
gathered the necessary signatures and met the filing deadline. No one other than the current mayor
chose to abide by those steps.
Please follow the law and save the city from this unnecessary expenditure.

no one filed to run against the incumbents, there is no reason to spend money on an
unnecessary election when there are other critical funding needs in the city.
I understand there is a group that wants to hold the election despite the lack of opposing
candidates, ostensibly so they can run a write-in campaign. If someone wanted to run for
office, they had ample opportunity to file properly by the deadline, and they will have another
chance in two years. Process is important to the credibility of our institutions, and I urge you
