SUMMARY OF ACTION:
Approve revegetation plan and specifications and authorize the solicitation of bids for the
habitat mitigation phase of the Bridge Street Bridge Rehabilitation Project; amend the existing
Agreement with Quincy Engineering for engineering services and design support services
during construction; amend the existing Contract with Filippin Engineering, Inc. for
construction management and inspection services; and approve an amendment to the Capital
Improvement Program budget to add the subject project to the current fiscal year.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
Federal Highway Bridge Program (HBP) funds in the amount of $250,000 have been secured
for the subject project based on original estimates. It is now estimated that $22,800 will be
needed for engineering services, $44,100 for construction management and inspection
services, and $270,000 for implementation, maintenance, monitoring and reporting. Staff will
seek additional HBP funding if necessary once construction bids are received and the total
costs are known. Staff time will be necessary to coordinate construction activities with the
contractor and engineering consultants.
RECOMMENDATION:
It is recommended the City Council: 1) Approve the revegetation plan & specifications for the
Habitat Mitigation Implementation, Maintenance, Monitoring, and Reporting for the Bridge
Street Bridge Rehabilitation Project, PW 2020-08; 2) Authorize the City Clerk to advertise for
construction bids; 3) Approve a Ninth Amendment to the Agreement for Consultant Services
("Ninth Amendment") with Quincy Engineering, Inc. for engineering services and design
support services during construction for the project; 4) Approve a Second Amendment to the
Contract for Consultant Services ("Second Amendment") with Filippin Engineering, Inc. for
construction management and inspection services for the project; and 6) approve an
amendment to the Fiscal Year 2020-21 Capital Improvement Program budget to add
$250,000 of HBP funds for the subject project.

BACKGROUND:
Revegetation Plan and Specifications
The Bridge Street Bridge Rehabilitation project is anticipated to result in temporary impacts
to U.S. Army Corps of Engineers (USACE) and permanent and temporary impacts to
California Department of Fish and Wildlife (CDFW), and Regional Water Quality Control
Board (RWQCB) jurisdictions in Arroyo Grande Creek. A Habitat Mitigation and Monitoring
Plan (HMMP) has been prepared to describe the proposed methods for mitigating project
impacts to riparian and wetland habitats associated with the project. Following the
construction project for the rehabilitation of the Bridge Street Bridge, the City must implement
the HMMP which was required as part of the environmental clearance and permitting.
Amendment to Quincy Engineering Agreement
On May 22, 2012, the Council approved an Agreement for Consultant Services with Quincy
Engineering, Inc. for design phase services for the Bridge Street Bridge Rehabilitation project.
Subsequently, eight amendments to the Agreement have been executed consisting of items
such as reallocation of budgeted tasks within the overall contract, extension of the contract
end date, and additional services to perform utility relocation design and design support
services during construction.
Amendment to Filippin Engineering Contract
On January 28, 2020, the Council approved a Contract for Consultant Services with Filippin
Engineering, Inc. for construction management, resident engineer, inspection, material
testing, and environmental monitoring services for the Bridge Street Bridge Rehabilitation
project. Subsequently, one amendment to the Contract has been executed addressing pre-
construction management, inspection, and environmental services.
ANALYSIS OF ISSUES:
Revegetation Plan and Specifications
A Habitat Mitigation and Monitoring Plan (HMMP) was prepared as part of the design and
permitting of the Bridge Street Bridge Rehabilitation project. The HMMP is intended to assist
project planners in preparing agency permit applications but it also includes detailed planting
and monitoring plans which resulted from agency comments during the permitting process.
The revegetation plan and specifications are based on these detailed planting plans. The
revegetation plan and specifications contain provisions for a habitat mitigation and restoration
implementation plan, and a five-year maintenance, monitoring and reporting plan. Because
habitat mitigation is typically performed by specialized contractors and over a five-year
window, the City coordinated with Caltrans to separate this post-construction phase of the
project from the construction phase. This allows the City to close out the construction contract
at the completion of the bridge rehabilitation, and allows a separate contractor to maintain
and monitor the planting it installs.

If successful bids are received and a construction contract awarded, site preparation and
planting is expected to be performed in November 2020. Delivery of the final completion
report is anticipated at the end of December 2025. Plans and specifications are available for
review at the Public Works Department.
Amendment to Quincy Engineering Agreement
Consultant engineering services are needed to prepare a bid package for the revegetation
plan and specifications for the habitat mitigation phase of the Bridge Street Bridge
Rehabilitation Project. City staff recommends Quincy Engineering, Inc. who is familiar with
the City’s standard specifications to assist the City in assembling a bid package that presents
the HMMP to interested contractors. The proposed ninth amendment will be funded from
grant funding that is programmed for post-construction activities.
Amendment to Filippin Engineering Contract
Consultant construction management services will be needed to oversee the contractor
during site preparation and planting. Filippin Engineering will be on site performing the final
phase of construction management and inspection services for the Bridge Street Bridge
Rehabilitation project during this time. Staff recommends utilizing the same team that is on
site and most familiar with the site to efficiently oversee the mitigation planting. The proposed
second amendment will be funded from grant funding that is programmed for post-
construction activities.
ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
1. Approve staff’s recommendations;
2. Do not approve staff’s recommendations and request further information;
3. Modify staff’s recommendation and approve; or
4. Provide direction to staff.
ADVANTAGES:
The project will mitigate impacts to riparian and wetland habitats associated with the Bridge
Street Bridge Rehabilitation project. Advertising for construction bids now will allow for a
contractor to be under contract for planting in November 2020 as outlined in the HMMP.
Approval of the Amendments will allow for consultant design services, and design support
and construction management services during construction.
DISADVANTAGES:
Approval of the Amendments for consultant services will utilize $66,900 of the post-
construction phase HBP grant funds.

ENVIRONMENTAL REVIEW:
Caltrans, as lead agency, has determined that the project is categorically excluded from the
requirements to prepare and Environmental Assessment (EA) or Environmental Impact
Statement (EIS) under the National Environmental Policy Act (NEPA) pursuant to 23 CFR
771.117(d): activity (d)(13) covering bridge rehabilitation that avoids an adverse effect to
historic properties under the National Historic Preservation Act.
The City, as lead agency, has adopted a Mitigated Negative Declaration (MND) prepared in
accordance with the California Environmental Quality Act (CEQA), Public Resources Code
§21000 et seq., and the State CEQA Guidelines, California Code of Regulations (CCR)
§15000 et seq. for the Bridge Street Bridge Rehabilitation project, including the habitat
mitigation phase of the project addressed in this proposed action.
PUBLIC NOTIFICATION AND COMMENTS:
The Agenda was posted at City Hall and on the City’s website in accordance with Government
Code Section 54954.2.

CONSULTANT SERVICES AGREEMENT
AMENDMENT NO. 9
This Ninth Amendment ("Ninth Amendment") to Consultant Services Agreement (“CSA”)
by and between the CITY OF ARROYO GRANDE (“City”) and QUINCY
ENGINEERING, INC. (“Consultant”) is made and entered into this 25th day of August
2020.
WHEREAS, the parties entered into a CSA dated May 22, 2012, for preliminary
engineering work on the Bridge Street Bridge Improvement project; and
WHEREAS, the First Amendment to the CSA was approved on May 27, 2014, which
included an increase in scope and fee to perform additional analysis and more detailed
costs estimates as requested by Caltrans to determine funding eligibility of the
rehabilitation alternative; and
WHEREAS, the Second Amendment to the CSA was approved on January 27, 2015,
which included an increase in scope and fee to carry two design alternatives through
the environmental process of Phase I, and to complete Phase II - Final Design Plans,
Specifications and Estimates (PS&E) and Permitting, and extended the contract
Agreement term; and
WHEREAS, the Third Amendment to the CSA was approved on July 18, 2016, which
included a no cost change for extra work required to complete the project by a
reallocation within the existing budget; and
WHEREAS, the Fourth Amendment to the CSA was approved on March 16, 2017,
which included a no cost change for extra work required to complete the project by a
reallocation within the existing budget; and
WHEREAS, the Fifth Amendment to the CSA was approved on July 27, 2017, which
included an increase in scope and fee to perform prepare an alternatives evaluation and
preliminary cost estimates for the permanent waterline relocation and temporary/
permanent relocation of the existing sanitary sewer crossing Arroyo Grande Creek for
grant programming purposes; and
WHEREAS, the Sixth Amendment to the CSA was approved on March 13, 2018, which
allowed for the design of both temporary and permanent utility relocations required as
part of the project, and extended the contract Agreement term; and
WHEREAS, the Seventh Amendment to the CSA was approved on August 13, 2019,
which extended the contract Agreement term and included a no cost change for extra
work required to complete construction documents by a reallocation within the existing
budget.

WHEREAS, the Eight Amendment to the CSA was approved on October 8, 2019, which
included an increase in scope and fee to perform design support services during the
construction phase of the project.
WHEREAS, the parties desire to further modify the CSA as set forth herein.
NOW THEREFORE, for valuable consideration the receipt and sufficiency of which is
acknowledged, the parties agree as follows:
1. To include the additional services at the increased cost as specified in Exhibit “A”
attached hereto and incorporated herein by this reference.
2. Except as modified herein, all other terms and conditions set forth in the CSA, as
amended, shall remain unchanged.

Amendment 9 – Revegetation Project Design Services
Dear Ms. McPeek,
Following the construction project for the rehabilitation of the Bridge Street Bridge the City must
implement the revegetation plan which was required as part of the environmental clearance and
permitting. The Quincy Team will assist the City in pulling this package together and then
supporting the City, CM Team and Contractor during construction.
Estimating the necessary level of effort can be difficult because effort is largely dependent on field
conditions and the contractor/CM team expertise. The following tasks are what is anticipated for
the revegetation project.
Task 1 – Prepare Bid Package
Quincy Team will review the revegetation plan to determine if as-built conditions would require
alterations to the plan. This may include suggestion or alterations to suggested planting,
depending on how things were handled during clearing and grubbing. Team will review the
Project Habitat Mitigation and Monitoring Plan (HMMP) and strike out any portions of the plan
that have been superseded by the Revegetation Plan sheets. An estimate of working days will be
generated for use in contract documents. An estimate of how many working days the
revegetation contractor would need to do the work so that it can be included in the bid
documents. In addition to the details outlined above this Task will include the following steps:
•Prepare Draft Bid Package including QA/QC Review
•Receive and address City comments
•Finalize Package
Task 2- Bid Support and Construction Support
Once the final bid package is completed, the Quincy Team will support the City during the
bidding phase, respond to Request for Information (RFI) and clarifications.
Project Manager or other representative of Quincy will attend Mandatory Pre-Bid Meeting with
prospective contractors at the project site.
Once the contract is awarded to the contractor, the Quincy Team will provide construction
support services, to respond to RFI, plan and specification clarifications raised by the City, CM
Team and Contractor.

WRECO would also be available for up to 1 year for Plan Establishment Period. WRECO has
assumed only (1) site visit either during construction or during the Plant Establishment Period.

CONTRACT FOR CONSULTANT SERVICES
AMENDMENT NO. 2
This Second Amendment ("Second Amendment") to Contract for Consultant Services
(“Contract”) by and between the CITY OF ARROYO GRANDE and FILIPPIN
ENGINEERING, INC. (“Consultant”) is made and entered into this 25th day of August
2020.
WHEREAS, the parties entered into a Contract dated January 29, 2020, for construction
management, resident engineer, inspection, materials testing, and environmental
services; and
WHEREAS, the First Amendment to the Contract was approved on July 14, 2020, which
included an increase in scope and fee to perform additional construction management
and environmental services necessary to move the project forward into construction; and
WHEREAS, the parties desire to further modify the Contract as set forth herein.
NOW THEREFORE, for valuable consideration the receipt and sufficiency of which is
acknowledged, the parties agree as follows:
1. To include the additional services at the increased cost as specified in Exhibit "A"
attached hereto and incorporated herein by this reference.
2. Except as modified herein, all other terms and conditions set forth in the Contract,
as amended, shall remain unchanged.
IN WITNESS WHEREOF, the parties hereto have caused this Contract to be executed

BRIDGE REHABILITATION PROJECT HABITAT MITIGATION, PW 2020-08
Dear Ms. McPeek:
Thank you for the opportunity to submit our proposal to provide Construction Management and Inspection
services for the City of Arroyo Grande’s Bridge Street Bridge Rehabilitation Project Habitat Mitigation. Filippin
Engineering (FE) is a well-established certified Disadvantaged Business Enterprise (DBE), that provides a wide
range of construction engineering services exclusively to public works agencies along the central coast. Filippin
Engineering is currently providing CMIT for the City’s Bridge Street Bridge Replacement Project and is in a unique
position to provide the requested services at the least cost to the City. It is our understanding that habitat
mitigation construction will begin early January 2021 and will be complete in mid-February, (30) working days.
We propose to utilize Mr. Raul Estrada, Assistant Resident Engineer and Mr. Dean Johe, Senior Construction
Inspector to perform the CM and inspection duties necessary for the Habitat Mitigation. Both are familiar with
the project site and City procedures.
The cost for FE construction inspection services will be on a time and materials basis and for a 6 week period is
estimated to be (10 hrs/wk * 6 wks of construction management) + (40 hrs/wk * 6 wks of inspection) = 300
hours at $147/hr = $44,100.00.
