PC R 20-2336RESOLUTION NO. 20-2336 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING SIX CERTIFICATES OF COMPLIANCE, APPLICATION NO. 20- 001; LOCATED AT 128 NELSON STREET; APPLIED FOR BY SCOTT CUSACK WHEREAS, the applicant has filed an application for six Certificates of Compliance to verify the legality of six (6) lots located at 128 Nelson Street; and WHEREAS, the subject property was originally subdivided by W.M. Short, T.J. Mason, and W. Whitely in 1887; and WHEREAS, the City of Arroyo Grande was not incorporated until 1911; and WHEREAS, each of the six (6) lots were subsequently deeded off in compliance with State and local subdivision regulations in place at the time of each deed transference; and WHEREAS, the Planning Commission of the City of Arroyo Grande has reviewed the project in compliance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the Arroyo Grande Rules and Procedures for implementation of CEQA and finds the project to be categorically exempt per Section 15061(b)(3) of the Guidelines regarding projects where it can be seen with certainty that there is no possibility that there will be a significant effect on the environment; and WHEREAS, the Planning Commission reviewed the project at its meeting on June 16, 2020; and WHEREAS, the Planning Commission finds, after due study and deliberation and based on substantial evidence in the record, that the lots were legally created. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Six Certificates of Compliance, Application No. 20-001, as presented to the Planning Commission on June 16, 2020. On a motion by Commissioner Martin seconded by Commissioner Maraviglia and by the following roll call vote to wit: AYES: Martin, Maraviglia, Montes, Sage, Schiro NOES: None ABSENT: None The foregoing Resolution was adopted this 16th day of June, 2020.
