RESOLUTION OF THE CITY COUNCIL PASSING
ON THE REPORT PRESENTED PURSUANT TO THE .
"HUNICIPAL IMPROVEt-1ENT ACT OF 1913", .
GIVING PRELIMINARY APPROVAL AND SETTING
TIME AND PLACE OF PUBLIC HEARING
WHEREAS, proceedings have been instituted for this improvement
for the construction of certain. works and improvements in a .
special assessment district under the provisions' of Division 12 I
of the Streets and Highways Code of the State of. California. (the
"Hunicipal Improvement Act of 1913") in said special assessment.
district known and designated as
ASSESSMENT DISTRICT NO. 79-1 .
(CANYON WAY)
(hereinafter referred to as the "Assessment Disti:ict")~ and, .
1VHEREAS, a report has been prepared and filed as provide.d for .
in Section 10203 and 10204 of the Streets and Highways Code of
the State of California, and said report has now been presented
for review and consideration; and, .
\-iHEREAS, Resolution of Intention No.. 1435 for this improve-
ment was duly adopted on the 14TH day of . OCTOBER, 1980
and at this time; this. legislative body is ready to proceed to
set the matter :for a public hearing.
NON, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE
CALIFOP~IA, AS FOLLONS:
SECTION l. That the above recitals are all true and correct.

SECTION 2. That the "Report", as now presented and referred
to hereinabove, is considered adopted, passed upon
and preliminarily apprQved.

NOI-!, THEREFORE, IT IS ORDERED AS FOLLOWS:
A. That the plans and specifications for the
proposed improvements to be made, contained
in said "Report" r be, and they are hereby

B. 'l'hat the estimate of the itemized and total

improvefi\ents and of the incidental expenses
in connection therewith, contained in said

preliminarily approved.

subdivisions have been given a separate number
upon said Diagram, as contained in said "Report",
be, ana it is hereby preliminarily approved.
D. That the proposed assessments upon the several
subdivisions of land in said Assessment Dist-
rict, in proportion to the estimated benefits
to be received by such subdivisions, respectively,
from said acquisitions and. improvements, and of
the incidental expenses thereof, as contained in
r said "Report", be; and they are hereby prelimi-
narily approved.

SECTION 3. 'NOTICE IS HEREBY GIVEN THAT ON TUESDAY ,

~~ETING PLACE OF THE CITY COUNCIL, BEING THE COUNCIL
CHAHBERS, CITY HALL, ANY AND ALL PERSONS HAVING ANY
OBJECTIONS TO THE PROPOSED WORK OR IHPROVEMENT, AC-
QUISITION, IF fu~Y, OR ASSESSMENT, OR EXTENT OF THE
ASSESS!1ENT DISTRICT, OR THE PROPOSED GRADES, 1-1AY
APPEAR AND SHOW CAUSE ~rnY SAID WORK SHOULD NOT BE
DONE OR CARRIED OUT IN ACCORDfu~CE WITH RESOLUTION
OF INTENTION NO. 1435 AND THE "REPORT" OF THE
SUPERINTENDENT OF STREETS_ PROTESTS MUST BE IN
WRITING AND MUST BE DELIVERED TO THE CITY CLERK OF
.THE CITY AT OR BEFORE THE TgiF: SET FOR THE HEARING.
SECTION 4_ That the City Clerk is hereby directed to give notice
of said hearing by causing' to be conspicuously posted
on all open streets within the Assessment District,
not more than three hundred (300) feet apart on each
street so posted, but no less than three (3) in all,
notice of the passage of the Resolution of Intention
and of this Resolution, all in accordance with the
provisions of said Division 12 of the Streets and
Highways Code.
SECTION 5. That the City Clerk is hereby directed to give notice
of said hearing and of the passage of the Resolution
of Intention and of this Resolution by causing such
notice to be published in accordance with Section
I 6066 of the Government Code, in the FIVE CITIES 'l'HIES-
P HF:SS- HECO!WER , it ne\vspape-c published and of gei1e-
ral circulatTon ,.!.i.thin the District, \vhich is hereby
designated for that purpose, all in accordance \-lith
the provisior1s of said Divisio!1 12.

"Report" to all persons owning real .property pro-
posed to be assessed whose names and addresses
appear on the last equalized assessment roll for
County taxes prior thereto or as other\'1ise known,
and to all other persons as prescribed and in
accordance with the. provisions of said Division 12.

SECTION 7. That on. the original and on at least one copy of
the map of the Assessment District, the City Clerk
shall endorse a certificate evidencing the date of
adoption of this Resolution, and within fifteen
(15) days after the adoption of the Resolution I
fixing time and place of the hearing on the forma-
tion or extent of the Assessment District, and in
no event later than fifteen (15) days. prior to such
hearing, a certified. copy shall be filed in the
Office of the County Recorder of the County of
