R 3327 , t- Llc (C\- i.. , ( RESOLUTION NO. 3327 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDJ= APPROVING PLANNED SIGN PROGRAM CASE NO. 98-127, LOCATED AT 850 OAK PARK ROAD (BEST WESTERN CASA GRANDE INN), APPLIED FOR BY WILLIAM SCHOEFFLER WHEREAS, the City Council of the City of Arroyo Grande has considered an application by William Schoeffler, for a Planned Sign Program at 850 Oak Park Boulevard in the Planned Development IGeneral Commercial District; and WHEREAS, the City Council held a Public Hearing on September 9, 1998 and found that this Planned Sign Program is consistent with the General Plan and the Environmental Documents associated therewith; and WHEREAS, the City Council has reviewed this project in compliance with the California Environmental Quality Act (CEQA) and has determined that the project is categorically exempt per CEQA Guidelines Section 15311 (a); and WHEREAS, the City Council finds, after due study, deliberation and public hearing, the following circumstances exist: 1. The proposed signs are consistent with the goals, objectives, policies and programs of the Arroyo Grande General Plan and any applicable design guidelines. The goals of the General Plan are to encourage economic vitality and business activity, protect investments while preserving the environment and character of the City because said signs are important to the success of this and similar businesses but are not out of scale or character with other signs in this zone and vicinity. 2. The proposed signs conform to applicable development standards and provisions of the Development Code. 3. The physical location or placement of the signs are compatible with the surrounding neighborhood and do not pose a safety risk. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo Grande approves the Planned Sign Program Case No. 98-127, with the above findings and subject to the conditions as set forth in Attachment "A", attached hereto and incorporated herein by this reference. '11~ a.~ NANCY A. !A.VIS, CITY CLERK Resolution No. 3327 Page 3 ATTACHMENT IIA" CONDITIONS OF APPROVAL PLANNED SIGN PROGRAM CASE NO. 98-127 BEST WESTERN CASA GRANDE INN GENERAL CONDITIONS This approval authorizes the following at 850 Oak Park Road: 1. Replace the existing illuminated logo identification portion of the pole sign with the new Best Western corporate logo copy (also illuminated). This would increase the size from 94 square feet to 103 square feet, which includes the Best Western logo copy of 33 square feet and the Casa Grande Inn copy of 15 square feet. 2. Replace copy in the existing illuminated monument sign with new illuminated Best Western corporate logo copy (no increase in sign area). 3. Replace copy on the existing illuminated tower wall sign on the south fac;ade with a new illuminated Best Western corporate logo copy (no increase in sign area). Remove the existing illuminated sign on the east facade. 4. Install a new 70 square foot illuminated wall sign on the end of the hotel building facing Branch Street. 5. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 6. The applicant shall comply with all conditions of approval for Planned Sign Program Gase No. 98-127. 7. This application shall automatically expire on September 1, 2000 unless a building permit is issued. Thirty (30) days prior to the expiration of the approval, the applicant may apply for an extension of one (1) year from the original date of expiration. 8. Development shall occur in substantial conformance with the plans presented to the Planning Commission at the meeting of September 1,1998 and marked Exhibit "A", 9. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees which the City, - . ~-- -~ ... -.- Resolution No. 33:l7 Page 4 its agents, officers or employees may be required by a court to pay as a result of'such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of hislher obligations under this condition. DEVELOPMENT CODE 10. Development shall conform with the General Commercial zoning requirements and the Sign Ordinance except as otherwise approved. BUILDING AND FIRE DEPARTMENT CONDITION UBC/UFC 11. The project shall comply with the most recent editions of the California State Fire and Building Codes and the Uniform Building and Fire Codes as adopted by the City of Arroyo Grande.
