PC Minutes 1993-12-211 1 1 ARROYO GRANDE PLANNING COMMISSION • DECEMBER 21, 1993 The Arroyo Grande Planning Commission met in regular session with Chairman Carr presiding. Present are Commissioners Tappan, Soto, Reilly, and Ilatchett. Absent are Commissioners Deviny and Keen. Planning Director Doreen Liberto - Blanck and Current Planner Scott Spierling are in attendance. ORAL COMMUNICATIONS - None APPROVAL OF MINUTES On motion by Commissioner Tappan, seconded by Commissioner Reilly and unanimously carried, the minutes of the regular meetings of November 16, 1993 and December 7, 1993 were approved with an addition on the minutes of November 16, 1993, as recommended by Commissioner Keen by telephone to Planning Director Liberto - Blanck. Commission by Minute Motion approved the addition of Commissioner Keen's comments regarding local labor usage on the Von's project. PUBLIC I - TENTATIVE PARCEL MAP CASE NO. 93 -512 AND CONDITIONAL USE PERMIT CASE NO. 93 -513 (P.U.D. PERMIT) AT 1274 ASII STREET, APPLICANT IS M.I.C.O., INC. Current Planner Spierling gave a presentation on this item, pointing out that the Commissioners would likely want to discuss underground utilities and the traffic mitigation fee. I-Ie concluded by stating that Staff recommended approval. Chairman Carr opened the public hearing. Kevin Hunstad, representing the applicant, brought to the Commissioners some of the applicant's concerns. 1. He requested credit on the traffic mitigation fee for the mobile home and trailer that had been on the property 2. On the Architectural Advisory Committee (AAC) requiring the provision of paver blocks, Mr. Hunstad stated that they preferred to meet with Parks and Recreation Director John Keisler and the arborist and then make a decision if paver blocks would benefit the Oak tree. 3. On the AAC condition that the garage windows facing the street be obscured, he said he would like to use mini- blinds rather than anything that would close out the light, such as frosted windows. 4. Regarding Planning Department Condition 20, Mr. Hunstad asked that curbs not be required on the individual driveways. Arroyo Grande Planning Commission Page 2 December 21, 1993 Mr. Hunstad stated that the applicant agreed to the AAC's condition of the coloring of the stucco on the house on lot 4 to conform with the other houses. The next person who spoke was Arthur Rupe, stating he owned half interest in the apartment house at the corner of Ash and Aspen. Mr. Rupe felt that the improvement was positive, but was concerned about drainage and asked that the Director of Public Works assure that this item was taken care of. Mr. Rupe also indicated that he was in favor of undergrounding all utilities. With no further comments from the audience, Chairman Carr closed the public hearing. Several items on this proposed project were then discussed by the Commissioners. The consensus was that all utilities should be undergrounded and changes made to some of the conditions. After a discussion by the Commissioners, the following action was taken, including the changes to the wording on Conditions 10, 20, 24, and 25 and deletion of Condition 33. RESOLUTION NO. 93-1451 A RESOLUTION OF TIIE PLANNING COMMISSION OF TIIE CITY OF ARROYO GRANDE APPROVING TENTATIVE PARCEL MAP CASE NO. 93 -512, LOCATED AT 1274 ASII STREET, APPLIED FOR BY M.I.C.O., INC.; ADOPTING A NEGATIVE DECLARATION WITII MITIGATION MEASURES; AND INSTRUCTING TIIE SECRETARY TO FILE A NOTICE OF DETERMINATION On motion by Commissioner Soto, seconded by Commissioner Tappan, and by the following roll call vote, to wit: AYES: Commissioners Tappan, Soto, Reilly, Hatchett, and Chairman Carr NOES: None ABSENT: Commissioners Deviny and Keen the foregoing Resolution was passed and adopted this 21st day of December 1993. Then the following action, including changes in the wording of Conditions 11, 15, 21, 25, 26 and the deletion of 34, was taken: RESOLUTION NO. 93 -1.452 A RESOLUTION OF TIIE PLANNING COMMISSION OF TIIE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING CONDITIONAL USE PERMIT (P.U.D. PERMIT) CASE NO. 93 -513, TO CREATE A FOUR -UNIT PLANNED UNIT DEVELOPMENT, APPLIED FOR BY M.I.C.O., INC. AT 1274 ASH STREET; ADOPTION OF A NEGATIVE DECLARATION WITII MITIGATION MEASURES AND INSTRUCTION THAT THE SECRETARY FILE A NOTICE OF DETERMINATION 1 1 1 1 1 1 Arroyo Grande Planning Commission . PUBLIC HEARING - UPDATE OF TRAFFIC IMPACT FEE PROGRAM, INCLUDING, BUT NOT LIMITED TO MODIFICATION OF METIIOD CALCULATING TRAFFIC FEE, APPLICANT IS THE CITY OF ARROYO GRANDE Planning Director Liberto - Blanck presented a summary on this item to the Commission and advised them that some of the changes they had previously recommended have been made and are underlined. She then proposed two additional changes: 1. Because interpretation is a foreseeable problem, she suggested that Section 7 be added to the Ordinance as follows: "Interpretations of this Ordinance shall be submitted to the Planning Director in writing and interpretation made by the Planning Commission." Ms. Liberto - Blanck further stated that if anyone did not agree with the Commission's interpretation, they could then appeal to the City Council. The existing Section 7 would then become Section 8. 2. Planning Director Liberto - Blanck brought to the Commission's attention the last paragraph of Section 2 of the Ordinance, suggesting that vacant residential lots also be included and suggested wording, such as: "Development projects still active, which were approved prior to September 1989 and vacant residential lots, which existed prior to (whatever date this Ordinance becomes effective) and which did not have a traffic impact fee mitigation measure, are exempt, providing building permits are obtained by (effective date of the Ordinance 1996). This would be two years from the effective date of the Ordinance. Chairman Carr opened the public hearing. With no comments from the audience, Chairman Carr closed the public hearing. Planning Director Liberto - Blanck then pointed out another correction and that was the Ordinance and Resolution for the City Council to adopt would be Exhibit A of the Resolution that was presently before the Commission. Therefore, she pointed out, you would actually be recommending that the City Council adopt the Ordinance and the Resolution. PLANNING COMMISSION ITEMS AND COMMENTS The first item was for cancellation of the January 4, 1994 meeting. On motion by Commissioner Soto, seconded by Commissioner Hatchett, and unanimously carried, the regular meeting of January 4, 1994, was canceled due to the holidays. Current Planner Spierling apprised the Commission that the engineer on the Von's project has been able to shift the whole design two feet, allowing them two extra feet of landscaping on the Courtland Street side. The Commission agreed to this shift. Planning Director Liberto - Blanck discussed a meeting to be held on January 27, 1994 at 2:00 P.M. with Cal -Trans and COG regarding the Brisco Road overpass. She also brought them up to date regarding 227 options and the funding. She stated this would be part of the updated Circulation Element. Commissioner Soto commended Planning Director Liberto - Blanck on her part in representing the City of Arroyo Grande on the County project and running it into Orchard Avenue. Planning Director Liberto - Blanck then recognized Traffic Commissioner Frank, who is on the Citizens Technical Advisory Committee, for his participation regarding the reprogramming of funding for Route 227. WRITTEN COMMUNICATIONS - None Chairman Carr then wished the Commissioners and Staff a Merry Christmas and a Happy, Healthy, and Prosperous New Year. ADJOURNMENT There being no further business before the Commission, on a motion by Commissioner Tappan, seconded by Commissioner Reilly, and unanimously carried, the meeting was adjourned at 9:10 P.M. to their next regular meeting on January 18, 1994.
