PC Minutes 1993-02-16ARROYO GRANDE PLANNING COMMISSION FEBRUARY 16, 1993 The Arroyo Grande Planning Commission met in regular session with Chairman Soto presiding. Present are Commissioners Carr, Moore, Tappan, Reilly, Deviny, and Hatchett. Planning Director Doreen Liberto -Blanck and Current Planner Scott Spierling are in attendance. Chairman Soto introduced and welcomed the two new commissioners, William Deviny and Eddie Hatchett. ORAL COMMUNICATIONS - None PUBLIC HEARING - TENTATIVE TRACT 2109, VARIANCE CASE NO. 92 -171 FOR SUBDIVISION OF A 2.02 AREA SITE AT 1385 BRIGHTON AVENUE, APPLICANT: MERILEE PECK- NEWDOLL Chairman Soto stated that a continuance had been requested by the applicant and inquired if there were any objections from the audience. After it was determined there were no objections, on a motion by Commissioner Carr, seconded by Commissioner Tappan, and unanimously carried, it was agreed to continue this item to March 16, 1993. PUBLIC HEARING - CONDITIONAL USE PERMIT CASE NO. 92 -505 AT 501 FAIR OAKS AVENUE, APPLICANT IS ST. PATRICK'S CHURCH Current Planner Scott Spierling reviewed the staff report, recommending to the Planning Commission that the resolution be adopted approving the project. Chairman Soto opened the public hearing. Greg Soto spoke briefly as the representative for St. Patrick's Church, stating they agreed with the conditions. With no further comments from the audience, Chairman Soto closed the public hearing. Commissioner Carr raised the issue of agricultural buffers. Current Planner Scott Spierling responded that this had not been considered, suggesting that a letter be requested from the Agricultural Commissioner's office stating their concerns. It was agreed by the Commissioners that Item la under General Conditions on Page 2 of the Resolution be added to specify that a letter be received from the Agricultural Commissioner's Office regarding the buffer question. Commissioner Soto inquired if this was acceptable to the applicant's representative, Greg Soto, and he responded in the affirmative. RESOLUTION NO. 93 -1406 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING CONDITIONAL USE PERMIT CASE NO. 92 -505 AND AN ASSOCIATED ARCHITECTURAL REVIEW, AT 501 FAIR OAKS AVENUE; APPLIED FOR BY SAINT PATRICK'S CHURCH; ADOPTION OF A NEGATIVE DECLARATION AND INSTRUCTION THAT THE SECRETARY FILE A NOTICE OF DETERMINATION On motion by Commissioner Tappan, seconded by Commissioner Carr, and by the following roll call vote, to wit: AYES: Commissioners Moore, Hatchett, Deviny, Tappan, Carr, Reilly, and Chairman Soto NOES: None ABSENT: None the foregoing Resolution was passed and adopted this 16th day of February 1993. 09 420 Arroyo Grande Planning Commission Page 2 February 16, 1993 PUBLIC HEARING - TENTATIVE PARCEL MAP CASE NO. 92-507, SUBDIVISION OF A 3.2 ACRE PARCEL AT 1101 HUASNA ROAD, APPLICANT IS BOB BOWEN Current Planner Scott Spierling reviewed the staff report, pointing out that Condition 21 has been deleted in its entirety. The main items to be considered were the access denial and the protection of views. The commissioners queried Scott on several items. Then Chairman Soto opened the public hearing. Bob Bowen, applicant, spoke briefly wherein he stated a willingness to move the driveway. Mary Rivas, 324 Platino Lane (Lot 60), Arroyo Grande, gave reasons for her objections to the approval of this item; i.e. view and fire hazard. Ralph Beck, 1051 Huasna Road, Arroyo Grande, stated that as a property owner adjacent to the Bowen property he felt any restriction made on this item would impair the value and use of his property in the future. Leonard Lenger of Jensen - Lenger Survey stated that he was available to answer any questions representing Mr. Bowen. Dwayne Brummett, spoke for his in -laws who live at 330 Platino, Arroyo Grande, stating they were concerned about their view being impaired and requested that the restriction be made to 213 foot elevation. With no further comments from the audience, Chairman Soto closed the public hearing. After considerable discussion among the commissioners, along with staff and Leonard Lenger, the following findings and conditions to the Resolution were decided: Condition 16 - Revised as follows: "The applicant shall provide, or pay a fee for striping bicycle lanes along the Huasna Road project frontage if not installed per Prop 116 funding." Condition 17 - Revised as follows: "2400 square feet of each individual parcel must remain in a natural state, i.e. no grading or filling may occur. Concurrent to recordation of the parcel map, the applicant shall record a deed restriction on parcels 1 through 4 noting this requirement." Condition 20 - Revised as follows: "Prior to recordation of the parcel map, the applicant shall construct a driveway from the cul -de -sac road to the residence on the remainder and eliminate the existing access. No additional driveways shall be installed from Huasna Road to the remainder unless approved as part of a subdivision of the remainder." RESOLUTION NO. 93 -1407 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE PARCEL MAP CASE NO. 92 -507, LOCATED AT 1101 HUASNA ROAD, APPLIED FOR BY BOB BOWEN; ADOPTING A NEGATIVE DECLARATION; AND INSTRUCTING THE SECRETARY TO FILE A NOTICE OF DETERMINATION On motion by Commissioner Carr, seconded by Commissioner Deviny, and by the following roll call vote, to wit: AYES: Commissioners Hatchett, Deviny, Carr, Reilly, and Chairman Soto NOES: Commissioners Moore and Tappan ABSENT: None the foregoing Resolution was passed and adopted this 16th day of February 1993. 1 1 Arroyo Grande Planning Commission February 16, 1993 PLANNING DIRECTOR /PLANNING COMMISSION ITEMS AND COMMENTS REQUEST FOR INTERPRETATION - KEY MARKETING, 201 BRISCO ROAD Current Planner Scott Spierling presented this item to the Planning Commission, apprising them of the two resolutions; one to be acted upon. Kenneth Watts, applicant, spoke briefly requesting approval. Commissioners discussed this item, making various inquiries of the applicant and staff. RESOLUTION NO. 93 -1408 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE PROVIDING AN INTERPRETATION OF THE DEVELOPMENT CODE THAT A KEY MARKETING IS PERMITTED USE, SUBJECT TO ISSUANCE OF A CONDITIONAL USE PERMIT, AT 201 BRISCO ROAD IN THE INDUSTRIAL ZONE. On motion by Commissioner Reilly, seconded by Commissioner Tappan, and by the following roll call vote, to wit: AYES: Commissioners Moore, Hatchett, Deviny, Tappan, Reilly, and Chairman Soto NOES: Commission Carr ABSENT: None the foregoing Resolution was passed and adopted this 16th day of February 1993. Planning Director Doreen Liberto -Blanck advised the Planning Commission that at the next regular meeting we would have a joint meeting on the ARCO Traffic Study. It was agreed that this meeting of March 2, 1993 would begin at 7:00 P.M. Commissioners were reminded of the Planners Institute meeting and the APA San Luis Obispo Subsection Event. Chairman Soto highly recommended the Planners Institute.
