PC Minutes 1992-11-17ARROYO GRANDE PLANNING COMMISSION NOVEMBER 17, 1992 The Arroyo Grande Planning Commission met in regular session with Chairman Brandy presiding. Present are Commissioners Carr, Souza, Soto, Moore, Tappan, and Reilly. Planning Director Doreen Liberto -Blanck and Current Planner Scott Spierling are in attendance. Also present is Sandra Bierdzinski. ORAL COMMUNICATIONS - None. MINUTE APPROVAL On motion by Commission Soto, seconded by Commissioner Souza, and unanimously carried, the minutes of the regular meeting of September 15, 1992, special session of September 29, 1992, and regular meeting of October 6, 1992 were approved as prepared. PUBLIC HEARING - VIEWSHED REVIEW PERMIT NO. 92 -40, SECOND STORY ADDITION, LOCATED AT 630 CERRO VISTA CIRCLE, APPLIED FOR BY NANCY C. FOWLER Current Planner Scott Spierling gave a summary regarding the proposal for a second story addition to an existing 1,385 square foot single family home for a master bedroom and bathroom. After Staff's presentation, Chairman Brandy opened the public hearing. David Ekbaum, applicant's brother speaking on her behalf, gave reasons why applicant felt the proposal should be approved, indicating the main objector, Mrs. Valdez, was no longer protesting. He also mentioned applicant's desire to cooperate with any changes in design in order to obtain approval of the project. Dick McGregor, stating he was the "possible" contractor of the project gave reasons he felt this proposal should be approved, indicating Mrs. Valdez's view would only be affected by 20% and that 44% of the houses in this neighborhood are two -story. Nancy Fowler, applicant, spoke briefly requesting approval of project. Philip and Andrea Lang, 615 Cerro Vista Lane, Arroyo Grande, presented a chart and pictures to the commission and gave reasons why the project should be denied. They both indicated their lifestyle would be affected by the loss of light and a desirable view to having to look up at solid building. They also stated that resale of their home would present problems to any potential buyer upon viewing their backyard view. They both requested denial of the proposal. After a few further comments from the public, commissioners discussed the project. Commissioners Carr and Soto indicated they wanted to visit the site. The consensus was that this proposal be postponed until the next regular meeting so that some of the commissioners might go to the site for further investigation. Ms. Fowler was asked if she agreed to the continuance and she answered in the affirmative. Commissioner Soto brought up the subject of computer graphics that might be used in situations like this, stating they were very effective. Planning Director Doreen Liberto -Blanck will look into this, checking costs involved as well. Motion to continue Viewshed Review Permit No. 92 -40 to the December 1, 1992 regular meeting was made by Commissioner Carr, seconded by Commissioner Soto, and unanimously carried. PUBLIC HEARING - CONDITIONAL USE PERMIT CASE NO. 92 -501 AND ASSOCIATED ARCHITECTURAL REVIEW FOR CONSTRUCTION OF A 665 SQUARE FOOT SECOND RESIDENTIAL UNIT OVER AN EXISTING GARAGE AT 840 FARROLL AVENUE, MAXIMUM PROPOSED HEIGHT IS 21.5 FEET 40 402 Arroyo Grande Planning Commission Page 2 November 17, 1992 Commissioner Carr stated he lives within 300 feet of this particular item and left Council Chambers. Commissioner Soto moved that the Commission continue Conditional Use Permit Case No. 92 -501 to December 15, 1992. This was seconded by Commissioner Tappan and unanimously carried, Commissioner Carr abstained. PUBLIC HEARING - RANCHO GRANDE EXPANDED INITIAL STUDY /MITIGATED NEGATIVE DECLARATION - RESOLUTIONS RECOMMENDING ADOPTION OF THE EXPANDED INITIAL STUDY AND MITIGATED NEGATIVE DECLARATION ON THE 10 ACRE ORIGINAL RANCHO GRANDE AND THE ALTERNATIVE RANCHO GRANDE PARK, APPLICANT IS THE CITY OF ARROYO GRANDE Commissioner Reilly asked to be excused from this item and the following item (Applicants Al and Carol Albin) and left Council Chambers. Planning Director Doreen Liberto - Blanck, referring to the commissioner's packet on this item, stated that in Attachment A the highlighted areas are those things that have been added by the Planning Commission and those areas with the dash -line through are those the Planning Commission has deleted, thereby representing clearly the actions taken at the last meeting on this item. She also brought their attention to the staff report giving responses by Judy Skousen, City Attorney, to comments presented by John Belsher, Attorney, Sinsheimer, Schiebelhut & Baggett. She requested that there be two separate motions by the Planning Commission, adopting a Resolution recommending to the Council adoption of the Mitigated Negative Declaration for the Original Rancho Grande Park Plan and then adopting a resolution recommending to the Council adoption of the Mitigated Negative Declaration for the Alternative Rancho Grande Park Plan. She advised the commissioners that Sandy Bierdzinski, who prepared the expanded initial study, was present if there were any questions on the amended mitigation measures. Commissioner Carr stated he had a questions and concerns on some of the mitigation measures. After further Commission comments, Chairman Brandy brought the discussion back for a motion. RESOLUTION NO. 92 -1392 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING ADOPTION OF A MITIGATED NEGATIVE DECLARATION FOR THE ORIGINAL RANCHO GRANDE PARK PLAN BY THE CITY COUNCIL, AND RECOMMENDING THAT THE CITY CLERK FILE A NOTICE OF DETERMINATION On motion by Commissioner Tappan, seconded by Commissioner Soto, and by the following roll call vote, to wit: AYES: Commissioners Tappan, Soto, Carr, Moore, Souza, and Chairman Brandy NOES: None ABSENT: None ABSTAIN: Commissioner Reilly the foregoing Resolution with amendments was passed and adopted this 17th day of November 1992. Arroyo Grande Planning Commission Page 3 November 17, 1992 RESOLUTION 92 -1393 A RESOLUTION OF THE PLANNING COMMISSION OF CITY OF ARROYO GRANDE RECOMMENDING ADOPTION OF MITIGATED NEGATIVE DECLARATION FOR THE ALTERNATIVE RANCHO GRANDE PARK PLAN BY THE CITY COUNCIL, AND RECOMMENDING THAT THE CITY CLERK FILE A NOTICE OF DETERIVIINATION On motion by Commissioner Soto, seconded by Commissioner Souza, and by the following roll call vote, to wit: AYES: Commissioners Soto, Souza, Tappan, Carr, Moore, and Chairman Brandy NOES: None ABSENT: None ABSTAIN: Commissioner Reilly the foregoing amended Resolution was passed and adopted this 17th day of November 1992. Discussion was then held by commissioners regarding whether there should be a policy adopted by the Parks and Recreation Department of how the park should or shouldn't be used. At the present time the Parks and Recreation Department handles each request individually and makes their determination. It was decided that no motion would be made by the Planning Commission and it would be left up to the City Council to pursue it. NON - PUBLIC HEARING ITEM (CONTINUED) - INTERPRETATION OF DEVELOPMENT CODE REGARDING KIOSKS, APPLIED FOR BY AL AND CAROL ALBIN Current Planner Scott Spierling stated that this was continued from October 20, 1992, meeting by the Planning Commission to get input on possible air quality concerns. He advised that the applicant is proposing to add espresso coffee. If it is determined to be of the same or similar as the existing use or less intense, applicant need only apply for a business license. However if the use is determined to be different or more intensive than the previous sue, a Conditional Use Permit will be required. He further informed the commission that there were two Resolutions in their packets and they would be voting on one of them. Al Albin, applicant, spoke to the Commission stating that the existing fast photo business was very poor and the addition of the espresso coffee would improve their venture. He presented information regarding the vehicle movement now and anticipated upon the addition of the espresso. After a brief discussion by the commissioners, it was determined that this kiosk would not be different or more intensive, and that the air quality would not be adversely affected. NON - PUBLIC HEARING ITEM - INTERPRETATION - REQUEST TO OPERATE A REAL ESTATE BUSINESS WITHOUT A CONDITIONAL USE PERMIT, APPLICANT HENRY BYZINSKI Planning Director Liberto -Blanck presented the staff report to the Commission. Henry Byzinski gave stated his planned improvements and desire to move ahead with his plans on an affirmative of the Commission. RESOLUTION NO. 92 -1395 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE PROVIDING AN INTERPRETATION OF THE DEVELOPMENT CODE REGARDING 1203 GRAND AVENUE On motion by Commissioner Soto, seconded by Commissioner Tappan, and by the following roll call vote, to wit: AYES: Commissioners Soto, Tappan, Carr, Moore, Souza, Reilly, and Chairman Brandy NOES: None ABSENT: None the foregoing Resolution was passed and adopted this 17th day of November 1992. PLANNING DIRECTOR ITEMS Ms. Liberto -Blanck discussed AAC recommendation for a City entrance sign identifying businesses near the Grand Avenue off -ramp. AAC is asking that the Planning Commission recommend this go onto the Council. She also stated that the Council could write a letter to Caltrans to install signs along 101 near Grand Avenue referencing businesses. Commissioner Carr moved that the Planning Commission recommend to the City Council that business signage be pursued at the Grand Avenue off ramps per recommendation of the AAC, and that a letter be sent to Caltrans for a historic village sign and business signs, seconded by Commissioner Soto, and unanimously carried.
