ARROYO GRANDE PLANNING COMMISSION
OCTOBER 20, 1992
The Arroyo Grande Planning Commission met in regular session with Chairman Brandy
presiding. Present are Commissioner Souza, Soto, Moore, and Tappan. Absent is
Commissioner Carr. Planning Director Doreen Liberto - Blanck and Current Planner Scott
Spierling are in attendance.

PUBLIC HEARING - DEVELOPMENT CODE REZONE CASE NO. 92-224, CITYWIDE,
APPLIED FOR BY WASSILY VON BISKUPSKY
Current Planner Scott Spierling reviewed the staff report dated October 20, 1992. The applicant
proposes to amend Development Code Section 9- 04.130, paragraphs D -3 and E -5 to allow
common sewer lines in air space condominiums of two or more stories.
Chairman Brandy opened the public hearing.
Von Biskupsky, the applicant, spoke in favor of water conservation and stated water
conservation can be handled in the CC &R's.
There being no further comments from the audience, Chairman Brandy declared the public
hearing closed.
The Planning Commission recommended to put in the disclosure about the sewer system; and
that the CC &R's stipulate water conservation measures.
After a brief Discussion, on motion by Commissioner Souza to instruct staff to advertize a
Negative Declaration and return with a resolution recommending approval of the amendment to
the City Council, seconded by Commissioner Brandy, and the motion passed with 4 to 1 vote.
PUBLIC HEARING - CONDITIONAL USE PERMIT CASE NO. 92 -501 AND
ASSOCIATED ARCHITECTURAL REVIEW, 840 FARROLL AVENUE, APPLIED FOR
BY ROGER FULLER
Current Planner Scott Spierling reviewed the staff report dated October 20, 1992. He stated the
applicant proposes construction of a 665 square foot second residential unit over an existing
garage. Maximum proposed height is 21.5 feet. Staff recommends that the Planning
Commission open the public hearing: accept public testimony; close the hearing; and provide
direction to staff and /or recommendation to the City Council. The Planning Commission could
also continue the hearing to the regular meeting of November 17, 1992 and refer the project to
the Architectural Advisory Committee for review and comment.
Chairman Brandy opened the public hearing.
Roger Fuller, the applicant, spoke in favor of the project
Dick Grantham, 505 Woodland Drive; Jerry Martin, 514 Woodland Drive; Bob Sanders, 541
Woodland Drive; George Hill, 536 Woodland Drive; Regina Austin, 509 Woodland Drive;
Patricia Brenner, 509 Woodland Drive; Jerry Bowser, 510 Woodland Drive; Melvin and
Marlene Johnson, 835 Olive Street; Verna Murray, 518 Woodland Drive, spoke against the
project.
Art and Patricia Coplin, 856 Farroll, spoke in favor of the project.
Hearing no fur-tjier comments - Chairman Brandy declared the public hearing closed.
After - a brief discussion, on motion by Commissioner Soto to continue this Conditional Use
Permit No. 92 -501 to November 17, 1992, and to refer the project to the Architectural Advisory
Committee for review and comment, seconded by Commissioner Tappan, and the motion passed
with a 4.to 1 vote.

NON PUBLIC HEARING - TIME EXTENSION FOR CONDITIONAL USE PERMIT
CASE NO. 89 -456, 150 W. BRANCH STREET, APPLIED FOR BY DOLORES DANA
AND PAUL J. RALPH
Current Planner Scott Spierling reviewed the staff report dated October 20, 1992. He stated the
applicant proposes a one year time extension. The Staff Advisory Committee recommends that
the Planning Commission approve a one year time extension for Conditional Use Permit Case
No. 89 -456 by minute motion based upon the finding and subject to the original conditions of
approval, and the additional conditions contained in the written staff report.
Chairman Brandy opened the public hearing.
There being no comments from the audience, Chairman Brandy declared the public hearing
closed.
After a brief discussion, on motion by Commissioner Soto to approve Time Extension for
Conditional Use Permit Case No. 89 -456, seconded by Commissioner Souza, and unanimously
carried.
NON - PUBLIC HEARING - INTERPRETATION OF DEVELOPMENT CODE
REGARDING KIOSKS, COMMERCIAL ZONES CITY WIDE, APPLIED FOR BY AL
AND CAROL ALBIN
Current Planner Scott Spierling reviewed the staff report dated October 20, 1992. The applicant
proposes to combine the existing Foto Fast Kiosk, located in a Kiosk at 1105 Grand Avenue,
with an espresso coffee business. Staff recommends that the Planning Commission consider the
information presented by staff and adopt one of the attached resolutions providing an
interpretation of the Development Code.
Al Albin, the applicant, spoke in favor of the project.
After a brief discussion, on motion by Commissioner Soto to continue interpretation of
Development Code regarding Kiosks to November 17, 1992, seconded by Commissioner Souza,
and unanimously carried.
NON - PUBLIC HEARING - INTERPRETATION OF DEVELOPMENT CODE
REGARDING SECTION 9- 03.090 (F) (1), PROHIBITED IIOME OCCUPATION USES,
AUTOMOTIVE AND OTIIER VEHICLE REPAIR, APPLIED FOR BY RON ACLAN
Current Planner Scott Spierling reviewed the staff report dated October 20, 1992. Staff
recommends that the Planning Commission consider the information presented by staff and adopt
one of the two resolutions that provide interpretations of the Development Code concerning
vehicles as found in Section 9- 03.090(F).
Ron Aclan, the applicant, spoke about his project.
Ted Aclan, 103 Equestrian Way, stated that he is the applicant's uncle and partner and that most
repairs will be on the road.
After a brief discussion, on motion by Commissioner Souza, to interpret Development Code
Section 9- 03.090(F)(1) refer only to motorized vehicles, seconded by Commissioner Tappan, and
unanimously carried.
NON - PUBLIC .HEARING - INTERPRETATION OF DEVELOPMENT CODE
REGARDING GUEST QUARTERS, RESIDENTIAL ZONES CITY WIDE, APPLIED FOR
BY ED CHADWELL
Current Planner Scott Spierling reviewed the staff report dated October 20, 1992. Staff
recommends that the Planning Commission consider the information presented by staff and adopt
a resolution that provide interpretations of the Development Code concerning guest quarters
which indicates that guest quarters are living quarters that:

1) Provide protection from the elements;
2) Provide lighting;
3) Provide for heating, whether from fixed units or portable heaters; and
4) Provide sanitation facilities including a tub and /or shower.
Staff would note that this interpretation does not agree with Mr. Chadwell's interpretation of the
code. If the Planning Commission feels that a different interpretation of the Development Code
is appropriate, the Commission should provide direction to staff in drafting a resolution setting
forth the findings of the Commission.
Ed Chadwell, the applicant, spoke about his project.
After a brief discussion, on motion by Commissioner Souza make the interpretation that addition
to existing definition, guest quarters, are living quarters that provide protection from the
elements; provide lighting; provide for heating, whether from fixed units or portable heaters;
and provide sanitation facilities including a tub and /or shower, seconded by Commissioner
Tappan, and unanimously carried.
PLANNING DIRECTOR ITEMS
Commissioner Tappan made a motion to cancel the November 3, 1992 Planning Commission
meeting due Election Day, which was seconded by Commissioner Moore, and unanimously
carried.
Affordable Housing - no update.
Economic Development - no update.
Proposition 116 - COG continued their meeting to November 12, 1992.
ADJOURNMENT
On motion by Commissioner Tappan to adjourn to a regular Planning Commission meeting on
November 17, 1992, seconded by Commissioner Souza, and unanimously carried.
There being no further business before the Commission, the meeting was adjourned at 10:15
P.M.
