PC Minutes 1992-10-06388 ARROYO GRANDE PLANNING COMMISSION OCTOBER 6, 1992 The Arroyo Grande Planning Commission met in regular session. Present are Commissioners Souza, Soto, Moore, and Tappan. Absent are Commissioner Carr and Chairman Brandy. Planning Director Doreen Liberto - Blanck, Current Planner Scott Spierling, Director of Fire and Building Kurt Latipow, and Public Works Director Van Laurn are in attendance. On a motion by Commissioner Souza to appoint Commissioner Soto as Acting Chairman, seconded by Commissioner Tappan, and unanimously carried. ORAL COMMUNICATIONS - Ernest Serina, 435 Le Point Street, spoke of drainage problems on Le Point Street. PUBLIC HEARING - VARIANCE CASE NO. 92 -168 AND ADMINISTRATIVE SIGN PERMIT, 1350 GRAND AVENUE, APPLIED FOR BY HOME SAVINGS OF AMERICA Current Planner Scott Spierling reviewed the staff report dated October 6, 1992. The applicant proposes a variance to exceed the allowed number of signs and to allow three (3) roof signs. The Architectural Advisory Committee and the Staff Advisory Committee recommend that the Planning Commission adopt a resolution which approves the variance with the findings and subject to the conditions of approval; and approve the administrative sign permit for Home Savings by minute motion. Acting Chairman Soto opened the public hearing. There being no comments from the audience, Acting Chairman Soto declared the public hearing closed. After a brief Discussion, the following action was taken: RESOLUTION NO. 92 -1387 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A VARIANCE, CASE NO. 92 -168, APPLIED FOR BY HOME SAVINGS OF AMERICA AT 1350 GRAND AVENUE, VARIANCE TO EXCEED THE ALLOWED NUMBER OF SIGNS AND TO ALLOW THREE (3) ROOF SIGNS On motion by Commissioner Souza, seconded by Commissioner Moore, and by the following roll call vote, to wit: AYES: Commissioners Souza, Moore, Tappan, and Acting Chairman Soto NOES: None ABSENT: Commissioner Carr and Chairman Brandy the foregoing Resolution was passed and adopted this 6th day of October, 1992. On minute motion by Commissioner Souza to approve an Administrative Sign Permit for Home Savings of America, seconded by Commissioner Moore, and unanimously carried. PUBLIC HEARING - VARIANCE CASE 92 -169 AND SIGN PERMIT CASE NO. 92 -106, VARIANCE TO ALLOW A FREESTANDING SIGN FOR A SHOPPING CENTER TENANT; PLANNED SIGN PROGRAM TO LOWER AN EXISTING FREESTANDING SIGN TO A MAXIMUM HEIGHT OF 15 FEET AND REDUCE EACH SIGN FACE TO 69 SQ. FT., 1400 GRAND AVENUE, APPLIED FOR BY PAYLESS DRUG STORE Current Planner Scott Spierling reviewed the staff report dated October 6, 1992. He stated the applicant proposes a variance to allow a tenant in a shopping center to have a freestanding sign; and a planned sign program to lower an existing freestanding sign to a maximum height of 15 feet and reduce each sign face to 69 square feet. The Architectural Advisory Committee and the Staff Advisory Committee recommend that the Planning Commission adopt a resolution approving Variance Case No. 92 -169 with the findings and subject to the conditions of approval; and adopt the resolution approving Sign Permit Case No. 92 -106 with the findings and subject to the conditions of approval. Dick Sattler of Oregon Signs, applicant's representative, stated that the applicant accepts the findings and conditions and that the applicant is in favor of the wood background. PUBLIC HEARING - REZONE CASE NO. 92-225, CITYWIDE, APPLIED FOR BY THE CITY OF ARROYO GRANDE Planning Director Doreen Liberto - Blanck reviewed the staff report dated October 6, 1992. Ms. Liberto- Blanck reviewed amendments to the Development Code: 1) Amend Section 9 -03.05 (b) (2), combining Professional Office with Retail Commercial. 2) Amend Section 9- 03.120 (5) to permit staff to ,grant a minor exception for parking space size up to two (2) feet. 3) Add Section 9- 03.120 (6) which allows the Planning Commission to make interpretations of other minor exception items which are not specifically stated. Acting Chairman Soto opened the public hearing. There being no comments from the audience, Acting Chairman Soto declared the public hearing closed. After a brief discussion, the following action was taken: 389 390 Arroyo Grande Planning Commission Page 3 October 6, 1992 RESOLUTION NO. 92 -1390 RESOLUTION OF THE CITY OF ARROYO GRANDE PLANNING COMMISSION RECOMMENDING THAT THE CITY COUNCIL ADOPT A NEGATIVE DECLARATION, INSTRUCT THE CITY CLERK TO FILE A NOTICE OF DETERMINATION AND AMEND VARIOUS SECTIONS OF THE DEVELOPMENT CODE (REZONE CASE NO. 92 -225) On motion by Commissioner Souza, seconded by Commissioner Tappan, and by the following roll call vote, to wit: AYES: Commissioners Souza, Tappan, Moore, and Acting Chairman Soto NOES: None ABSENT: Commissioner Carr and Chairman Brandy the foregoing Resolution was passed and adopted this 6th day of October, 1992. PUBLIC HEARING - CONDITIONAL USE PERMIT CASE NO. 92-497, 751 S. TRAFFIC WAY EXTENSION, APPLIED FOR CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS Current Planner Scott Spierling reviewed the staff report dated October 6, 1992. This project was continued from the meeting of August 4, 1992. The applicant proposes to construct two additions totalling 3951 square feet on an existing church; minor exterior remodel of building; upgrade parking and landscaping; and construct roadway improvements. The Architectural Advisory Committee and the Staff Advisory Committee recommend that the Planning Commission: 1) Adopt a resolution adopting a negative declaration, instruct the secretary to file a Notice of Determination, and approve Conditional Use Permit Case No. 92 -497 with the findings and subject to the conditions of approval; and 2) approve the architectural review for the Latter Day Saints Church by minute motion. For the record, Commissioner Soto and Souza were not present at the meeting of August 4, 1992; Both Commissioners stated that they have listened to the tape of the August 4, 1992 Planning Commission meeting, and all documents have been read. Commissioner Tappan questioned condition 29, providing a fire sprinkler system throughout the facility. Fire Chief Kurt Latipow stated he concurred with the condition, based on the increasing capacity of the facility and that the City has a volunteer fire department. Adding automatic fire protection systems reduces the hazards not only for the safety of the occupants of the building but also to the fire fighters. The Planning Commission questioned the possibility of the City maintaining South Traffic Way Extension. Public Works Director Van Laurn stated that if the City approves the condition as written, the church will have a 20 foot road with private maintenance of it. If all of the property owners 'agree to grant the necessary right -of -way, the City may compromise on the improvements. For the record, he stated that the site plan that Mr. Spierling presented to the Planning Commission was a very early site plan. The drainage on it is not accurate; it leads to a false conclusion that drainage from the site is presently going to the O'Connor's property, when it is not. City Staff is not recommending a change in the drainage flow, but a maintenance of the existing (historic) drainage flow. The existing drainage flow presently ponds in the road and this is the reason why the road is deteriorated. It should exit through the Lawler property to the freeway, which is the historic path. This is what City Staff has indicated should be continued. Acting Chairman Soto declared the public hearing open. Arroyo Grande Planning Commission Page 4 October 6, 1992 David Brannon, Studio Design Group, stated the applicant is comfortable with the conditions as written. The applicant will work with what the City recommends on drainage. James Lawler, 750 S. Traffic Way, A.G., and Howard Mankins spoke on drainage. Vernon Fredericks, 747 White Oaks, Pismo Beach; spoke in favor of a public road. Mr. and Mrs. Dean, 111 Orcutt Lane spoke of concerns on drainage and spoke against a 35 mph design speed. Sandra O'Connor, 650 S. Traffic Way Ext. spoke on concerns of drainage. Hearing no further comments from the audience, Acting Chairman Soto declared the public hearing closed. After a brief discussion, the Planning Commission recommended that the first sentence of condition #25 be clarified as to read: 25. Building drainage shall be directed via road surface to maintain the historic drainage route as determined by the Director of Public Works. A motion by Commissioner Souza was made to approve Architectural Review for the Latter -Day Saints Church, seconded by Commissioner Moore, and unanimously approved. Wynn Dewsnup, area representative for the Church of Jesus Christ of Latter - Day Saints, thanked the Planning Commission and Staff for their effort and time. PLANNING DIRECTOR ITEMS The cancellation of the November 3, 1992 Planning Commission meeting will be discussed on October 20, 1992. Affordable Housing - no update. Economic Development - no update. Bike and Pedestrian Access - Council of Governments is recommending that the City of Arroyo Grande consider some State discretionary funds to put a bridge over highway 101 along Fair Oaks Avenue. 392.
