PC Minutes 1992-09-013 7Th ARROYO GRANDE PLANNING COMMISSION SEPTEMBER 1, 1992 The Arroyo Grande Planning Commission met in regular session with Chairman Brandy presiding. Present are Commissioners Souza, Soto, Moore, and Tappan. Commissioner Carr is absent. Current Planner Scott Spierling is also in attendance. Chairman Brandy stated to the audience that the agenda items will be taken out of order. ORAL COMMUNICATIONS - None PUBLIC HEARING - CONDITIONAL USE PERMIT CASE NO. 92-497, 751 S. TRAFFIC WAY EXTENSION, APPLIED FOR BY CHURCH OF JESUS CHRIST OF LATTER -DAY SAINTS Current Planner Scott Spierling reviewed the staff report dated September 1, 1992. Due to concerns about the project, the Staff Advisory Commission recommends that the public hearing be continued to the regular Planning Commission meeting of October 6, 1992. A motion was made by Commissioner Soto to continue Conditional Use Permit 92 -497 to October 6, 1992, seconded by Commissioner Moore, and unanimously carried. PUBLIC HEARING - VIEWSHED REVIEW PERMIT NO. 92 -37, 116 BELL STREET, APPLIED FOR BY HUE C. DIEP Current Planner Scott Spierling reviewed the staff report dated September 1, 1992. He stated the applicant proposes a second story, 732 square foot addition to an existing 1139 square foot single family home. Maximum height proposed is 22 feet. The Staff Advisory Committee recommends that the Planning Commission deny Viewshed Review Case 92 -37 by minute motion with the findings for denial contained in the staff report. Chairman Brandy opened the public hearing. Hue C. Diep, applicant, spoke in favor of project; and Gregory D. Soto, applicant's representative, spoke on the project. He stated that the project was in character with the cottage type homes Thelma Spohn, 517 Cornwall spoke of concerns regarding utility lines; Paul Quinlinn, 511 Cornwall; Kim Burd, 515 Cornwall; and Louis Brazil 603 Cornwall spoke against project. For the record, Commissioner Soto stated that he was not related to Gregory Soto. Hearing no further comments from the audience, Chairman Brandy declared the public hearing closed. The Planning Commission addressed the fact that the second residential unit does not meet second residential unit requirements; and that the proposed structure is not consistent with the established scale and character of the neighborhood. After a brief discussion, a motion was made by Commissioner Soto to deny Viewshed Review Permit No. 92 -37. The motion was seconded by Commissioner Souza, and unanimously carried. PUBLIC HEARING - TENTATIVE PARCEL MAP CASE NO. 92 -501, CONDITIONAL USE PERMIT CASE NO. 92 -496 AND ASSOCIATED ARCHITECTURAL REVIEW, AT 220 SHORT STREET, APPLIED FOR BY PETE MUSCARELLA Current Planner Spierling reviewed the staff report dated September 1, 1992. The applicant proposes to create two lots, lot number 1 = 4,726 square feet, lot number 2 = 5,166 square feet. A two -story house is proposed on each lot. The Architectural Advisory Committee and the Staff Advisory Committee recommends that the Planning Commission adopt a resolution approving Conditional Use Permit 92 -496, adopting a negative declaration, and instructing the Secretary to file a Notice of Determination; adopt the attached resolution approving Tentative Parcel Map Case No. 92 -501, adopting a negative declaration, and instructing the Secretary to file a Notice of Determination; and approve the associated architectural review by minute motion. He disregarded his comment due to a misinterpretation of condition 32. Pete Muscarella, applicant; Bob Thompson, 229 Short Street; and Earl Littleton, 217 Short, spoke in favor of project. Hearing no further comments from the audience, Chairman Brandy declared the public hearing closed. After a brief discussion, the Planning Commission recommended an amendment to condition #1 of the resolution to delete a period after the word parcel and as to read: 1) "These conditions of approval shall be attached to any real estate disclosure statement accompanying the sale of either parcel in perpetuity. The real estate disclosure statement for lot 1 shall also notify subsequent property owners of the existence of the sump pump and the need for maintenance of said pump." 2) Delete condition #15. 3) Modify condition #36 to read: "Residential fire sprinkler systems shall be installed in rear structure prior to final occupancy." The following action was taken. RESOLUTION NO. 92 -1381 THE RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING CONDITIONAL USE PERMIT (P.U.D PERMIT) CASE NO. 92 -496, TO CREATE A TWO -UNIT PLANNED UNIT DEVELOPMENT, APPLIED FOR BY PETE MUSCARELLA AT 220 SHORT STREET; ADOPTION OF A NEGATIVE DECLARATION AND INSTRUCTING THE SECRETARY TO FILE A NOTICE OF DETERMINATION On motion by Commissioner Soto, seconded by Tappan, and by the following roll call vote, to wit: AYES: Commissioners Soto, Moore, Souza, Tappan, and Chairman Brandy NOES: None ABSENT: Commissioner Carr the foregoing Resolution was passed and adopted this 1st day of September, 1992. RESOLUTION NO. 1382 THE RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE PARCEL MAP CASE NO. 92 -501, LOCATED AT 220 SHORT STREET, APPLIED FOR BY PETE MUSCARELLA; ADOPTING A NEGATIVE DECLARATION; AND INSTRUCTING THE SECRETARY TO FILE A NOTICE OF DETERMINATION '37'9 38.0 Arroyo Grande Planning Commission Page 3 September 1, 1992 On motion by Commissioner Soto, seconded by Tappan, and by the following roll call vote, to wit: AYES: Commissioners Soto, Moore, Souza, Tappan, and Chairman Brandy NOES: None ABSENT: Commissioner Carr the foregoing Resolution was passed and adopted this 1st day of September, 1992. PLANNING DIRECTOR ITEMS Current Planner Spierling briefed the Planning Commission on the joint afternoon workshop with the City Council on September 22, 1992 on SRRE. He stated the time has been changed to 3:30 P.M. not at 2:00 P.M. ADJOURNMENT There being no further business before the Commission, on motion by Commissioner Soto to adjourn the Planning Commission meeting at 9:20 P.M., seconded by Commissioner Souza, and unanimously carried.
