Jerry Hurley, Architect, spoke on the project; and Earl Patton, owner of the property, spoke in
favor of the project.
Robert Thompson, 229 Short Street; Earl Littleton, 217 Short Street; Bill Hart, 207 Bridge
Street; Nancy Underwood, 142 Short Street spoke against the project.
The Planning Commission recommended amendments to the conditions of approval as follows:
1) An amendment to the first sentence of condition 12 under the Planning Department
conditions of the resolution modified to read:
"Six (6) months after the start of school in this location, this conditional use
permit shall be reviewed by the Police, Pubic Works and Planning Departments,
and the Planning Commission to assess pedestrian safety, neighborhood parking,
loitering, crime, trash, traffic, noise, and other neighborhood concerns."
2) The last sentence of condition 12 be deleted.
3) Adding condition 12a as to read:
"Maximum number of students attending the school during a single session shall
be 100, with a maximum of 2 sessions."
4) Deleting conditions 19 and 20 under Public Works Department Conditions.
Hearing no further comments from the audience, Acting Chairman Soto declared the public
hearing closed. After a brief discussion, the following action was taken with the amended
conditions of approval.

LUCIA MAR UNIFIED SCHOOL DISTRICT; ADOPTING A
NEGATIVE DECLARATION AND INSTRUCTING THE
SECRETARY TO FILE A NOTICE OF DETERMINATION.
On motion by Commissioner Carr, seconded by Commissioner Moore, and by the following roll
call vote, to wit:
AYES: Commissioners Carr, Moore, Tappan, and Acting Chairman Soto
NOES: None
ABSENT: Chairman Brandy
ABSTAIN: Commissioner Souza

PUBLIC HEARING - CONDITIONAL USE PERMIT CASE NO. 92 -503, 145 BRIDGE
STREET, APPLIED FOR BY RALPH AND JEAN BUSH
Planning Intern Gayle Feichter reviewed the staff report dated August 18, 1992. The applicant
proposed changing of use of an existing building from a warehouse to retail commercial uses and
storage. She stated that the Staff Advisory Committee recommends that the Planning
Commission adopt a resolution adopting a negative declaration, instructing the secretary to file
a Notice of Determination, and approve Conditional Use Permit Case No. 92 -503 with the
findings and subject to the conditions contained in the resolution.

Acting Chairman Soto opened the public hearing.
Ralph Bush, applicant, spoke in favor of project and stated he had no problems with the
conditions.
Commissioner Carr departed the meeting at 9:40 p.m.
Hearing no further comments from the audience, Chairman Soto declared the public hearing
closed. After a brief discussion, the following action was taken.

PUBLIC HEARING - TENTATIVE PARCEL MAP CASE NO. 92-503, 538 IDE STREET,
APPLIED FOR BY THE ESTATE OF OLIVER NELSON
Current Planner Scott Spierling reviewed the staff report dated August 18, 1992. The applicant
proposes to subdivide a single one -acre parcel into four lots whose average net area is 8506
square feet. He stated that the Staff Advisory Committee recommends that the Planning
Commission adopt a resolution approving the Tentative Parcel Map subject to the findings and
conditions of approval; adopt a Mitigated Negative Declaration; and instruct the secretary to file
a notice of determination. An alternative recommendation would be that the Planning
Commission continue this item to address any outstanding issues.
Acting Chairman Soto opened the public hearing.
Jim McGillis, San Luis Engineering, spoke on the project, and answered questions or concerns.
Mr. Howser, 220 Garden Street; Paul Weinberg, 546 Ide Street; Rod Hogan, 247 Cross Street;
Ed and Jeanne Phillips, 255 Cross Street; Delia Hogan, 246 Cross Street; spoke on drainage
problems and on the well -being of the trees located on the Nelson estate.
Mr. and Mrs. Nelson spoke in favor of the project.
Hearing no further comments from the audience, Acting Chairman Soto declared the public
hearing closed. After a brief discussion, the Planning Commission amended the following to
the conditions of approval:
8a. Construction on lots 1 -4 shall be limited to single story homes.

ARROYO GRANDE PLANNING COMMISSION
AUGUST 18, 1992
The Arroyo Grande Planning Commission met in regular session. Present are Commissioners
Moore, Souza, Soto, and Tappan. Commissioners Carr, and Chairman Brandy are absent.
Planning Director Doreen Liberto - Blanck, Current Planner Scott Spierling, and Planning Intern
Gayle Feichter are also in attendance.
Due to the absence of Chairman Brandy and Vice Chairman Carr, a motion was made by
Commissioner Souza to appoint Commissioner Soto as Acting Chairman, which was seconded
by Commissioner Tappan, and unanimously carried.
Acting Chairman Soto stated that the items on the agenda would be taken out of order.
APPROVAL OF MINUTES
Hearing no additions or corrections, minutes of June 16, 1992 and July 7, 1992 were approved
on a motion by Commissioner Moore, seconded by Commissioner Souza, and unanimously
carried.

PUBLIC HEARING - DEVELOPMENT CODE REZONE CASE NO. 92-224, CITYWIDE,
APPLIED FOR BY WASSILY VON BISKUPSKY
Current Planner Spierling reviewed the staff report dated August 18, 1992. The applicant
proposes to amend Development Code Section 9- 04.130, paragraphs D -3 and E -5 to allow
common sewer lines in air space condominiums of two or more stories. He stated the Staff
Advisory Committee recommends that the Planning Commission adopt the attached resolution
recommending that the City Council Deny Development Code Rezone Case No. 92 -224 with the
findings contained in the resolution.
Vice Chairman Carr entered the meeting at 7:45.
Acting Chairman Soto opened the public hearing.
Wassily Von Biskupsky, the applicant, spoke in favor of the project.
Hearing no further comments, Acting Chairman Soto closed the public hearing.
After discussion, the Planning Commission requested that Staff do research of other cities that
allow common sewer lines in air space condominiums, and that the applicant can come back with
other alternatives to prevent sewer backup.
After a brief discussion, a motion was made by Commissioner Souza, to continue Development
Code Rezone Case No. 92 -224 to October 20, 1992, seconded by Commissioner Tappan, and
unanimously carried.
PUBLIC HEARING - CONDITIONAL USE PERMIT CASE NO. 92 -502, 227 BRIDGE
STREET, APPLIED FOR BY LUCIA MAR UNIFIED SCHOOL DISTRICT
Due to a possible conflict of interest, Commissioner Souza stepped down. Current Planner Scott
Spierling reviewed the staff report dated August 18, 1992. The applicant proposed to convert
a church to a public high school. The existing two story classroom building shall be used for
the school and the chapel shall be used for school district storage. He stated that the Staff
Advisory Committee recommends that the Planning Commission adopt the attached resolution
that adopts a negative declaration; instructs the secretary to file a Notice of Determination; and
approves Conditional Use Permit Case No. 92 -502 with the findings and subject to the
conditions of approval contained in the resolution.
Acting Chairman Soto opened the public hearing.
Scott Lathrop, representative, spoke on the project. He requested that condition 19 and 20 be
deleted, and asked if Lucia Mar School District could possibly sublease the building to churches.

8b. Prior to recordation of the final parcel map, the applicant shall construct a two
(2) foot high concrete fence footing (for drainage diversion) along the entire
westerly properly line. A six (6) foot high fence shall be constructed on top of
the footing along the westerly boundary of lots 2, 3, and 4.
15. A fence shall be constructed along the east property line: A concrete block, steel
reinforced wall, six (6) feet high shall be constructed along the east property line
of lot 1 from the northwest corner of the house at 546 Ide Street to the south
property line of lot 1.
