PC Minutes 1992-06-16ARROYO GRANDE PLANNING COMMISSION JUNE 16, 1992 The Arroyo Grande Planning Commission met in regular session with Chairman Brandy presiding. Present are Commissioner Souza, Groves, and Moore. Commissioners Boggess, Carr, and Soto are absent. Planning Director Doreen Liberto - Blanck and Current Planner Scott Spierling are also in attendance. APPROVAL OF MINUTES Hearing no additions or corrections, minutes of May 19, 1992 were approved by Commissioner Moore, seconded by Commissioner Souza, and unanimously carried. ORAL COMMUNICATIONS - None PUBLIC HEARING - VARIANCE CASE NO. 92 -164, 121 POOLE STREET, APPLIED FOR BY EARL PATTON Commissioner Souza stepped down because of a possible conflict of interest. There being no quorum, Variance Case No. 92 -164 was automatically continued to the regular Planning Commission meeting of July 7, 1992. PUBLIC I-IEARING - PLANNED DEVELOPMENT REZONE CASE NO. 91 -223, SPECIFIC DEVELOPMENT PLAN CASE NO. 91 -05, ARCHITECTURAL REVIEW CASE NO. 91 -470, DRAFT ADDENDUM TO THE EIR FOR THE HALCYON IIILLS SUBDIVISION, 600 RODEO DRIVE, APPLIED FOR BY ARROYO GRANDE PRESBYTERIAN CI- IURCI-I Mike Multari, Crawford Multari & Starr, reviewed the staff report dated June 16, 1992. He addressed the westerly access driveway problem, and stated that both Fire Department and Public Works Department agreed that the westerly driveway will be used as an exit only driveway. He stated that the Staff Advisory Committee and Architectural Committee recommend that the Planning Commission recommend that the City Council certify the Addendum EIR; recommend approval of Planned Development Rezone 91 -223 and Specific Plan Case 91 -05 to the City Council, with the following findings and subject to the conditions of approval identified as Attachment A; and recommend approval of Architectural Review Case 91- 470 by minute motion. Chairman Brandy opened the public hearing. Curtis Ellingworth, representative of the Presbyterian Church, spoke in favor of the project and that the church was comfortable with the conditions. Hearing no further comments from the audience, Chairman Brandy declared the public hearing closed. After a brief discussion, the following action was taken. RESOLUTION NO. 92 -1372 A RESOLUTION OF THE PLANNING COMMISSION OF TIIE CITY OF ARROYO GRANDE RECOMMENDING THAT THE CITY COUNCIL CERTIFY THAT THE ENVIRONMENTAL IMPACT REPORT FOR THE HALCYON HILLS SUBDIVISION WITII TIIE PREVIOUS ADDENDA AND TIIE ADDENDUM FOR THE ARROYO GRANDE PRESBYTERIAN CIIURCH PROJECT HAS BEEN PREPARED IN COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. AND SPECIFIC DEVELOPMENT PLAN NO. 91 -05 TO ALLOW A CHURCH ON LOT 184 OF TRACT 1390 (ROYAL OAKS ESTATES) On motion by Commissioner Souza, seconded by Commissioner Moore, and by the following roll call vote, to wit: AYES: Commissioners Souza, Moore, Groves, and Chairman Brandy NOES: None ABSENT: Commissioners Boggess, Carr and Soto the foregoing Resolution was passed and adopted this 16th day of June, 1992. A minute motion by Commissioner Souza to approve Architectural Review Case No. 91 -410, was seconded by Commissioner Groves, and unanimously carried. PUBLIC HEARING - SIGN PERMIT CASE NO. 92 -104, VARIANCE CASE NO. 92 -166, 1570 W. BRANCI -I STREET, APPLIED FOR BY K -MART CORPORATION Current Planner Scott Spierling reviewed the staff report dated June 16, 1992. He stated that the Architectural Advisory Committee and the Staff Advisory Committee recommends that the Planning Commission adopt a resolution recommending approval' of Variance Case No. 92 -166 to the City Council with the following findings and subject to the attached conditions of approval; and adopt a resolution recommending approval of Sign Permit Case No. 92 -104 to the City Council with the following findings and subject to the attached conditions of approval. Chairman Brandy opened the public hearing. Hearing no comments from the audience, Chairman Brandy declared the public hearing closed. After a brief discussion, the following action was taken. NON - PUBLIC HEARING - APPLICATION PROCESSING /DEVELOPMENT CODE Planning Director Liberto - Blanck reviewed the staff report dated June 16, 1992. She briefed the Commission and made recommendations on Conditional Use Permit (CUP) Procedures (Section 9- 03.050); Minor Exceptions (Section 9- 03.120); and Business License Applications (Section 9- 03.180). Conditional Use Permit Procedure (Section 9- 03.050) - Liberto- Blanck stated that staff recommends a change to Section 9- 03.050 (B)(2) of the Development Code. The Retail Commercial category would be combined with Professional Office, and a new category which includes Shopping Centers, Convenient Stores and Saving Institutes would be created. Staff recommends that the Planning Commission instruct staff to return with an amendment to the Development Code making the correction. Minor Exception Applications (Section 9- 03.120) - Liberto - Blanck stated staff recommends that Section 9- 03.120 of the Development Code permits the Planning Director to grant Minor Exception to certain ordinance requirements rather than requiring a variance procedure; and to instruct staff to return with an amendment to the Development Code making the correction. PLANNING DIRECTOR /PLANNING COMMISSION ITEMS Economic Development - Nothing new to pass on. Bike and Pedestrian - Nothing new to pass on.
