ARROYO GRANDE PLANNING COMMISSION
JUNE 2, 1992
The Arroyo Grande Planning Commission met in regular session with Vice Chairman Carr
presiding. Present are Commissioner Souza, Groves, Soto, and Moore. Commissioner Boggess
and Chairman Brandy are absent. Planning Director Doreen Liberto - Blanck and Current Planner
Scott Spierling are also in attendance.

PUBLIC HEARING - CONDITIONAL USE PERMIT CASE NO. 91 -485,
ARCHITECTURAL REVIEW CASE NO. 91 -466, SUPPLEMENT TO THE FINAL EIR
FOR OAK PARK ACRES, TRACT 604, 1570 W. BRANCH, APPLIED FOR BY K -MART
CORPORATION
Current Planner Scott Spierling reviewed the staff report dated June 2, 1992. He stated the
applicant proposes a Conditional Use Permit and Architectural Review for an 11,305 net square
foot addition to an existing K -Mart Store. The Staff Advisory Committee recommends that the
Planning Commission adopt resolutions recommending that the City Council certify the Final
Supplement EIR for the K -Mart project based on the findings contained in Attachment "A ",
"Statement of Significant Environmental Effects and Mitigation Measures "; recommend that the
City Council approve Conditional Use Permit Case No. 91 -466 based on the following findings
and subject to the attached mitigation measures (Attachment "B ") and Conditions of Approval
(Attachment C "); and recommend approval of Architectural Review Case No. 91 -466 to the City
Council by minute motion.
Vice Chairman Carr opened the public hearing.
John Dorsett, the applicant's representative, spoke in favor of the project.
Hearing no further comments from the audience, Vice Chairman Carr declared the public
hearing closed. After a brief discussion, the following action was taken.

ARROYO GRANDE RECOMMENDING THAT THE CITY COUNCIL
CERTIFY THAT THE SUPPLEMENT TO THE ENVIRONMENTAL
IMPACT REPORT FOR OAK PARK ACRES (TRACT 604) PREPARED
FOR THE K -MART ADDITION HAS BEEN PREPARED IN
COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT AND RECOMMENDING THAT THE CITY COUNCIL CERTIFY
THAT THE CITY COUNCIL HAS REVIEWED AND CONSIDERED THE
INFORMATION CONTAINED IN THE FINAL SUPPLEMENT
ENVIRONMENTAL IMPACT REPORT; CONDITIONAL USE PERMIT
CASE NO. 91 -485, AND ARCHITECTURAL REVIEW CASE NO. 91 -466,
AND INSTRUCTING THE CITY CLERK TO FILE A NOTICE OF
DETERMINATION
On motion by Commissioner Soto, seconded by Commissioner Souza, and by the following roll
call vote, to wit:
AYES: Commissioners Soto, Souza, Moore, Groves, and Vice Chairman Carr
NOES: None
ABSENT: Commissioner Boggess, and Chairman Brandy
the foregoing Resolution was passed and adopted this 2nd day of June, 1992.
A minute motion by Commissioner Soto to approve Architectural Review Case No. 91 -466, was
seconded by Commissioner Souza, and unanimously carried.

PUBLIC HEARING (NEW) - VARIANCE CASE NO. 92 -164, 121 POOLE STREET,
APPLIED FOR BY EARL PATTON
Commissioner Soto and Commissioner Souza stepped down because of a conflict of interest.
There being no quorum, Variance Case No. 92 -164 was automatically continued to the regular
Planning Commission meeting of June 16, 1992.
PUBLIC HEARING (NEW) - APPEAL OF PLANNING DIRECTOR DECISION OF THE
REQUIREMENT FOR A CONDITIONAL USE PERMIT, 121 N. HALCYON ROAD,
FRANK AND ELEANOR KINSELLA
Current Planner Spierling reviewed the staff report dated June 2, 1992. He stated that the
applicant appealed the requirement for a Conditional Use Permit in the conversion of Kinsella
Realty to an antique shop. Staff recommends that the Planning Commission deny the appeal of
the Planning Director's determination, by minute motion, with the findings: 1) The proposed
use is not the same or similar in character to the existing use because the existing use is a
professional office and the proposed use is retail commercial. 2) The proposed use is not less
intensive than the existing use. Typical, retail uses are more intensive than professional office
uses. 3) The proposed use may have the possibility of a significant impact on the environment.
Vice Chairman opened the public hearing.
Frank Kinsella, applicant, 121 N. Halcyon, spoke in favor of project.
Current Planner Spierling stated that the applicant proceeded with the appeal process because
it was quicker than the conditional use permit process. The applicant had a prospective tenant
that could not wait to go through the use permit process.
Hearing no further comments from the audience, Vice Chairman Carr declared the public
hearing closed.
The Planning Commission requested that Staff and applicant provide more information on the
project.
After a brief discussion, on minute motion by Commissioner Moore to deny the appeal of the
Planning Director's determination, seconded by Commissioner Groves, and the motion carried
with a 3 to 2 vote.
NON PUBLIC HEARING - HOUSING ISSUES
Commissioner Groves provided an overview of the staff report on housing, dated June 2, 1992.
She stated that two key issues must be addressed: 1) Updating the City Housing Element and
preparing a Comprehensive Housing Affordability Strategy; and 2) establishing housing
programs as required by the implementation measures of the adopted housing element of the
general plan. Commissioner Groves recommend that the Planning Commission authorize her
to represent the Commission updating the City Council on the housing issue and presenting the
above questions at the next City Council meeting. She also recommend that the Planning
Commission recommend a joint session with the City Council, and include the Senior Advisory
Committee to discuss housing.
Scott Smith of People Self Help Program reviewed a memo on Housing Affordability and
Waiting List Statistics. He stated that Housing Element compliance is a mandatory requirement
in order to obtain state and federal financing for affordable housing, and the City will not be
able to apply for grants if the Housing Development is not updated. The Self Help Program
plans to ask the City to sponsor a block program in the Spring of 1993.
The Commission questioned Mr. Smith on various concerns regarding resale prices, average lot
sizes, and managing rental properties, etc.

George Moylan, Director of Housing Authority of San Luis Obispo briefed the Planning
Commission on the Comprehensive Housing Affordability Strategies (CHA's). He stated that
in order to receive funding under certain HUD programs, a State or unit of general local
government must have a CHA's that has been approved by HUD.
On minute motion by Commissioner Moore, to authorize Commissioner Groves to represent the
Commission updating the City Council on the housing issue; to recommend that the Planning
Commission recommend a joint session with the City Council, and include the Senior Advisory
Committee to discuss housing; recommend that the Housing Element be updated, and the
Planning Department Staff pursue the cost and funding opportunities for doing an update of the
Housing Element; the Planning Commission continue to pursue housing issues, and pursue of
the entitlement agreement with the City of San Luis Obispo, seconded by Commissioner Souza,
and unanimously carried.
PLANNING DIRECTOR /PLANNING COMMISSION ITEMS
Economic Development - Commissioner Soto briefed the Commission on the need for an
inventory list of all commercial lease spaces available. Ms. Liberto - Blanck stated that the
Chamber would like to put something together showing all leasable areas available.
Bike and Pedestrian - Planning Director Doreen Liberto Blanck briefed the Commission on a
meeting with Chairman Brandy, Grover City and the County regarding a joint project. She
stated that Grover City and the County are interested in filing a joint application for Prop 116
Fund.

There being no further business before the Commission, the meeting was adjourned at 9:30 p.m.
on motion by Commissioner Groves, seconded by Commissioner Moore, and unanimously
carried.
