JANUARY 21, 1992
The Arroyo Grande Planning Commission met in regular session with Chairman Brandy
presiding. Present are Commissioners Carr, Soto, Boggess, Souza, Moore, and Groves.
Current Planner Spierling is also in attendance.
PUBLIC HEARING - VARIANCE CASE NO. 91 -161, AMENDED CONDITIONAL USE
PERMIT CASE NO. 89-458, AT 789 VALLEY ROAD, APPLIED FOR BY CASA TIERRA
INVESTMENTS /ROSE VICTORIAN INN.
DUE TO A POSSIBLE CONFLICT OF INTEREST, COMMISSIONERS SOTO AND
SOUZA LEFT THE MEETING AND ARE NOW ABSENT.
Current _Planner Spierling reviewed the staff report, dated January 21, 1992. This project is
located near the City Limit line. Directly adjacent to the property is the Sunrise Terrace Mobile
Home park and a finger of land within San Luis Obispo County boundaries. This finger of land
is part of an approved tentative tract within the county. As a condition of approval for the
tentative tract map, the California Department of Forestry required a secondary access through
•the Rose' Victorian property. This access is to be at least 16 wide. To achieve this width,
the applicant had to re- configure the parking area. Staff Advisory Committee recommends that
the Planning Commission adopt a Negative Declaration, instruct the secretary to file a Notice
of Determination and adopt the Resolutions to approve the Variance and the Amended
Conditional Use Permit.
Upon being assured by the Planning Commission Secretary that the public hearing for Variance
Case No. 91 -161 and Amended Conditional Use Permit Case No. 89 -458 had been duly
published and property owners notified, Chairman Brandy declared the hearing open.
Terry Orton, Project Representative, Westland Engineering Co. stated they have been working
with CDF on the project.
Hearing no further comments from the audience, Chairman Brandy declared the hearing closed.
After further discussion condition of approval 7a was added as follows: The applicants may,
at their discretion, eliminate one (1) parking space in the lot fronting Valley Road, with the
intent to save the lemon trees. The following actions were taken:

PUBLIC HEARING - SIGN PERMIT CASE NO 91 -103, 124 S. HALCYON ROAD,
RICHARD RAMIREZ.
Current Planner Spierling reviewed staff report, dated January 21, 1992. Mr. Spierling advised
that the Architectural Advisory Committee recommended approval with some modifications
which have been included in the resolution as conditions of approval.
Upon being assured by the Planning Commission Secretary that public hearing for Sign Permit
Case No. 91 -103 had been duly published and property owners notified, Chairman Brandy
declared the hearing open.
Hadley Davis, representative, spoke in favor of the proposed signage.
Hearing no further comments from the audience, Chairman Brandy declared the hearing closed
and, after a brief discussion the following action was taken:

PUBLIC HEARING - VARIANCE CASE NO. 91 -160, 100 BARNETT STREET, GRAND
CENTRAL STATION, TIME EXTENSION FOR CONDITIONAL USE PERMIT CASE
NO. 89 -452.
Current Planner Spierling reviewed staff dated, January 21, 1992. The Staff Advisory
Committee recommends that the Planning Commission adopt the resolution readopting the
negative declaration for the project, instructing the Secretary to file a Notice of Determination
and approving Variance Case No. 91 -160. It is then recommended that a one year time
extension for Conditional Use Permit Case No. 89 -452 be approved by minute motion.
Upon being assured by the Planning Commission Secretary that public hearing for Variance Case
No. 91 -160 had been duly published and property owners notified, Chairman Brandy declared
the hearing open.

A minute motion for a one year time extension for Conditional Use Permit Case No. 89 -452 was
unanimously carried.
PUBLIC HEARING - APPEAL OF PLANNING DIRECTOR DETERMINATION OF
EXPIRATION STATUS FOR CONDITIONAL USE PERMIT CASE NO. 89 -456, 150 W.
BRANCH STREET, DOLORES DANA /PAUL RALPH.
Current Planner Spierling reviewed staff report dated, January 21, 1992, and stated the
following: Conditional Use Permit (CUP) Case No. 89 -456 was approved by the Planning
Commission on November 7, 1989. This CUP allowed the applicants, Dolores Dana and Paul
J. Ralph, to utilize off -site parking for their proposed commercial building. This commercial
building was proposed on the corner of Branch and Wesley Streets, adjacent to the Guidetti
Square project. The proposed commercial building would share parking, landscaping and design
elements with the Guidetti project.
Section 9- 4.3105 of the zoning ordinance in effect when the project was approved stated that:
"Any use permit or variance granted in accordance with the terms of this chapter
shall be null and void if not used within one year after the date of the approval
thereof or within any shorter or longer period of time if so designated by the
Commission or Council."
Since the Commission and Council did not specify a time period, the application was valid for
one year from the approval date.
On September 18, 1990 the Planning Commission approved a revision to CUP No. 89 -456.
This approval started a new one year time period.
Upon being assured by the Planning Commission Secretary that public hearing for Appeal of
Planning Director Determination of expiration status for Conditional Use Permit Case No. 89-
456 had been duly published and property owners notified, Chairman Brandy declared the
hearing open.
Kem Weber, Representative, stated that the appeal should be upheld due to the confusion with
the dates and so forth.
John Kuden, Representative for Guidetti Square and Dave Dana both spoke in favor of upholding
the appeal.

Hearing no further comments from the audience, Chairman Brandy declared the hearing closed
and, after further discussion the following action was taken:
On motion by Commissioner Carr to uphold the appeal due to the very unusual circumstances,
seconded by Commissioner Soto, and on the following roll call vote, to wit:

NON - PUBLIC HEARING - TENTATIVE TRACT 1769, REVIEW OF CONDITION OF
APPROVAL NO. 24b. - BASIN SCREENING, 1400 FARROLL AVENUE, HERB
PHILLIPS
DUE TO A POSSIBLE CONFLICT OF INTEREST, COMMISSIONERS SOTO AND
SOUZA LEFT THE MEETING AND ARE NOW ABSENT.
Current Planner Spierling reviewed the staff report, dated January 21, 1992. Mr. Spierling
advised that the Architectural Advisory Committee recommends that the Planning Commission
approve the screening plan for the basins, by minute motion, with the following conditions of
approval.
1. The fence between lot 16 and the easterly drainage basin shall be of the type with slump
stone pillars (type A).
2. The AAC recommends that the solid wood fence (type B) alternate finished sides at every
post (a "good- neighbor fence ").
On motion by Commissioner Carr, seconded Commissioner Groves and unanimously carried.
COMMISSIONERS SOTO AND SOUZA RETURNED TO THE MEETING AND ARE
NOW PRESENT.
NON - PUBLIC HEARING - CITY OF ARROYO GRANDE, FLAG POLE
INTERPRETATION, INTERPRETATION OF DEVELOPMENT CODE REGARDING
INSTALLATION OF FLAG POLES.

After the Commissioners discussed maximum height, set backs, building permit, number of flags
and so forth, the following action was taken:
RESOLUTION NO. 92 -1365
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARROYO GRANDE PROVIDING AN
INTERPRETATION FOR FLAG POLES IN RESIDENTIAL
ZONES
On motion by Commissioner Carr, that flag poles not be regulated by the Development
Code, seconded by Commissioner Boggess, and by the following roll call vote to wit:
AYES: Commissioners Carr, Moore, Souza, Boggess and Groves
NOES: Chairman Brandy
ABSTAIN: Commissioner Soto
the foregoing Resolution was adopted this 21st day of January 1992.

PLANNING DIRECTOR /PLANNING COMMISSION ITEMS
Commissioner Soto called attention to. Doreen's letter as Past President in the League of
California Cities Newsletter and the outstanding job she did as President.
ADJOURNMENT
There being no further business before the Commission, on motion by Commissioner
Souza seconded by Commissioner Moore and unanimously carried, the meeting was adjourned
at 10:00 P.M. to Joint Meeting with Parks and Recreation Commission February 4, 1992.
