Arroyo Grande Planning Commission
June 18, 1991
The Arroyo Grande Planning Commission met in regular session with Chairman Carr
presiding. Present are Commissioners Souza, Gallagher, Moore, Brandy and Soto.
Commissioner Boggess is absent. Current Planner Spierling is also in attendance.
CONTINUED'PUBLIC HEARING - GENERAL PLAN AMENDMENT (GPA) 90 -1 AND
PLANNED DEVELOPMENT (PD) REZONE /DEVELOPMENT PLAN NO. 90 -220,
WILMA PACIFIC.
Chairman Carr announced that a written request has been submitted by the applicant
requesting that this item be continued to the meeting of July 2, 1991. On motion by
Commissioner Gallagher, seconded by Commissioner Soto, and unanimously carried, the Wilma
Pacific application was continued to the Planning Commission meeting of July 2, 1991.
PUBLIC HEARING - VARIANCE CASE NO. 91 -158 AND VIEWSHED REVIEW CASE
90 -26, REQUEST VARIANCE FROM PARKING REQUIREMENTS FOR EXPANSION
OF SINGLE FAMILY RESIDENCE, 240 W. BRANCH STREET (RICK AND CINDY
COLLINS) .
Current Planner Spierling reviewed the staff report dated June 18, 1991. He pointed
out that a letter was received from Mr. Donald Levins, dated March 24, 1991, stating his
objections to the lack of off - street parking. Another letter was received from Wilda Theroux,
dated March 29, 1991, stating she has no objections to the requested variance.
Upon being assured by the Planning Commission Secretary that public hearing for
Variance Case No. 91 -158 had been duly published and property owners notified, Chairman
Carr declared the hearing open.
Mr. Collins, applicant for the variance, commented with regard to Public Works
Condition #6, stating he would prefer posting a bond in lieu of cash for the installation of curb,
gutter and sidewalk if that would be possible.
Hearing no further comments for or against the requested variance, Chairman Carr
declared the hearing closed.
After discussion of Mr. Collins' request, the Commission modified Public Works
Condition #6 by adding the following sentence: "If not otherwise prohibited, the applicant may
post a bond in lieu of the cash deposit ". After a brief discussion, the following action was
taken:

NEGATIVE DECLARATION.
On motion by Commissioner Gallagher, seconded by Commissioner Brandy, and by the
following roll call vote, to wit:
AYES: Commissioners Souza, Gallagher, Moore, Brandy and Chairman Carr
NOES: Commissioner Soto
ABSENT: Commissioner Boggess
the foregoing Resolution was passed and adopted this 18th day of June 1991.

REQUEST FOR TIME EXTENSION - CONDITIONAL USE PERMIT CASE NO. 88-437,
207 PILGRIM WAY. COASTAL CHRISTIAN SCHOOL
Current Planner Scott Spierling reviewed the staff report dated June 18, 1991. He
advised that the Staff Advisory Committee reviewed the proposed time extension. At that
meeting, the Building and Fire Departments indicated that the applicants had not yet fulfilled all
of the conditions of Architectural Review Case No. 86 -372, and thus had not met the conditions
of approval of the conditional use permit. Therefore, the Staff Advisory Committee could not
recommend approval of the time extension. It is suggested that this item be continued to allow
the applicant more time to complete the required conditions.
During discussion, the Commision expressed concern over the fact that stairways have
been constructed and the school has been allowed to begin operations without the second floor
of the church addition being completed. The Commission also expressed concern with the
second floor addition because of the lack of a fire alarm and sprinkler system.
After further discussion, on motion by Commissioner Soto, seconded by Commissioner
Gallagher, and unanimously carried, the request for extension was continued to the Planning
Commission meeting of August 6, 1991, and staff was directed to contact the Department of Fire
and Building and express the Commission's concerns regarding these safety issues.
APPEAL OF PLANNING DEPARTMENT'S DETERMINATION THAT A SUPPLEMENT
TO THE OAK PARK ACRES EIR IS REQUIRED. CONDITIONAL USE PERMIT CASE
NO. 90 -482. JAMES WAY AND OAK PARK BOULEVARD (JAMES HUNT).
Mr. Spierling reviewed the staff report dated June 18, 1991. He advised that staff
reviewed the applications in accordance with CEQA and determined that the proposed project
will have a potential significant effect on the environment in the areas of traffic and the
availability of resources for domestic water demand, and that a Supplement to the Oak Park
Acres EIR would be required to address these issues.
He described the project site, stating it is one of four parcels located at the corner of James
Way and Oak Park Boulevard. The four parcels are being developed under a conceptual master plan
which will eventually result in development of 39,160 square feet of professional offices and a health
club.
Mr. Spierling advised that the applicant was notified of the requirement for an SEIR on
January 11, 1991. The applicant did not appeal that decision so staff prepared a Notice of
Preparation (NOP) to be sent to the State Clearing House and other affected agencies. Also, staff
prepared a request for proposals that was sent to several qualified consulting firms. Bids were
received from three consulting firms, but prior to agreeing on a firm to prepare the SEIR, the City
received a response to the NOP from the Department of Fish and Game indicating that a study should
be prepared to investigate the effects of this development on the adjacent habitat and wildlife. After
discussing these comments with the Department of Fish and Game and the applicant, the City
required the scope of the SEIR to be expanded to include a biota study. The applicant is appealing
this decision.
The applicant's appeal states that a biota study was done as part of the project (tract 604) EIR
and that development of this project is in compliance with the planned development of Oak Park
Acres. Staff has reviewed the project EIR and found that while the conditions have changed
surrounding the project, the issues raised by the Department of Fish and Game appear to be addressed
in the document.
Mr. Spierling advised the Commission of the options available to them. He stated they could
either 1) by minute motion, deny the appeal of the Planning Director's environmental determination
to require a Supplement to the Oak Park Acres EIR which includes a biota study; or 2) by minute
motion, approve the appeal of the Planning Director's environmental determination to require a
Supplement to the Oak Park Acres EIR which includes a biota study with the provision that the
wildlife and vegetation sections of the project EIR be included in the SEIR.

After discussion, on motion by Commissioner Soto, seconded by Commisriorier Moore, and
unanimously carried, Mr. Hunt's appeal was upheld. A Supplemental EIR is recfc,ii!;ed on the traffic
and water availability study, with the provision that the the biota study on and vegetation
sections of the project Environmental Impact Report be included in the Supplemer 7 .1.: Environmental
Impact Report.

Commissioner Gallagher suggested that the Commission adopt a resolie6A-: cornmgnding
Planning Department staff that will be leaving in July. After a brief discuss :...::_ :C:9n motion by

instructed to draft a resolution for adoption at the next meeting.
