PC Minutes 1990-10-30ARROYO GRANDE SPECIAL PLANNING COMMISSION MEETING, OCTOBER 30, 1990 The Arroyo Grande Planning Commission met in regular session with Chairman Carr presiding. Present are Commissioners Moore, Gallagher, and Boggess. Absent are Commissioners Soto, Brandy and Souza. Also in attendance are Planning Director Doreen Liberto - Blanck, Long Range Planner Sandra Bierdzinski, and City Attorney Judy Skousen. APPROVAL OF MINUTES - On motion by Commissioner Boggess, seconded by Commissioner Gallagher, and unanimously carried, the minutes of the regular meeting of September 26, 1990, were approved as prepared. ORAL COMMUNICATIONS - Pedro Araya, 357 Tally Ho Road, stated his desire for a lot split in exchange for dedication of his property. Judy Skousen, City Attorney stated that Mr. Araya has been before the City Council and that she has reviewed it in detail along with the Public Works Director. Attorney Skousen advised that the Planning Commission could take no action on this matter. Glen Peters, 1587 El Camino Real, read his letter dated October 30, 1990, in Attachment "D" of the staff report of October 30, 1990. Jack Green, 670 S. Elm Street, started speaking during the general public comment period and was asked to hold his comments until the public hearing on the Development Code. PUBLIC HEARING - DRAFT DEVELOPMENT CODE (ZONING ORDINANCE /SUBDIVISION ORDINANCE). Long Range Planner, Sandra Bierdzinski reviewed the staff report of October 30, 1990. She advised that on May 22, 1990, the City of Arroyo Grande adopted a new General Plan and the Development Code now being reviewed consists of the Zoning Ordinance, Subdivision Ordinance, Parking and Sign Regulations, consolidated into one document. City staff is recommending that when the Development Code is adopted that a provision be included to allow any changes that are necessary be processed by City staff at no charge to applicants for the first year, due to this being such a massive document. Staff is recommending this Public Hearing be continued until November 20, 1990. Judy Skousen, City Attorney, advised the Planning Commissioners of the regulations in regards to conflict of interest. Upon being assured by the Commission Clerk that the public hearing for the Draft Development Code had been duly published and over 5,000 property owners notified, Chairman Carr declared the public hearing open. Mark Vasquez, Design Graphics, 345 Acero Place, stated one of his concerns was about the criteria for multifamily development not taking into account that most lots are 60 to 80 feet wide. Planning staff asked Mr. Vasquez whether he would be available to meet regarding his concerns. Ed Dorfman, 289 LaCresta Drive, spoke regarding the MF zone and his property on Farroll, also his concerns about plans for 22 lots of the Oakcrest Estates not yet built. Karl Hogan, 1255 Poplar Street, complained that this is the third time his property on Poplar Street has been rezoned in 34 years. Marie Cattoir, 195 Orchid Lane, expressed her concerns over the planning of new streets and in particular, Trinity Avenue in Tract 1513. She stated that property owners need to be notified early in the planning process of proposed projects. Staff indicated that the City's CEQA Guidelines now require early notification. Arroyo Grande Special Planning Commission Meeting Pa e October 30, 1990 Henry Byzinski, 1203 Grand Avenue, stated that he owns the old Exxon gas station at Grand Avenue and Elm Street. Mr. Byzinski requested that auto - related uses should be allowed subject to a Conditional Use Permit. There needs to be flexibility since all buyers interested in the property want auto related uses. Staff indicated that the existing zoning ordinance does not permit auto related uses along most of Grand Avenue. The Draft Development Code has not changed this. Scott Smith, People's Self Help Housing Corp., 1411 Marsh Street, Suite 103, San Luis Obispo, asked for confirmation that the SR zone only allows senior uses. Can handicapped persons that are not seniors be included in the definition of senior citizen? Financing for their projects requires allowing 10% handicapped persons. Parking requirements of 0.5 to 0.6 spaces per unit have been adequate in past projects he has been involved in. The multiple family and SR setback requirements may be too restrictive. Coker Ellsworth, 129 Bridge Street, stated he owns the property (16 acres) at Branch Mill Road and Cherry Avenue. When he bought the property it was zoned residential. The general plan designates it as agriculture. He would like to go on record opposing the new agriculture zoning. Grace Stilwell, 734 Myrtle Street, asked how the code was written in regards to her property. The permitted uses in the RR zone include orchards not exceeding 0.5 acres. There are already larger orchards in this zone. Robert Weber, 162 Fairview Drive, advised that his property is located two houses off Grand Avenue and is currently zoned C -2. When the property was purchased it was non - conforming residential, but Mr. Weber felt the commercial zoning would be valuable in the long run. He submitted a letter to the Commission. Katcho Achadjian, 222 Grand Avenue, stated his concern about his property at 414, 418 and 422 Grand (near McDonald's). He would like the property to be zoned highway commercial. Regarding his property at 222 Grand Avenue, he is worried about the non - conforming status. Staff indicated that the property located at 414, 418 and 422 Grand Avenue has been changed to highway commercial. The use on the property located at 222 Grand Avenue is already non- conforming under the existing zoning ordinance. Jerren Jorgensen, M.D., 75 San Antonio, Avila Beach, stated objections to the setbacks in the office professional zone where office uses adjoins residential uses. Robert Strong, One Buena Vista, San Luis Obispo, voiced concerns with all uses in commercial districts requiring a Conditional Use Permit. He feels this is to restrictive and will require extensive staff time. Staff explained that not all uses would require a conditional use permit. Charles Doster, 1152 10th Street, Los Osos, (320 E. Branch Street, Last Chance Liquors), spoke in regards to window signs in the sign ordinance. Mr. Doster expressed several other concerns regarding signage. Charles Naziska, 653 Woodland Drive, spoke regarding Section 9- 10.070 on fences, walls, and hedges. Mr. Naziska feels this section does not address tall trees that form a row and block sunlight. Ron Stob, Alder House, 295 Alder Street, stated that setbacks for senior housing are too large, such as the 20 ft. side yard. He also objected to the parking requirements of 1 space per 3 beds. Melvin Johnson, Vagabond Mobile Home Park, 535 Traffic Way, stated he does not want the zoning changed, the age of the park (30 years) makes it unsuitable for mobilehome park designation. Jeff Peters, 1575 El Camino Real, questioned what state laws require all the regulations contained in the Development Code. Staff provided Mr. Peters with a copy of the Development Code Overview. 1 1 Arroyo Grande Special Planning Commission Meeting Page 3 October 30, 1990 The Planning Commission directed staff to respond to the comments in writing by the next public hearing on the Draft Development Code. Chairman Carr stated that the Public Hearing would be continued until November 20, 1990 at 7:00 P.M. ADJOURNMENT There being no further business before the Commission, on motion by Commissioner Moore, seconded by Commissioner Gallagher, and unanimously carried the meeting was adjourned at 10:10 P.M.
