PC Minutes 1990-06-05Arroyo Grande Planning Commission June 5, 1990 The Arroyo Grande Planning Commission met in Regular Session with Vice Chairman Flores presiding. Present are Commissioners Soto, Moore, and Brandy. Absent are Commissioner Gallagher and Chairman Carr. One vacancy exists on the Commission. Director of Planning Doreen Liberto - Blanck, Current Planner Scott Spierling, and City - Attorney Vickie Finucane are .also in attendance. PUBLIC HEARING - VARIANCE CASE NO. 90 -149, SIGN PERMIT CASE NO. 89 -96, VARIANCE FROM SIGN ORDINANCE PROHIBITING ROOF MOUNTED. SIGNS, 618, 620 AND 624 GRAND AVENUE (TOYO PLAZA). Current Planner Spierling reviewed the staff report dated June 5, 1990. He noted that the application-was reviewed by the Staff Advisory Committee and they recommend that the Planning Commission deny the variance and the Planned Sign Program based on the findings. for denial as- listed in the- staff report. Upon being assured by the Planning Commission Clerk that public hearing for Variance Case No. 90 -149 and Sign. Permit Case No. 89 -96 had been duly published and property owners notified,- Vice Chairman Flores declared the hearing open. Wayne Millheim, representing the applicant stated it is his opinion that the proposed location is the most effective and.safest place to put the signs. Putting the signs below. the -eaves would not require •a variance and that is not the owner's will. Putting-the- signs -at the.bottam of the eaves would place them too low- for adequate - visibility, -.and also, the .signs-might be -too-low to be safe. Hearing no further - comments for or against the project,-Vice Chairman Flores declared the hearing closed. Af •ter a brief discussion it was .agreed .that the•variance.could be approved because the granting of the deviation is compatible with the objectives, policies and uses specified in the general plan, and the request conforms to the low profile rural nature of the community. After further discussion, the Planning Commission found that the proposed signs are not - visually :compatible - with ., the - buildings- they identify. The applicant was requested to. redesign the signs- and, on motion by Commissioner Soto, seconded by Commissioner- Moore, and unanimously , carried, Sign Permit Case No. 89 -96 was continued- to the first Planning Commission - meeting in•July. She indicated that, in the past, the Planning Commission expressed interest in a City Architectural- Advisory Committee_to- assist - -in - .reviewing architectural and sign applications. The primary.function ; of the- committee is to make recommendations to the Planning Commission, City Council and Planning Director regarding projects undergoing,the architectural and sign review process. PUBLIC HEARING - TENTATIVE TRACT NO. 983 - 139, 141, 143, AND 145 TALLYHO ROAD, RESUBDIVISION OF FOUR (4) - EXISTING PARCELS INTO SIX (6) PARCELS (L. C. LA VINE.) Current Planner Spierling reviewed the staff report dated June 5, 1990. He noted that since the latest revisions to the tentative tract map were not completed until Friday (June 1st), most City departments have not been able to revise their conditions of approval for the revised map. Therefore, -staff is unable to present conditions of approval with this report. He stated that if the Planning Commission feels uncomfortable recommending approval of this project to the City Council without seeing the conditions for approval, staff could return at the next Planning Commission meeting with those conditions. Upon being assured by the Planning Commission Clerk that public hearing for Tentative Tract Map No. 983 had been duly published and property owners notified, Vice Chairman Flores declared the - hearing open. Jim McGillis, San Luis Engineering, representing the applicant, reviewed the various concerns mentioned in the Staff Report. Hearing no further comments for or against the project, Vice Chairman Flores declared the hearing closed. After a brief discussion, on motion by Commissioner Moore, seconded by Commissioner Soto, and unanimously carried, Tentative Tract No. 983 was continued to the Planning Commission meeting of June 19, 1990, and staff was requested to return with conditions of approval. PUBLIC HEARING - PARCEL, MAP CASE NO. 89 -488, 345 SOUTH HALCYON ROAD, (ARROYO GRANDE HOSPITAL), MERGE FOUR (4) TATS INTO TWO (2) LOTS IN THE PROFESSIONAL COMMERCIAL ZONE (AMERICAN MEDICAL INTERNATIONAL.) Current Planner Spierling reviewed the staff report dated June 5, 1990 recommending continuance to the Planning Commission meeting of July 3, 1990. He explained that this project was originally advertised for public hearing even though all of the environmental work had not been completed. This action was necessary because of the time limits for processing projects under the Subdivision Map Act. After the project was advertised, the applicant submitted a waiver of the time limits under the Subdivision Map Act and, therefore, the project could be continued. Mr. Spierling advised that on May 23, 1990, staff received an archaeological report on the subject property. This was the last environmental document needed prior to advertising a draft negative declaration. State Law requires that a negative declaration be advertised 21 days before a public hearing on a project. Working within these guidelines, the soonest this project could come back before the Planning Commission is July 3, 1990. After discussion, Parcel Map Case No. 89 -488 was continued to the Planning Commission meeting of July 3, 1990. ARCHITECTURAL REVIEW CASE NO. 90 -447, 221 E. BRANCH STREET (THE WHITE HOUSE) - ARC ITECIURAL REVIEW OF A RETAINING WALL, AND PROJECT SITE DEVELOPMENT PLAN (MARK GODEREY. ) Director of Planning Liberto - Blanck reviewed the staff report and Agreement, dated June 5, 1990. She stated that the Planning Commission heard the project on March 6, 1990 and continued the item requesting that the applicant investigate the extent to which relocation of the retaining wall would damage the roots of the redwood tree. Staff indicated that the Planning Commission could consider allowing the applicant to take access to the parking lot without widening the driveway subject to an agreement. She further stated that the Planning Department recommends approval.of the project with the findings listed in the staff report dated March 6, 1990, and subject to the conditions listed in - 2 - Arroyo Grande Planning Commission, 6 -5 -90 the staff report with modifications and /or deletions as follows: #2 - Modify to read "Development shall occur in substantial conformance with the information presented to the Planning Commission at the meeting of June - 5, 1990, and .the applicant shall enter into Agreement between Godfrey and-the-City-marked "Exhibit A ". #3 - Delete #5 - Delete #6 - Delete #7 - Delete #8 - Delete #9 - Delete #10 - Delete #12 - Delete - #13 - Delete #16 - The landscape plan shall be prepared by a licensed- landscape architect and submitted to the Director of Parks and Recreation for approval prior to issuance of a business license. #17 - Delete , 0 - #18 - Delete After considerable discussion, on motion by Commissioner Soto, seconded by Comnissioner:Moore, and unanimously carried, Architectural Review Case No. 90 -447 was approved subject to the conditions listed- in the - staff - report dated June 5, 1990 as modified. REVIEW - CONDITIONAL USE PERMIT NO. 89 -459 - COASTAL CHRISTIAN SCHOOL/LANDMARK BAPTIST CHURCH, 1220 FARROLL AVENUE, PRIVATE ELEMENTARY SCHOOL (K -6) Current Planner Spierling reviewed the staff report dated June 5, 1990. He stated that on August 22, 1989 the City Council. approved a conditional use permit for the relocation of the Coastal Christian School to 1220- Farroll Avenue. One of the conditions of- approval required that the-use permit be- reviewed the first Planning Commission in June 1990 to determine whether there are any public or safety concerns due to the operation of the school. Mr. Spierling reported that no complaints have been filed with the Planning Department. Also, the Building and Fire Department, Police Department and Public Works Department have not noted any public or safety concerns related to the school's operations. After a brief discussion, on motion by Commissioner Soto, seconded by Commissioner Brandy, and unanimously carried, Conditional Use Permit Case No. 89- 459 was reviewed and no public or safety concerns were noted. The applicant was instructed to return next June for another annual review. REQUEST FOR TIME EXTENSION - USE PERMIT CASE NO. 88 -434 - RETAIL AND OFFICE SHOPPING CENTER ENTER DEVELOP ENE, MASON & BRANCH STREETS (BROOKSIDE - E.C. LOOMIS /JOEY SCOLARI. Current Planner Spierling reviewed the staff report dated June 5, 1990. He stated that staff is not aware of any changes which would affect the findings and conditions of approval of the conditional use permit, or would warrant denial of a one year time extension. It is staff's recommendation that the Planning Commission grant a one year extension. On motion by Commissioner Soto, seconded by Commissioner Moore, and unanimously carried, Conditional Use Permit Case No. 88 -434 was granted a one year extension subject to the previously approved conditions. PARCEL MAP CASE NO 88 BRANCH MILL ROAD, REQUEST FOR CIE YEAR EXTENSION OF PARCEL, MAP (MILTON AND MARY HAYES.) Current Planner Spierling reviewed the staff report dated June 5, 1990. He commented that staff is not aware of any changes which would affect the findings and conditions of approval of the lot split or would warrant denial of a one year time extension. He stated it is staff's recommendation that the Commission grant the requested extension. After a brief discussion, on motion by Commissioner Moore, seconded by Commissioner Brandy, and unanimously carried, a one year extension of was granted on Parcel Map Case No. 88 -453 subject to the previously approved conditions. PLANNING DIRECTOR /PLANNING COMMISSION ITEMS AND COPTS City Council Answered Agenda (Information) - It was pointed out that the City Council did adopt the Land Use, Housing, Open Space and Conservation Elements of the General Plan on May 22, 1990. - 3 - 183 184 Arroyo Grande Planning Commission, 6 -5 -90 Viewshed Review Permit Case 90 -16, Addition of Second Story Family Roan and Garage, 1080 Maple Street (Andrew and Patricia Starkie) - Mr. Spierling reviewed the staff report dated June 5, 1990. He advised that a Notice of Intent to Construct was sent to property owners within 150 feet of the project on May 1, 1990, and no comments were received on this proposal. There being no discussion, Viewshed Review Permit was approved with the findings listed in the Staff Report. Attendance at Land Use Law Workshop on June 15, 1990 - Commissioners Moore, Brandy, Soto and Flores indicated they are planning to attend the Land Use Law Workshop on June 15th. Interim Urgency Ordinance Suspending Submittal of Parcel Maps, Subdivision Maps and 2nd Units for 45 Days (Information) - Planning Director Liberto -Blanck advised that the City Council adopted an Interim Urgency Ordinance Suspending Submittal of Parcel Maps, Subdivision Maps and 2nd Units for 45 days, pending a water conservation policy. City Water Conservation Policy - Ms . Liberto-Blanck advised that a workshop is planned for June 19 to discuss a City water policy with the Planning Commission.
