PC Minutes 1990-01-162 Arroyo Grande Planning Commission Meeting January 16, 1990 The Arroyo Grande Planning Commission met in regular session with Chairman Carr presiding. Present are Commissioners. Flores, Moore, Gallagher, and Fischer. Absent are Commissioners Soto and Brandy. Also in attendance are Planning Director Liberto - Blanck and Current Planner Spierling. ORAL COMMUNICATIONS Jim McGillis, Surveyor, San Luis Engineering, 133 Bridge Street, expressed concerns regarding Coleen Kubel's house, 510 Ide Street (a flag lot), which has been red tagged by the Building Department. He stated the discovery of a road right -of -way through the flag lot requires that the house be set back an additional 10 feet. He further stated that a Variance application has been submitted and should be heard by the Planning Commission in March, and expressed concern about being able to continue construction and protecting the existing new wood framing to minimize damage. He requested this item be discussed at the end of tonights meeting. Planning Director Liberto - Blanck indicated that in order for this item to be placed on the agenda, the Planning Commission would have to make findings that the issue is "urgent ", and fourth- fifths of the Planning Commission would have to vote in favor of putting the item on the agenda. She also mentioned that the Building Department was under the Fire Chief, therefore, Mr. McGillis should contact Doug Hamp. CONTINUED PUBLIC HEARING - CONDITIONAL USE PERMIT CASE NO. 89 -455 /ARCHITECTURAL REVIEW CASE NO. 89 -434; SECOND RESIDENTIAL UNIT OVER GARAGE AT 290 RIDGEVIEW WAY (ED CHADWELL) Current Planner Spierling advised that the public hearing on this item has been continued by the Planning 'Commission on several occasions due to the holidays and the applicant being out of town. Mr. Spierling reviewed staff reports of October 17, 1989, and November 7, 1989. The Staff Advisory Committee recommends the Planning Commission adopt a resolution approving Conditional Use Permit Case No. 89 -455, subject to the findings and conditions of approval in the resolution and secondly, make a minute motion, approving Architectural Review Case No. 89 -434. Upon being assured by the Planning Commission Clerk that public hearing for Use Permit Case No. 89 -455 had been duly published and property owners notified, Chairman Carr declared the hearing open. Ed Chadwell, 290 Ridgeview Way, Applicant, spoke in favor of the Use Permit being granted. He commented he realizes that the process was done backwards, however, originally it was intended as an office and extra bedroom. Hearing no further comments for or against the project, Chairman Carr declared the hearing closed. Current Planner Spierling advised that under State Law, in order to deny a second residential unit findings must be made that public health, safety or welfare will be jeopardized. If the Planning Commission did deny this project, the kitchen would have to come out and Mr. Chadwell would have to apply for a variance because height limits were also exceeded. After a few brief questions, the following action was taken: RESOLUTION NO. 90 -1265 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING CONDITIONAL USE PERMIT CASE NO. 89 -455, APPLIED FOR BY ED CHADWELL, LOCATED AT 290 RIDGEVIEW WAY TO CONSTRUCT A SECOND RESIDENTIAL UNIT, ADOPTING A NEGATIVE DECLARATION AND INSTRUCTING THE SECRETARY TO FILE A NOTICE OF DETERMINATION On motion by Commissioner Flores, seconded by Commissioner Fischer and by the following roll call vote, to wit: AYES: Commissioners Flores, Moore, Fischer and Chairman Carr NOES: Commissioner Gallagher ABSENT: Commissioners Soto and Brandy the foregoing resolution was adopted this 16th day of January 1990. 1 Arroyo Grande Planning Commission, 1/16/90 On motion by Commissioner Flores, seconded by Chairman Carr, motion carried with one "no" vote, ARC 89 -434 was approved subject to the conditions and findings of the staff report dated January 16, 1990. PUBLIC HEARING - SIGN PERMIT CASE 89 -92, PLANNED SIGN PROGRAM AT 100 TRAFFIC WAY (VILLAGE CREEK PLAZA III /MID COAST LAND COMPANY) Current Planner Spierling stated this item was continued from the Planning Commission meeting of December 5, 1989. He reviewed the staff report dated December 5, 1989. Upon being assured by the Planning Commission Clerk that public hearing for Sign Permit Case No. 89-92 had been duly published and property owners notified, Chairman Carr declared the hearing open. Steve Wise, M Group Architects, representing the owner of the building and tenant, commented on the various reasons for the location and height of the sign. He stressed that they were not in the village and should not be required to conform to the requirements ofthe village. Mr. Wise stated the project is part of the Village Creek Plaza Center and should be similar to what is already there. Hearing no further comments for or against the Planned Sign Program, Chairman Carr declared the hearing closed Current Planner Spierling advised the that the Staff Advisory Committee reviewed this application and recommends adopting a resolution denying the Planned Sign Program, if approved, the findings must be made in the affirmative and the conditions of approval listed in the staff report of December 5, 1989, incorporated into the resolution. Chairman Carr and Commissioner Soto agreed that the sign was consistent with the sign ordinance and met City standards. After a brief discussion, the following action was taken: RESOLUTION NO. 90 -1266 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING A PLANNED SIGN PROGRAM, CASE NO. 89 -92, APPLIED FOR BY MID COAST LAND COMPANY (VILLAGE CREEK III), AT 100 TRAFFIC WAY, AND ADOPTING A NEGATIVE DECLARATION On motion by Commissioner Flores, seconded by Commissioner Gallagher, and by the following roll call vote, to wit: AYES: Commissioners Flores, Moore, Gallagher, and Chairman Carr NOES: Commissioner Fischer ABSENT: Commissioners Soto, and Brandy the foregoing resolution was adopted this 16th day of January 1990. Upon being assured by the Planning Commission Clerk that public hearing for Conditional Use Permit Case No. 89 -464 had been duly published and property owners notified, Chairman Carr declared the hearing open. Hearing no comments for or against the proposed Use Permit, Chairman Carr declared the hearing closed. He stated the Staff Advisory Committee recommends the Planning Commission adopt the draft resolution approving the project included with the agenda packets. Upon being assured by the Planning Commission Clerk that public hearing for Sign Permit Case No. 89 -95 had been duly published and property owners notified, Chairman Carr declared the hearing open. PUBLIC HEARING - PD REZONE CASE NO. 89- 218 /LOT LINE ADJUSTMENT CASE NO. 89 -480, ADJUST LOT LINES BETWEEN 4 LOTS; AND PD REZONE TO REFLECT SAID ADJUSTMENTS, LOTS 221 TO 224 IN THE ROYAL OAKS TRACT NO. 1390 (ASSESSORS'S PARCEL NO. 07- 017-08, 09, 10, AND 11) Current Planner Spierling reviewed the staff report of January 16, 1990. He advised that the Staff Advisory reviewed the proposal and their recommendation is that the Planning Commission recommend to the City Council, approval of the PD Rezone and Lot Line Adjustment. Upon being assured by the Planning Commission Clerk that public hearing for PD Rezone Case No. 89 -218 and Lot Line Adjustment Case No. 89 -91 had been duly published and property owners notified, Chairman Carr declared the hearing open. Keith Crowe, Engineering Development Associates, representing the applicant, spoke in favor of the PD Rezone and Lot Line Adjustment. There being no further comments for or against the proposed rezoning and lot line adjustment, Chairman Carr declared the public hearing closed. After a brief discussion, the following resolution was adopted recommending approval to the City Council. 3 Arroyo Grande Planning Commission, 1/16/90 RESOLUTION NO. 90 -1269 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMENDMENT TO ORDINANCE NO. 355 C.S. ROYAL OAKS ESTATES TO MODIFY EXHIBIT "A" On motion by Commissioner Fischer, seconded Commissioner Flores, and by the following roll call vote, to wit: AYES: Commissioners Flores, Moore, Gallagher, Fischer, and Chairman Carr NOES: None ABSENT: Commissioners Soto and Brandy The foregoing resolution was adopted this 16th day of January, 1990. RESOLUTION NO. 90 -1270 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF LOT LINE ADJUSTMENT CASE NO. 89 -480 BETWEEN LOTS 221, 222, 223, AND 224 IN TRACT 1390, APPLIED FOR BY DON MCHANEY AND BOB CANTRELL On motion by Commissioner Fischer, seconded Commissioner Flores, and by the following roll call vote, to wit: AYES: Commissioners Flores, Moore, Gallagher, Fischer, and Chairman Carr NOES: None ABSENT: Commissioners Soto and Brandy the foregoing resolution was adopted this 16th day of January 1990. PUBLIC HEARING - PARCEL MAP CASE NO. 89 -483, LOT SPLIT TO CREATE TWO LOTS AT 1131 FAIR OAKS AVENUE (KIRBY GORDON) Contract Planner John Ashbaugh reviewed the staff report dated January 16, 1990. He stated a letter, dated January 16, 1990, was received by the applicant indicating his agreement to continuance of this item. Current Planner Spierling pointed out the continuance is necessary because of the inadequacy of the traffic report. Mr. Ashbaugh reviewed several letters from surrounding neighbors opposing the proposed lot split. He stated that the proposal was reviewed by the Staff Advisory Committee, and their recommendation is for denial, however, if the Commission should decide to discuss the project, it should be continued to their March 6th meeting. Upon being assured by the Planning Commission Clerk that public hearing for Parcel map Case No. 89 -483 had been duly published and property owners notified, Chairman Carr declared the hearing open. Noel Higa, Engineering Development Associates, representing the applicant, spoke in favor of the proposal, stating that it does meet R -1 zoning requirements. He briefly addressed traffic and drainage concerns, stating that a soils report has been prepared. Jack Faught, 1125 Fair Oaks Avenue, stated he is concerned about maintenance of the 15 foot easement and the need for some type of agreement to maintain the easement. Mrs. Kellerman, 1129 Fair Oaks Avenue, stated she objects to the lot split. Scott Preston, 1127 -A Fair Oaks Avenue, and Melvin Caldwell, 565 Woodland Drive, were in favor of the proposed lot split. Kirby Gordon, applicant, spoke in favor of the proposed lot split. he stated he would be in favor of a maintenance agreement for the access easement. Chairman Carr stated he was not prepared to approve or deny this project tonight. He referred to the need for additional information on traffic, and the need to review the findings. he also expressed concern about the retaining wall and the amount of fill. After further discussion, on motion by Commissioner Moore, seconded by 4 126 Arroyo Grande Planning Commission, 1/16/90 Commissioner Flores, and carried with none "no" vote, this item was continued to the meeting of February 20, 1990. PLANNING DIRECTOR ITEM: Viewshed Review Permit Case No. 89-14, 1231 Newport Avenue, Second Story Addition to existing residence. Current Planner Spierling reviewed Staff Report dated January 16, 1990. He stated that no comments were received from the surrounding neighbors and, therefore, Viewshed Review Permit Case No. 89 -14 was approved subject to 10 day appeal period.
