January 20, 1987
The Arroyo Grande Planning Commission met in regular session with Chairman Carr
presiding. Present are Commissioners Olsen, Moore, Soto, Flores and Gerrish. Commissioner
Boggess is absent. Planning Director Eisner is also in attendance.
MINUTE APPROVAL
Hearing no additions or corrections, the minutes of the regular meeting of January 6,
1987 were approved on motion by Commissioner Gerrish, seconded by Commissioner Moore, and
unanimously carried.
ORAL,/WRPITEN COMMUNICATIONS
Commissioner Moore inquired about a truck being parked on West Branch Street in
front of the theaters with a sign on it reading_ "House of Crystal ". He noted that cars are
also being parked there. Mr. Eisner stated that the Public Works Department has indicated
they will be taking action to ,resolve this problem.
PUBLIC HEARING - USE PERMIT CASE NO. 86 -416, (RFSUBMITTAL) - REQUEST FOR
SHOOND RESIDENTIAL UNIT, 160 SPRUCE STREET IN THE "R -1" SINGLE FAMILY
RESIDENTIAL DISTRICT. (MYRNA DUNHAM).
Planning Director Eisner advised that the request is for a second residence (granny
flat) at 160 Spruce Street. The property is now occupied with a single family residence which
includes a one car enclosed garage. The existing house and its garage were legal at the time
of original construction and was built with necessary permits and approvals. Mr. Eisner
reviewed the provisions of the ordinance for a second residence in residential zones. He noted
that the applicant has submitted a plan for a 640 sq. ft. dwelling unit consisting of a living
room, dining room, kitchen, and one bedroom and one bathroom. A 10' x 14' patio is adjacent
to the proposed new dwelling and existing residence. The applicant proposes to complete the
building with materials and colors to match the existing dwelling.
Mr. Eisner advised that the proposal has been reviewed by the Staff Advisory
Committee and is found to comply with the provisions of California State Law and local
ordinances relating to "granny flats". The proposal is recommended for approval with the
following conditions:
1. That the patio shall not be covered, enclosed or otherwise
converted to additional living space for either the existing
house or the proposed second unit.
2. That the existing garage shall not be converted to living space
for the existing dwelling unit.
3. That the project comply with all grading and drainage requirements
of the City of Arroyo Grande.
4. All City and District fees applicable, including sewer hookup fees,
shall be paid prior to issuance of a building permit.
Chairman Carr questioned the intent of Condition No. 2, asking if the intent is that
neither garage shall be converted to living space? He recommended changing the language in
Condition No. 2 to read:
2. That neither garage shall be converted to living space.
Upon being assured by the Planning Commission Secretary that public hearing for Use
Permit Case No. 86 -416 had been duly published and property owners notified, Chairman Carr
declared the hearing open.
Hearing no comments for or against the proposed Use Permit, Chairman Carr declared
the hearing closed. After a brief discussion, the following action was taken:

PLANNING DIRECTOR EISNER ADVISED THAT ROB STRONG WOULD BE ACTING
PLANNING STAFF ON THE NEXT AGENDA ITEM. MR. EISNER LEFT THE MEETING AND
IS NOW ABSENT.
CONTINUATION - (PUBLIC HEARING CLOSED) - ROYAL OAKS ESTATES (FORMERLY
OAK KNOLLS). (OAK KNOLLS ASSOCIATES).
Mr. Strong briefly reviewed the sequence of events on this project up to this point.
He noted that at the third public hearing on January 6th, and at the - eleventh hour, the
Commission's quorum broke up and some Commissioners left the meeting, so the instructions were
to submit to the Cormnssion the final drafts for the proposed resolutions and revised map for
action. He stated the list of conditions of approval were drafted by staff and then revised by
the Commission during the three public hearings. Mr. Strong pointed out that the public hearing
was closed at the Commission's last meeting and the matter is before the Commission this evening
for a decision.
Mr. Strong reviewed that, essentially, Exhibit "A" is the resolution adopted on
December 2nd. Exhibit "B" was offered by staff as a resolution of the Planning . Commission
recommnending approval for the amendments to' Ordinances 221 and 317 which are the previous
"P -D" ordinances associated with this property, and referencing Exhibits "C ", "D" and "E".
Exhibit "C" is a resolution dealing with the tentative map and also proposes the Planning
Commission's approval of the revised tentative map of Tract 1390 which is, in essence, the
exhibit for the Planned Development as well as the proposed tentative map. Exhibit "D" is a
list of conditions of approval which was drafted by staff and then revised by the Commission
during its three major public hearings. Exhibit "E" is a draft ordinance which is offered as an
attachment to the two previous exhibits, essentially accompanying the Planning Commission's
recommendation regarding the tentative map and the Planned Development that would become an
ordinance of the City of Arroyo Grande, assuming that the City Council accepts the Planning
Commission's recommendation if approved.
Oon nissioner Gerrish referred to the new map and inquired as to the placement of the
two new lots that will replace the large parcels that were consolidated. Mr. Strong pointed out
on the map that the changes were Lots 183 and 185. Commissioner Gerrish suggested that the
approval refer to the Planned Development as shown on the revised tentative map, Tract Map
No. 1390, dated January 16, 1987. Mr. Strong stated that it was his intent, in the draft
ordinance, that it is the City Council that will adopt the ordinance, and concurrent with the
adoption of the ordinance, the Council will be making its final decision on the tentative map, so
if they make some additional revisions that do not require referral back to the Planning
Commission for changes, the final revised tentative map of Tract 1390 is the exhibit that should
be attached to the "P -D" ordinance. Commissioner - Gerrish suggested wording to the effect
that the planned development as shown on the revised map includes the conditions, so that the
conditions are part of the ordinance.
Chairman Carr pointed out that at the last meeting the Commission concluded the
meeting with the motion to approve the "P -D" amendment and that motion failed on a 3 to 1
vote and, in his opinion, it would be appropriate to reconsider that denial and then take action
on the tentative map.
Commissioner Soto referred to the wording of Exhibit "C" pointing out that the way it
is layed out, if the Commission votes in favor of it, we are indicating that we agree with the
statements 100 %. Mr. Strong stated that these are findings required by State law to approve a
tentative map. Commissioner Soto inquired about the West Branch Street cross section. Mr.
Strong stated that the precise design of that section still remains to be approved by the Public
Works Department. Commissioner Soto asked if the EIR Addendum is going to go back and be
updated to reflect the existing school site as it shows on the revised map. He - commented that
his concern was the original EIR addendum addressed the school site as 10 acres and at that
time he felt the site was undersized. The revised map shows the school site as 14.47 acres and,
in his opinion, may be more appropriate. Commissioner Soto stated he was concerned about the
intersection of Halcyon Road and Highway 101, the cross section of West Branch Street as
being insufficient, and the drainage going down to Halcyon Road. Chairman Carr stated he
doesn't feel these are issues the Coriinission can readily resolve. Chairman Carr expressed
concern regarding the preservation of the oak trees, stating his feelings that this matter needs
to be addressed in some way. Commissioner Gerrish stated he agrees with Chairman Carr on the
tree preservation issue, however, the Council has previously stated what their position is.
After further discussion, the following action was taken:

On motion by Commissioner Gerrish, seconded by Commissioner Flores, and by the
following roll call vote, to wit:
AY1: Commissioners Soto, Flores, Gerrish and Chairman Carr
NOES: Com issioners Olsen and Moore
ABSENT: Commissioner Boggess
the foregoing Resolution was adopted this 20th day of January 1987.
On motion by Commissioner Gerrish, seconded by Commissioner Flores, and by the
following roll call vote, to wit:

NOES: Commissioners Soto, Moore and Olsen
ABSENT: Commissioner Boggess
the foregoing Resolution was lost due to a tie vote on this 20th day of January 1987.
Mr. Strong conmented that this concludes the actions required by the Commission. The
matter will now progress on to the City Council without any further action by the applicants.
Chairman Carr requested that the Commission be provided a final copy of the exhibits
that go to the City Council reflecting the changes made during tonight's meeting.
Chairman Carr expressed his appreciation to the applicants, for their presentation and
patience, and to Mr. Rob Strong for all of his dilligent and professional effort he has put into
this project.
ADJOURNMENT
There being no further business before the Commission, the meeting was adjourned by
the Chairman at 8:50 P.M.
