PC Minutes 1986-02-04ARROYO GRANDE PLANNING COMMISSION February 4, 1986 The Arroyo Grande Planning Commission met in regular session with Chairman Gerrish presiding. Present are Commissioners Corr, Moore, Olsen, Soto, .Boggess and Flores. Planning Director Eisner is also in attendance." MINUTE APPROVAL Hearing no corrections or additions, the minutes of the regular meeting of January 7, 1986 were approved by the Chairman as prepared. CONTINUATION - ARCHITECTURAL REVIEW CASE NO. 86 -355, REPLACE EXISTING SIGN, 100 TRAFFIC WAY. (SKILLEY'S CAMPER SALES). After a brief discussion, it was the Commission's feeling that they did not have enough information to review this application. Planning Director Eisner advised he would get together with the applicant and obtain additional information for the Commission's review. The matter was continued to the next meeting of February • 21, 1986. CONTINUATION - ARCIiITECI'URAL REVIEW CASE NO. 85 -352, OFFICE AND WAREHOUSE ADDITION, 1052 GRAND AVENUE. (BLANKENBt)RG BROTHERS INVESTMENTS). Planning Director Eisner reviewed that this matter was on the Cotmission's agenda two weeks ago, however, because there were some problem with the parking lot, the applicants were directed to prepare a revised parking lot design and submit it for review and approval of the Planning Cbm nission. Mr. Eisner briefly reviewed the revision to the parking lot design, pointing out that the property is not one parcel as it appears; each of the existing buildings on the property is shown as a separate identifiable parcel. Some of the buildings have no parking associated with them. There is a large lot that contains the parking and the existing newspaper building, which is both office space and some warehousing. The proposal is for a building on the north side, or the Linda Drive side, of the property. He advised when the plan was submitted, it was short some parking spaces for the addition in accordance with the provisions of the existing parking requirements. The existing ordinance stipulates 1 space for every 200 sq. ft. of floor area for office use, and 1 space for every 800 sq. ft. of warehouse and storage area. Mr. Eisner stated that the parking has been redesigned since the last meeting. The parking that was shown along Linda Drive has had the angle changed from 60 degrees to 45 degrees in order to accomplish the landscaping along Linda Drive and provide for an 18 ft. wide driveway and a 2 ft. landscaped area along the north side of the building. Even with the revised plan, they were still short approximately' 3 spaces, so the designers took the existing 45 degree parking directly in front of the building on the south side and changed that to standard 90' degree parking, with a 24 ft. `drive isle. By doing' that, they were able to pick up the additional 3 space. In terns of the new addition, they have technically met the parking requirements for the addition. However, there is an issue that the Staff Advisory Committee and the City Manager's office wants the Planning Commission to be aware of. In taking the rough dimensions of all of the buildings on the property, we estimate that the overall project is approximately 22 spaces short of what we would be getting if this was an entire parcel. Mr. Eisner pointed out the fact . that these buildings were all built at separate times; they are individual identifiable parcels, and when you add up all of the parking, the fact is it is short of parking now and with the addition it is going to continue to be short of parking. Mr. Eisner noted that one of the things the applicant has done is reduce the amount of floor space on the second floor and increase the amount of space being used for storage and archives, which reduces the impact of the building somewhat. The figures now, overall, indicate they are probably still between 7 and 8 spaces short for the entire project. He advised it is up to the Commission as to how they want to proceed with this. With regard to the list of recommended conditions, Mr. Eisner stated he would like to modify the requirement stating that the lot line that runs between the addition of the existing building be removed. He suggested that the Commission consider a Reversion to Acreage, which is a process that removes all of the existing internal property lines from the parcel so as to create one large parcel which would preclude any of these buildings . ever being sold off separately without associated parking. Commissioner Soto commented that by taking out the 14 spaces and adding 23, there is still a net loss overall; the 14 spaces have nothing to do with the new site, but deleting them leaves a shortage of parking spaces. Commissioner Moore stated, in his opinion, the Commission does not have enough information to make a decision. Conrnissioner Flores suggested that because the parking is such a critical element to the plan, that the entire entity be reviewed instead of just the addition. Planning Director Eisner advised the application is for a use permit to allow the re- 'establishment of a' beer and wine license' (off -sale) at 398 -F Sunrise Terrace... He stated that the market has been in business approximately since the development of Sunrise Terrace Mobilehome .Park, and the owners are in the process of re-establishing. the market and scaling it down to a level more in' keeping with the purchasing- ; power, of. the neighborhood.: 'He. pointed out that the zoning on the property. is ; "O-N" Neighborhood Cbr ner'cial; the building is existing and everything is in place. Upon being 'assured by the Planning Director .that public hearing for Use Permit Case No. 86 -407 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Hearing no comments for or against the proposed use, Chairman Gerrish declared the hearing closed. After a brief discussion, the following action was taken: RESOLUTION NO. 86 -1075 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 86 -407, APPLIED FOR BY SUNRISE MARKET AT 398-F SUNRISE TERRACE. PUBLIC HEARING - USE PERMIT CASE NO. 86 -408, TO PERMIIT, MASSAGE A ND - STRESS REDUCTION THERAPIES AT KENNEDY NAUTILUS FITNESS CENTER, 126-A E. BRANCH STREET 1/1 THE "G -B-D" DISTRICT. (ROBIN DE. JONG/STRESS REDUCTION CENTER). Planning Director Eisner advised the .request is for 'a use permit to allow massage and stress reduction therapy at the Kennedy Nautilus Fitness Center at 126 -A E. Branch Street in the Village area. He reviewed that. the commission had previously considered Ms. De Jong's request for an interpretation that massage and stress reduction are consistent uses as a part of a full service exercise program. Mr.. Eisner stated the request has been reviewed by the Staff Advisory Corrinittee without comment. He noted that the facility . and use as. a recreation activity has been in operation for approximately 2 years, and off - street parking is available and will not be impacted by this use. He further noted that a separate investigation by the Police Department will be necessary prior to issuance of final approval Upon being assured by the Planning Director that public hearing Use Permit Case No. 86 -408 had been duly published and property owners notified, .Chairman Gerrish declared the hearing open. Robin De Jong; applicant, was present and briefly described the proposed use. In answer to Commissioner Boggess' question regarding acupuncture, Ms. De Jong stated they are not intending to do acupuncture at this facility. Hearing no further comments for or against the proposed Use .Permit, Chairman Gerrish declared the hearing closed. Commissioner Olsen commented she had talked to a representative of the Village Merchants Association and was advised they are opposed to the idea because of the size of the building; it would be crowded, and there may be other activities such as acupuncture, biofeedback, etc., 'included. Chairman Gerrish stated he doesn't see the use as being 'a particular problem in the Village, but. he would like to see a review in 6 months in case a problem comes up. PUBLIC HEARING - APPEAL OF WILBUR R. NEUBERT TO DENIAL OF HOME OCCUPATION PERMIT NO. 85 -486, TO OPERATE A CATALOG MAIL ORDER SERVICE OF AIRCRAFT SUPPLIES, 570 EASY STREET, IN THE "R-,S" RESIDENTIAL SUBURBAN DISTRICT. (WIL NEUBERT AIRCRAFT SUPPLIES). Planning Director Eisner advised that Mr. Neubert has appealed an administrative denial of an application for a Home Occupation Permit to operate a catalog mail order aircraft parts service out of his home at 570 Easy Street He stated that originally Mr. Neubert had applied for, and received, an administrative permit for this same business at 511 Via LaBarranca, which was issued in 1978, and ,Mr... Neubert-had been in business at -that location. since the time of the issuance of that permit. He moved from that location to 570 Easy Street in the recent past. Staff originally received a complaint first by telephone, followed by a written complaint signed by the neighbors to 570 Easy Street. Mr. Eisner stated that he made an on -site visit of the operation and, at that time, notified Mr. Neubert that it would be necessary to apply for a new Home Occupation Permit for that specific site. Mr. Neubert did so and, after review of the matter with the City Attorney, the staff, as an administrative function, denied the Home Occupation Permit. The reason for the denial was that the definition of Home Occupation and the criteria to be used did not seem to wholly fit together. Upon being assured by the Planning Director that public hearing for Home Occupation Permit No. 85 -486 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Wilbur R. Neubert, 570 Easy Street, spoke in favor of the Home Occupation Permit. He stated that he had operated this business out of his home on Via La Barranca for 6 years and 10 months without a complaint, with the neighbors within 50 ft. In the present loction the nearest neighbor is 500 yards away and people complained after a very short length of time. He stated it doesn't seem rational in any way that they could be causing that much disturbance because when they were in closer proximity to neighbors on Via La Barranca, they were not bothering anyone. Mr. Neubert advised he has applied for space for his business at the San Luis Obispo Airport and as soon as that space becomes available, he will move his business to that location. He is asking for a temporary Home Occupation Permit until this space becomes available, which is projected for October of 1987. F. J. Kirkpatrick, 737 Printz Road, stated the property owners in that area spent a lot of time setting up this zoning; it is very specific and is strictly a residential surburban area, and they did not want any businesses in there. He was concerned that if one business goes in, soon others will be wanting businesses in the area. Mrs. Neubert, 570 Easy Street, advised that the type of business does not require large semi trucks going in and out; the deliveries and pickups are done by United Parcel Service. Elmer Kirk, 735 Printz Road; and Carol Harrison, 783 Printz Road, stated they were opposed to the use of the property for business purposes. Upon hearing no further comments from the audience regarding Home Occupation Permit No. 85 -486, Chairman Gerrish declared the hearing closed. After general discussion by the Commission, on motion by Corm issioner Olsen, seconded by Commissioner Flores, and carried, a temporary Home Occupation Permit was granted for a period of six (6) month, renewable no more than twice, for a total period not to exceed eighteen (18) months. 245 246 Arroyo Grande Plarmitg CbIlITISSiOn, 2 -4-86 COMMUNICATIONS The Planning C omMission discussed the Home Occupation Permit section of the ordinance. Cbninissioner Olsen asked why she was not aware of all of the Home Occupation permit requests submitted to the Planning Director forT approval. Planning Director Eisner stated that Home Occupation Permits are an administrative function according to Article 9- 4.3000 of. the Zoning Ordinance. He pointed out that the criteria for a Home Occupation Permit is spelled out .in -the . code and that the test of any home occupation is that no one knows they are going on. Commissioner Olsen stated that she wanted to know what is going on in every home. After further discussion, on motion by Commissioner Soto, seconded by Commissioner Olsen, and unanimously carried, staff was directed to prepare a draft amendment to the Home Occupation section to clarify home occupation uses and to consider a requirenierit for Planning Commission approval ADJOURNMENT There being no further business before the C onTlission, the meeting was adjourned by the Chairman at 9:35 P.M. • Planning Director Chairman Page 4 1
