Present are Corrrnissioners Boggess, Olsen, Moore, Soto and Flores. C rraissioner Carr is absent. Planning Director Eisner is also in attendance. MINUTE APPROVAL . . Hearing no additions or .corrections, the riinutes of the regular greetings of November 19, 1985 and - December 3, 1985 were approved by the Gfiairr an as prepared. PUBLIC HEARIIIG - LOT SPLIT CASE . NO. 85;421 ; BELL STREET IN ' ice "R -1" SINGLE FAMILY RESIDENTIAL DISTRICT. (SAN LUIS ENGINEERENG, AGENTS FOR JEFFREY SALSER). Planning Director . Eisner advised the request is for a lot line adjustment at 114-116 Bell Street. The Zoning is R -1, Single Family Residential. The property is 50 ft. in ,vidth, with a depth of 124 ft.; in effect, the property corsists of two 25 ft. lots. He pointed out that in 1984 the Planning Commission approved a request for a Use Permit to :permit a second residence on the property, and it was at that time that the residence at 114 Bell Street was constructed. One of the conditions of the Use Permit was that no further division of the property would take place. Mr. Eisner stated that the request is not teehnically dividing the property any further, but is taking the lot line that runs down the middle and adjusts the line running across. With regard to the dimersiors, Mr. Eisner advised. that • the rear property line running between the two dwellings would be 5,5 ft., or a distance of 11 ft. between • the two buildings: • Upon being assured by =the Planning Secretary that public hearing for Lot Split. Case No. 85 -421 had been duly published and property owners notified, Chairman Gerrish opened the public hearing. • Jim • NicGilli.5, Surveyor for San Luis Engineering, representing the applicant, spoke in favor of the Lot - Split... He stated that nothing will be changed • by drawing ' a line between. the two buildings and, as far as long range, planning is concerned, the configuration. being offered is better than 'what is there now. He cog :rented by approving the requested lot split, the Commission will be providing a starter home for young people in the caraway. -Lloyd Brazil, 603 Cornwall, stated he owns property_ across the street identical to this property, and inquired. if he would be entitled to the same split. Chairman Gerrish explained the request is not really splitting the property, but realigning the lot. line. Marie .Cattoir; 195 Orchid Lane, spoke in favor of the request being granted, stating it seems like a very logical request. Hearing no further comments for or against the proposed lot split, Chairman Gerrish declared the hearing cicsed . - Coi. wissioner Olsen stated, for all practical purposes, the request could result in a lot split and, in her opinion, this might set a precedent that she would not be in favor of. Commissioner Flores stated he is also concerned that this would be setting a precedent. Chairman Gerrish cuff ented that there are two legal existing lots right now and the applicant r is not asking for any r re lots, and since the buildings are already there, he= doesn't see any problem with the request. Commissioner Moore stated the nature of the neighborhood could be changed by granting the, request and setting a precedent, and it would be going against the policy of the Council by increasing the density. He pointed out that the older house is setting in a hole • ai ut • 4 ft. deep and there is going to be sorre difficulty getting a drivewa into it. He noted that the area has a lot of 25 ft. lots just like this one. Corrassioner Boggess stated it seers the original intention in this case was to avoid further splitting and malting two tiny lots. After further discussion, Lot Split Case No. 85 -421 was denied on motion by Coandssioner Moore, seconded by Commissioner Soto, motion carried with one "no" vote. PUBLIC REARING - LOT SPLIT CASE NO. 85 -415, PROPERTY LOCA1ED ON HIGHWAY 227 BETWEEN PASEO STREET AND CORBETT CANYON ROAD, IN THE "RA-B3" RESIDENTIAL AGRICULTURAL DISTRICT. WAY, DT THE "RA -B2" RESIDENTIAL AGRICULTURAL DISTRICT. (W. A. AND S. J.WEITRAT). Planning Director Eisner advised the request is for a lot split to create 3 parcels from one large lot; current zoning on the property is "RA -B2 ". Minimum lot size is 20,000 sq. ft net. The proposed lot split would create one lot of 30,295 sq. ft. and one flag lot of 18,877 sq. ft. with a 24 ft. flag extending to Canyon Way; and a third lot of 20,000 sq. ft. He pointed out that the Qty Council's policy has been to discourage the creating of flag lots in the C:Ity, and the Planning Commission policy has been to require, there flag lots are necessary, that the body of the parcel (exclusive of the flag stern) contain the minimum square footage required by the zoning. Mr. Eisner stated that the map has been reviewed by the Staff Advisory Coi,mittee and should the Corrriission choose to approve the request, Staff Advisory Committee recommends that the 8 conditions listed in the staff report be included in the approval. Upon being assured by the Planning Secretary that public hearing for Lot Split Case No. 85 -419 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Bill Weitkamp, 251 James Way, applicant, spoke in favor of the lot split being approved. Mr. Weitkamp presented a map and briefly reviewed the history of the Canyon Way Improvement District. He advised that of the 25 lots in the District, 16 were flag lots. Judy Ca Tilley, 205 Canyon Way, stated they were in the original Assessment District and it was understood at that time that in order for the property owners to be able - td afford to participate in the District, flag lots would be necessary. She stated their house is on a flag lot and, in her opinion, flag lots do not detract from the neighborhood; that is the way the neighborhood is established right now. Larry Rohloff stated he was the assessment engineer for the District, and he could attest to what the property owners have said regarding flag lots. Sally Weitkamp, 251 James Way, and Marilyn Carfarchia, 241 James Way, spoke in favor of the lot split being approved. Hearing no feather comments for or against the proposed lot split, Chairman Gerrish declared the hearing closed. After discussion, on motion by Commissioner Moore, seconded by Commissioner Olsen, and unanimously carried, Lot Split Case No. 85 -419 was approved subject to the 8 conditions listed in the staff report, dated January . 7, 1986, with Condition No. 3 amended to read "Developer to employ an engineering firm and have assessment split forwarded to the aty". PUBLIC BLEARING - LOT SPLIT CASE NO. 85-418, 241 JAIlf WAY IN TEE "RA -B2" RESIDENTIAL AGRICULTURAL DISTRICT. (M. AND M. CARFARC,HIA), Planning Director Eisner advised this is a request similar to the Weitkamp lot split. He pointed out that all three lots are over 20,000 sq. ft. 'The request has been reviewed by the Staff Advisory Committee and is submitted for Commission review subject to the 8 conditions listed in the staff report, dated January 7, 1986, with Condition No. 3 amended to read "Developer to employ an engineering firm and have assessment split forwarded to the aty." Upon being assured by the Planning Secretary that public hearing for Lot Split Case No. 35-413 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Hearing no comments for or against the proposed lot split, Chairman Gerrish declared the hearing closed. After a brief discussion, Lot Split Case No. 85 -418 was approved on motion by Commissioner Soto, seconded by Commissioner Boggess, and unanimously carried, subject to the 8 conditions listed in the staff report dated January 7, 1986. PUBLIC HEARING - LOT SPLIT CASE NO. 85 -419, JAMES WAY, IN THE "RA -B2" RESIDENTIAL AGRICULTURAL DISTRICT. (-J. CARRIIITERS, AGENT FOR PAT WEBER, ETAL.) Planning Director Eisner advised that the subject property was before the Commission a few months ago with a request for a zone change and a parcel map for three lots. At that time the request was denied. The proposal before the Commission tonight divides the property into two parcels of 20,096 (net) sq. ft. each. Zoning on this parcel is "RA -B2" which requires a 20,000 sq, ft. minimum lot size. The proposed lots are consistent with the land pattern in the surrounding neighborhood. He noted that the matter has been reviewed by the Staff Advisory Committee and is submitted with a recommendation for approval subject to the 7 conditions listed in the staff report, dated January 7, 1986. Upon being assured by the Planning Commission Secretary that public hearing for Lot Split Case No. 85-419 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Jeffrey Carrithers, representing the applicant, spoke in favor of the lot split, commenting that the lot sizes conform to the requirements of the District. Hearing no further comments for or against the proposed lot split, Chairman Gerrish declared the hearing closed. After a brief dikcasion, Lot Split Case No. 85 -419 was approved subject to the 7 conditions listed in the staff report dated January 7, 1986, on motion by Commissioner Soto, seconded by Commissioner Moore, and unanimously carried. PUBLIC BEARING - USE PERMIT CASE NO. 84 -368, (RESUBr1ITTAL - ORIGINAL USE PERMIT EXPIRED) NEW CHURCH FACILITIES, NORTHEAST CORNER OF OAK PARX BOULEVARD AND JAMES WAY. (OAK PARX FOURSQUARE CHURCH). Planning Director Eisner advised that the request is for renewal of an expired Use Permit previously approved by the Planning Corrrnission and City Council. He pointed out that because the church was unable to exercise the permit within one year it is necessary for the Planning Corrrnission and Council to re -adopt the original use permit. He stated there have been some modifications to the plans and specifications as originally subratted and approved. Staff has reviewed the changes and recommends approval subject to the 5 conditions listed in the staff report dated January 7, 1986, in addition to the original conditions listed in the staff report dated May 15, 1984. Upon being assured by the Planning Commission Secretary that public hearing for Use Permit Case No. 84-368 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Richard Day, 206 Wildwood Lane, Associate Pastor of the Church, spoke in favor of the Use Permit being granted. He advised the original use permit expired due to an oversight on their part. Hearing no further comments for or against the proposed use permit, Chairman Gerrish declared the hearing closed. Commissioner Olsen expressed concern regarding traffic and inquired as to the status of the Oak Park Interchange. Planning Director Eisner stated, to the best of his knowledge, until something changes, it is assumed that all previous a°reements remain in effect.. Chairman Gerrish agreed that this is a problem but, in his opinion, there is nothing further the Commission can do about it. Connissioner Boggess stated he doesn't think a church generates the traffic that other businesses do. (BILL AWA.LTJCIARLES JEFFRIES). Planning Director Eisner advised the application is x for a tentative tract map and accefrpanying Conditional Use Permit for a 5 unit professional loffice condominium at 717 Grand Avenue; an :application for architectural review also accomcanes the condominium application. Mr,. Eisner briefly reviewed the application., noting that the proposal is to develop a } 2i After a brief discussion, the following action was taken: RESOLUTION NO. 86-107i: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF USE PERMIT CASE NO. 84 -368, APPLIED FOR BY OAK PARK FOURSQUARE CHURCH. I 1 Arroyo Grande Planning Corarission, 1 -7 -36 condominium building on a site 100 ft. wide and 125 ft. deer). The zoning-on the parcel is "H- S". The proposed building is 4800 sq. ft. and will require 24 parking spaces, which are being . provided. The architectural review includes a 6' x 10' pedestal sign which is - consistent with • the development standards of the City. Also the colors and materials proposed for the development are consistent with the commercial development standards of the City. Mr. Eisner advised that the three part application has been reviewed by the Staff Advisory Committee and the Architectural Review/Subdivision Review Coiii and is submitted for approval with the 11 conditions listed in the staff report, dated January 7, 1936. Upon being assured by the Planning Commission Secretary that public hearing for Use Permit Case No. 85 -404 and Tentative Tract Map No. 1378 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Larry Rohloff, engineer for the applicant, spoke in favor of the application being approved. DIM. Rohloff referred to Condition No. 4 of the staff report requiring "all parking spaces shall be 10' x 20' clear ". He pointed out that up to 30% of the parking can be compact spaces. The condition was amended to add the words "...except compact spaces ". With regard to Condition No. 11 relative to a sewer manhole on Grand Avenue, it was agreed to amend that condition to read: "Sewer plan shall be provided to the satisfaction of the Public Works Director, includin a sewer access on Grand Avenue if found to be required by the Public Works Director ". Hearing no further comments for or against the proposed Use Permit and 'Tract Map, Chairman _ Gerrish declared the he closed. Architectural Review Case No. 85 -347. Planning Director Eisner showed a colors and materials board to the Commission. He advised that the project has been reviewed by the Architectural Review Committee and is recommended for approval. After discussion, Architectural Review Case No. 35 -347 was approved on motion by Commissioner Boggess, seconded by Commissioner Soto, and unanimously carried. PUBLIC HEARING - ZONING MAP AMENDMENT TO INCORPORATE TEXT MODIFICATIGNS,, AND TO IMPLEMENT POLICM ADOPTED AS PART OF TBE . CITY'S GENERAL PLAN. 238 Arroyo Grande Planning Commission, 1-7-86 • Planning Director Eisner advised that the zoning map amendment is to incorporate - the text dealing with the commercial changes made by the Car mission and Council a few months ago. He pointed out that the draft text amendment approved by the Coninission modifies the "CG-N" zone by changing the title to "C-1"; adding a "C -2" zone which will create a General Commercial zoning category; and modifying the existing "H -S" zone by changing the .title to "C- 3" (Highway Service Comercial), and adjusts the development standards. Mr. Eisner stated it is now necessary for the Planning Comdssion to review the accompanying map so that both the text and map may be heard concurrently by the aty Council. He stated that the issue here is that the zoning does meet the consistency text of. the State planning law. Upon being assured by the Planning Corrmriission Secretary that public hearing for the proposed zoning map amendment had been duly published and posted, Chairman Gerrish declared the hearing open. There being no comments from the audience for or against the proposed amendment, Chairman Gerrish declared the hearing closed, and the following action was taken: RESOLUTION NO. 85 -1074 A RESOLUTION OF THE PLANNING COMISSION OF ME CITY OF ARROYO GRANDE RECOMMENDING 10 THE CITY COUNCIL ADOPTION OF ZONING MAP AMENDMENT TO INCORPORATE TEXT MODIFICATIONS, AND TO IMPLEMENT POLICIES ADOPTED AS PART 01? THE CITY'S GENERAL PLAN. ARCIIITEGIURAL REVIEW CASE NO. 85 -354 - SIGN PROPOSAL, Cry PLAZA SHOWING CEWIER, NORTITEAST CORNER OF NO. HALCYON ROAD AND GRAND AVENUE. (MURRAY SIGN CO.). Planning Director Eisner advised the request is for a sign program submitted by the Murray Sign Corporation, representing 7 -11 Stores, Inc. The sign program includes a - monument sign to be located on the Grand Avenue frontage; an entryway sign to be located on the Halcyon Road frontage; a similar sign to be located on Rena Street Frontage; and space allocations for signs to be attached to the facade of the building. Mr. Eisner advised that staff has reviewed the material and recommend that, if the Corrmrission chooses to approve the sign plan, the • approval be at a standards level subject to resubmission of modified drat, ings. He stated the applicant is requesting a sign on Grand Avenue 15' x 14', noting that staff has no problem with the length of the sign, but would recon r a sign no higher than 8 ft. He further stated that after reviewing the signs for Rena and Halcyon, staff would recondnend that no sign over 4' in overall height be approved. The sign proposal for building sio s is consistent with facia sign requirements. nairman Gerrish stated, in his opinion, three free standing signs are a lot for that property, and even an 8 ft. sign would be a problem with sight distance. He stated he would rather see a pole sign rather than a monument sign from a sight standpoint. Consrissioner Soto stated he feels a pole sign would be more appropriate than a monument sign. Commissioner .Flores stated he secs no problem with the sign with the exception of the height. He also su modifying the ordinances, both the Subdivision Ordinance and the Zoning Ordinance, to require that where we get into the development of some of the old narrow lots in the city, . that one of the conditions of approval would be reversion of the lot lines, in other words,. whenever We have a proposal that encompasses two or more lots, a standard condition should be that the lot lines disappear and it becomes one lot. Chairman Gerrish pointed out that ConTrissicner Soto is no longer able to serve on the Architectural Review Cenu,ittee because of his schedule. He commented that, the City Council having changed the Ordinance, gives the Architectural Review Con ittee essentially no power at nil. He requested the Commission consider eliminating that Corrnnittee and hearing everything at the Commission level. Chairman Gerrish requested that the proposal to eliminate the function of the Architectural Review Corrmittee be placed on the next agenda.
