PC Minutes 1985-08-061 1 ARROYO GRANDE PLANNING COMMISSION August 6, 1985 The Arroyo Grande Planning Commission met in regular session with Chairman Gerrish presiding. Present ,are Commissioners Carr, Fischer, Moore and Soto. Commissioners Olsen and Boggess are absent. Associate Planner Stonier is also in attendance. MINUTE APPROVAL Chairman Gerrish noted he was present at the meeting of July 2, 1985, and corrected the minutes to show he was in attendance. Hearing no further additions or corrections, the minutes of the meetings of July 2, 1985 and July 16, 1985 were approved by the .Chairman as corrected. PUBLIC HEARING - VARIANCE CASE -NO. 85 -101, REQUEST 10 EXCEED HEIGHT LIMIT REQUIREMENTS, 193 DEER TRAIL CIRCLE, OAK PARK AQU?S, IN THE "P-D" PLANNED DEVELOPMENT DISTRICT. (MICHAEL WEINTRAUB). Associate Planner Stonier briefly reviewed the staff report dated August 6, 1985. Upon being assured by Associate Planner Stonier that public hearing for Variance Case No. 85 -101 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Michael Weintraub, applicant, spoke in favor of the Variance being granted. Mr. Reuben Kvidt, Oak Park Acres, advised Mr. Weintraub that the requested height variance would be acceptable so long as he complies with all of the Qty's requirements. Hearing no further conments for or against the proposed Variance,. Chairman Gerrish declared the hearing closed. Commissioner Fischer comnented, in her opinion, cases where structures are built to maximum standards should be monitored more closely. It was the consensus of the Commission that structures should meet requirements at the foundation level and this type of problem should be resolved at an earlier level. On motion by Comrnssioner Moore, seconded by Commissioner Fischer, and unanimously carried, the Commission directed that a message be forwarded to the Qty Council stating that this Variance request was approved under protest, and the situation is a result of inconsistent policy for interpreting height limits and should be clarified, and requesting Council to examine and rectify the problem. After further discussion, the following action .was taken: RESOLUTION NO. 85 -1045 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A VARIANCE, CASE NO. 85 -101, APPLIED FOR BY MICHAEL WEINTRAUB. On motion by Commissioner seconded by Chairman Gerrish, and by the following roll call vote, to wit: the foregoing Resolution was adopted this 6th day of August 1985.
