The Arroyo Grande Planning Commission net in regular session with
Chairman Gerrish presiding. Present are Commissioners Carr, Moore, Moots,
Olsen and Soto. Commissioner Fischer is absent. Planning Director Eisner is
also in attendance.

Upon hearing no corrections or additions, the minutes of the regular .
meetings of July 3 and July 17, 1984 were approved as prepared on motion by
Commissioner Carr, seconded by Commissioner Moots, and unanimously carried.

Planning Director Eisner referred to the letter, dated August 1, 1984,
from Garing, Taylor and Associates, requesting the extension for filing the
final map for Tract No. 1009. Planning Director Eisner advised that the tract
is already built and the final map is ready to be recorded, however, because
of a technicality, the deadline cannot be met, and staff recommends granting a
one year extension. On motion by Commissioner Moots, seconded by Commissioner
Carr, and unanimously carried, the extension was granted on Tract 1009 for a
period of one year.

Planning Director Eisner advised that this matter is before the
Commission for a six month review of the Use Permit granted to Five Cities
Ambulance Service, located at 1503 El Camino Real. He noted that at the Staff
Advisory meeting last week, all of the departments were polled to see if there
were any complaints regarding the ambulance service, and it appears no
complaints have been received. He noted that a letter from H. Ray Sheppard,
dated July 5, 1984, was included in the Commissioner's packets. Mr. Sheppard
stated he would be out of town and requested that the review be delayed until
October 1, 1984.
Upon being assured by Planning Director Eisner that public hearing for
review of Use Permit Case No. 84 -362 had been duly published and property
owners notified, Chairman Gerrish declared the hearing open. Hearing no
corrinents for or against the use permit, Chairman Gerrish declared the hearing
closed.
Chairman Gerrish stated in reading the letter from Mr. Sheppard, he
did not indicate there were any real problems there, however, if he had some
objections in the future, then the matter could come back to the Commission
for further review.
After a brief discussion, Use Permit Case No. 84 -362 was re- affirmed
on motion by Commissioner Moore, seconded by Commissioner Moots, and
unanimously carried.

Planning Director Eisner advised the application is for a pedestal
sign for a hair salon at 146 Traffic Way in the "H -S" zone. He stated that
the applicant has indicated a desire to place the sign in the front yard of
the property, approximately half way between the sidewalk and the building.
He noted that a 100 ft. right of way is required for Traffic Way and,
therefore, staff recommends the following condition in approval of the permit:
1. That the approved sign be located on the property outside the
Traffic Way right of way so as not to inhibit visibility of
traffic entering or leaving Traffic Way.
Upon being assured by Planning Director Eisner that public hearing for
Use Permit Case No. 84 -379 had been duly published and property owners
notified, Chairman Gerrish declared the hearing open. There being no comments
for or against the proposed Use Permit, Chairman Gerrish declared the hearing
closed and the following action was taken:

Planning Director Eisner advised the request is for approval of a tentative
map for development of a 12 unit office condominium. The Commission has
approved a use permit for the project, and it has also received architectural
approval.
Upon being assured by Planning Director Eisner that public hearing for
Tract No. 1216 had been duly published and property owners notified, Chairman
Gerrish declared the hearing open.
Jim McGillis, Surveyor with San Luis Engineering, agent for the
applicant, commented with regard to Condition No. 2 of the staff report dated
August 21, 1984, requiring dedication of the creek. Mr. McGillis advised that
the applicant does not own from the center of the creek and, therefore, the
requirement for dedication and clean -up of the creek cannot be met. Planning
Director Eisner stated that fact was pointed out to staff after the staff
report was printed and will be corrected. Mr. McGillis stated that the other
condition he is concerned about is the requirement for separate water and
sewer services to each unit. He noted that a business or professional office
does not use a lot of water, and rather than having separate services, it
could be done by a homeowners' association. The way the condition reads, the
applicant would have to run 12 laterals out to Branch Street. Mr. McGillis
requested relief from that condition. With reference to Condition No. 5, Mr.
McGillis stated that this condition serves no purpose, in that recordation of
the tract map has nothing to do with the condominiums, therefore, he also asks
for relief from that condition.
Coker Ellsworth, 135 So. Halcyon Road, applicant, spoke regarding the
wording of Condition #3 requiring provision of separate water and sewer
services to each unit. He stated that the sewer and water provisions can be
covered in the Homeowners' Association, and he would like to have some
flexibility on the water meters so that he is not required to have 12 meters
if he only has 4 users. He stated he feels that this could be worked out to
the satisfaction of the Public Works Director.
Upon hearing no further continents for or against the proposed tract,
chairman Gerrish declared the hearing closed.
Commissioner Olsen expressed concern about the water and sewer hook -up
problem setting a precedent. Planning Director Eisner advised the conditions
were written when the assumption was that we were looking at a tentative tract
map as part of a condominium development. If, in fact, the applicant is .
constructing this building for leasing, then it could be like any other ,
building in town.
Commissioner Carr stated, in his opinion, the question of separate water and
sewer services should be left up to the Public Works Director to work out. He
commented he doesn't feel there is a need for separate sewers.

Chairman Gerrish left the meeting due to a. possible conflict of
interest and is now absent. Vice Chairman Moots assumed the Chair.
Planning Director Eisner reviewed the staff report, dated August 21,
1984. Upon being assured by the Planning Director that public hearing for
Rezoning Case No. 84 -177 had been duly published and property owners notified,
Vice Chairman Moots declared the hearing open.
Mr. Lee Setser, 827 Plata Road, presented a petition to the Planning
Commission containing 32 signatures objecting to the rezoning of the property
because of significant adverse affects the rezoning would have on drainage,
traffic and water. Mr. Setser stated he is concerned with that hill, and
commented that the area cannot support the drainage problems they already
have. James Boyle, 230 Oro Drive, stated he is concerned about the drainage,
and also the - traffic.
Ronald Olson, applicant, stated he lives next to the property and he
would like to see the property developed properly. He advised that he can
provide the access. He further advised that he is aware of the drainage
problem, however, he feels the problem can be solved and that they may be able
to improve the problem that already exists. He commented that the traffic
consideration is something to be dealt with, but he doesn't feel that a
development of this size . is going to add that much to the traffic burden.
Terry Ortin, Westland Engineering. Company, representing the applicant, briefly
described the proposed development.
Steve Beard, resident of Plata Road, stated he is concerned about the .
existing drainage and those problems should be resolved now.
Nancy Gerrish, 823 Plata Road, stated she is concerned about the
drainage and the additional traffic coming down Oro Drive and, in her opinion,
a zoning change from RA - B3 to R - 1 does not fill or meet the needs of the
Arroyo Grande residents and it may cause many problems. Mrs. Gerrish
commented that, from all appearances, if this subdivision is approved, it
would create one of the-largest lots in the City of Arroyo Grande. Jim.
Henderschott, 333 Miller Way, stated his concerns regarding the increased
density and increased traffic problems.
There being no further comments for or against the proposed zone
change, Vice Chairman Moots declared the•hearing closed.
Planning Director Eisner advised that the issue before the Commission
is strictly a question of • zoning, noting that the requested zoning is
consistent with the General Plan; the issues of lot size, etc. would be a
consideration at the development plan stage.
Ccx;a Carr stated he feels the property owners at least deserve
development to the same level as the adjacent Wildwocd Tract and, in his
opinion, they shouldn't be restricted to 40,000 square foot lots. He further
cmmerted that in listening to the discussion about the proposed design, it

could possibly improve the drainage. Commissioner Olsen stated she would feel
uncomfortable about changing the zoning until the traffic and drainage
problems are solved. Vice Chairman Moots stated he agrees with Commissioner
Carr, and he also feels that the drainage problem could be improved with the
proper controls. He further stated that, in his opinion, P-D zoning would be
the logical zoning for the property. Commissioner Moore stated that the
Planning Commission has already gone on record asking the City to do some
coordination of various concerns such as drainage, sewer, water and traffic.
He commented that our current plans are ten years old or more and are
inadequate. Now the room is disappearing, the water is getting short, the
schools are getting overcrowded and the traffic is congested. He recommended
that the Commission send another request to the City Council for a coordinated
study. Planning Director Eisner advised that a coordinated study is part of
our work program for the coming year. Vice Chairman Moots pointed out that
the Council is well aware of the concerns that the Commission has.

Planning Director Eisner advised that the applicants are requesting an
amendment to Ordinance 140 C.S. to modify the underlying Professional
Commercial ( "P-C ") zone on Parcel 3 of Tract 604 to allow construction of
professional office condominiums on a 1.85 acre site. Mr. Eisner pointed out
that Section 9- 4.1102(b) of the City's Zoning Ordinance (Professional
Commercial District) permits "Professional offices, not including real estate
offices." He noted that the confusion at the staff level is that the list of
uses is modified by the words "uses only ", and after going through the list,
it concludes with "and similar uses ". He requested that the Commission
consider that the words "such as" and "similar uses" be found to include
"professional offices" or, as an alternative, the Commission find that the
Ordinance, Sub - Section C, should be modified so that the language stays the
same as in the City's Zoning Ordinance. He noted that, in either case, the
matter will go to the City Council for final action. He also noted that the
only issue before the Commission is the modification of the language.
Upon being assured by Planning Director Eisner that public hearing for
Amendment to Ordinance 140 C.S. had been duly published and property owners
notified, Chairman Gerrish declared the hearing open.
Tony Orefice, RMO Architects, representing the applicant, advised that
the issue, basically, is to construct professional offices on the proposed
site under the P-C zoning. He pointed out that professional offices are
allowed in the Zoning Ordinance under the P-C zone.
Rueben Kvidt, Oak Park Acres, advised that this piece of land has been
sold to Bonita Homes, and the proposed use would be agreeable to Oak Park.
Acres and would be an appropriate use.
Upon hearing no further comments for or against the proposed ordinance
amendment, Chairman Gerrish declared the hearing closed.

wording to correspond to the terminology in the Zoning Ordinance under the

Planning Director Eisner advised that this lot line adjustment is
necessary due to an engineering error in an adjacent project. The net change
in the land use will be less than one acre, and there will be no other effects
on the overall project by the change. He further advised that the requested
lot split has been reviewed by the Staff Advisory Committee and is recommended
for approval.
Upon being assured by Planning Director Eisner that public hearing for
Lot Split Case No. 84 -395 had been duly published and property owners
notified, Chairman Gerrish declared the hearing open. Upon hearing no
comments for or against the proposed lot split, Chairman Gerrish declared the
hearing closed.
After a brief discussion, Lot Split Case No. 84 -395 was approved on
motion by Commissioner Moots, seconded by Commissioner Olsen, and unanimously
carried. Planning Director Eisner advised that this matter would be forwarded
to the City Council to be included with the amendment process to Exhibit "A"
of Ordinance No. 186 C.S.

Planning Director Eisner advised that. the request is for modification
of the development plan for Oak Knoll. The proposal has been reviewed by the
Staff Advisory Committee and, in their review, various amendments are
recommended to Ordinance No. 221 C.S. These amendments cover all of the
development concerns that the City has at the present time. He noted there
are two issues that should be considered by the Commission: (1) The overall
density, 233 units, is consistent with the Ordinance now in effect; and (2)
the road system has been reviewed previously by the Commission, and the
Commission is on record as feeling that this road system is substantially
better than the one presently approved with Ordinance 221 C.S. Mr. Eisner
further advised that the major issues to be considered by the Commission
include the protection of the Oak Trees, the overall road design, and the
phasing program for on -site improvements, and it is staff's opinion that these
matters have been covered in the proposed amendment to Ordinance 221 C.S.
Mr. Eisner commented that the matter before the Commission is an
amendment to Ordinance 221 C.S., specifically, Section 2; a revised
development plan, and a tentative parcel map which includes division into
larger parcels and the adoption of the street system. He noted that the
environmental document that was prepared under the CEQA guidelines is still in
effect. The basic nature of the EIR at the time it was prepared was for a
project of substantially greater density. He pointed out that, in his
capacity as the City's Environmental Coordinator, the project falls within the
scope of the certified public document and, therefore, the conditions and
requirements of that EIR are still in effect.

Upon being assured by Planning Director Eisner that public hearing for
Rezoning Case No. 84 -179 had been properly published and property owners
notified, Chairman Gerrish declared the hearing open.
Mr. Eddie Ramseyer, Civil Engineer and Planner, representing the
applicant, stated they have reviewed the proposed conditions as written by
both the Planning and Public Works Departments, and they are in agreement with
those conditions and accept them as written. He requested the Commission's
approval of the proposal.
Jim Garing, engineer for Rancho Grande, inquired if, as part of this
proposal, the rights of way are to be. offered for dedication. Also, is there
an offer of dedication for utilities on Street "A "? He stated, as a part of
the Rancho Grande development, they are currently designing a lift station to
handle the wastewater, and if a gravity easement can be obtained as part of
this project, it would be of benefit to the City in the future.
Al Spierling, 299 Miller Way, stated that the present proposal, in
many respects, is the same as the other proposals that have previously been
before the Commission, and he is concerned about the preservation of the Oak
Tree Grove on the northwesterly side of the hill. Spence Thomas, 141 James
Way, Jim Henderschott, 333 Miller Way, and John McGrath, Miller Way, spoke
regarding their concerns on the circulation and increased traffic problems.
Mr. Ramseyer stated, with regard to Mr. Garing's comments, they have
no problems in offering the easements. He commented with regard to the other
concerns expressed regarding circulation and traffic, noting that the plan
before the Commission tonight is a better circulation plan than the one
previously submitted. With regard to the Oak Trees, he advised he tried to
highlight the trees over the entire area and, if it is the City's desires, the
applicant would be glad to offer that area to the City.
Planning Director Eisner pointed out, as a matter of clarification,
that there is an approved project of 233 units and a tentative tract map that
is in Pffect. at. this time and, in a sense, this is not a new project. If the
three actions before the Commission are not favorable, there is still an
approved project on the books that could be developed.
Hearing no further comments for or against Rezoning Case No. 84 -179,
Chairman Gerrish declared the hearing closed.
Commissioner Moore commented that this most recent plan is better than
the other one, but there is still room for improvement, and the Commission has
to look at the systems of drainage, . roads and traffic. Commissioner Soto
commented he agrees with Commissioner Moore, and we have some real traffic
problems. Commissioner Carr stated, in his opinion, the preservation of the
Oak Trees is primary, and before any action is taken, the Oak Trees should be
considered and not allowed to be on separate lots. He also commented that
because of necessary fire protection, barricades could not be placed on Miller
way. Commissioner Moots stated he is not satisfied that this present plan is
the best way to go; there was a lot of open space in the original plan.
Chairman Gerrish stated, in his opinion, there is a substantial change in the
concept that was previously approved.

Chairman Gerrish stated his reason for voting "no" on the foregoing
resolution was because he did not feel that denial was the proper way to go.
After further discussion, on motion by Commissioner Moots, seconded by
Commissioner Olsen, and carried, Lot Split Case No. 84 -397 was denied based on
the recommendation for denial of the modification of the development plan.
Planning Director Eisner noted that the request for amendment to the
development plan and Ordinance 221 C.S. would automatically appear on the City
Council's agenda September 11, 1984. He also noted that the action on the
tentative parcel map was finaled with the Planning Commission unless appealed
to the City Council within 10 days.
