PC Minutes 1984-03-0666 ARROYO GRANDE PLANNING COMMISSION March 6, 1984 The Arroyo Grande Planning Commission met in regular session with Chairman Gerrish presiding. Present are Commissioners Benhardt, Carr, Fischer, Moore and Moots. Commissioner Olsen is absent. Planning Director Eisner is also in attendance. MINUTE APPROVAL Commissioner Moore corrected the minutes of the meeting of February 21, 1984, Page 2, first paragraph under Variance Case No. 84-96 to read 28 inches instead of 28 feet. There being no further comments, the minutes of the regular meeting of February 21, 1984 were approved as corrected on motion by Commissioner Benhardt, seconded by Commissioner Moore, and unanimously carried. CONTINUATION (PUBLIC HEARING CLOSED) - USE PERMIT CASE NO. 84 -361, FREE STANDING SIGN, 200 W. 'BRANCH STREET IN THE "H -S" DISTRICT. (MINA -TREE SIGNS, INC., AGENTS FOR BANK OF AMERICA). Chairman Gerrish advised that the applicants have requested that this item be continued to the next regular meeting of March 20th Upon hearing no objections to the continuance, Chairman Gerrish announced that Use Permit Case No. 84-361 would be continued to the meeting of March 20, 1984. PUBLIC HEARING - LOT SPLIT CASE NO. 84 -390, NORTH ELM STREET, IN THE "R -3" DISTRICT. (LOUISE T. PASCHALL). Planning Director Eisner advised that the applicant has withdrawn the appli- cation. He suggested that the Commission accept the withdrawal without prejudice to enable re- filing by the applicant if desired. On motion by Commissioner Fischer, seconded by Commissioner Benhardt, the lot split application was withdrawn as requested ..by.:the applicant without prejudice. Motion carried unanimously. PUBLIC HEARING - USE PERMIT CASE NO. 84 -363, UPHOLSTERY SALES, SERVICE AND SHOWROOM. AT 111 NO. HALCYON ROAD, IN THE "H -S" HIGHWAY SERVICE DISTRICT. (PARTEE) . Planning Director Eisner reviewed that the applicant had previously appeared before the Commission with a request that they find upholstery sales, service and showroom use is consistent with other uses permitted in the Highway Service District. The Commission made that determination on January 17, 1984 subject to approval of a Use Permit. Mr. Eisner advised that the subject property is located in a building formerly occupied by "Pat's Pups ". The building contains approximately 480 sq. ft. and the use will require 4 parking spaces. He pointed out that there are approximately 26 spaces on the site serving two buildings and, therefore, sufficient parking will be available for this use. Upon being assured by Planning Director Eisner that public hearing for Use Permit Case No. 84 -363 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Mr. Partee, applicant, spoke in favor of the Use Permit being granted. With regard to parking, he stated there probably would not be more than 3 or 4 customers throughout the day. There being no further comments for or against the proposed use permit, Chairman Gerrish declared the hearing closed. After a brief discussion, the following action was taken: RESOLUTION NO. 84 -977 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING A USE PERMIT, CASE NO. 84- 363', APPLIED FOR BY STEVEN AND DAVID PARTEE AT 111 NO. HALCYON ROAD IN THE "H -S" HIGHWAY SERVICE DISTRICT. On motion by Commissioner Benhardt, seconded by Commissioner Fischer, and by the following roll call vote, to wit: AYES: Commissioners Benhardt, Carr, Fischer, Moore, Moots and Chairman Gerrish NOES: None ABSENT: Commissioner Olsen the foregoing Resolution was adopted this 6th day of March 1984. Arroyo Grande Planning Commission, 3 -6 -84 Page 2 PUBLIC HEARING - PROPOSED ZONING ORDINANCE AMENDMENT CREATING STANDARDS FOR SECOND RESIDENTIAL DWELLING UNITS ON EXISTING SINGLE FAMILY LOTS. Planning Director Eisner introduced Linda Stonier, Associate Planner. He advised that Ms. Stonier had done extensive research in preparation of the proposed ordinance. Mr. Eisner reviewed that the State law changed about 1 -1/2 years ago and, as a result, it is now up to the cities to choose whether or not they are going to adopt standards for additional housing units on single family and multiple family lots. He pointed out that if a city does not adopt its own ordinance, then the provisions of the State go into effect, and they are not as restrictive as the City might like. By way of summary, Mr. Eisner noted that the ordinance would permit second housing units if they are attached to main units. All of the site requirements would be in effect, including the requirement for additional off - street parking. The maximum size of the unit would be 640 sq. ft., and 6,000 sq. ft. minimum size is the recommendation for the lot itself. He advised that staff also recommends that no second house or second units be permitted if there is already a guest house existing. He further pointed out it has been recommended that there be owner - occupancy in at least one of the units. Upon being assured by Planning Director Eisner that public hearing for the proposed Zoning Ordinance amendment had been duly published and posted, Chairman Gerrish declared the hearing open. In answer to a question from a member of the audience, Ms. Stonier advised that the reason for the provision of the unit being attached was to maintain the character of a single family area. Tom Steaver inquired if a carport between the two buildings would constitute an attached unit. Ms. Stonier read from the proposed Ordinance "... "dwelling unit" shall not include a garage or any accessory structures ". In response to a question from the audience regarding guest houses and "Granny Flats ", Chairman Gerrish advised that they are completely separate ordinances, and the proposal before the Commission states that you can't have both. Upon hearing no further comments for or against the proposed Ordinance amendment, Chairman Gerrish declared the hearing closed. Commissioner Carr commented with regard to detached units that the City allows flag lots all over the City and, in his opinion, the City might want to consider allowing units larger size lots, and he didn't feel it would detract or impact any more than flag lots. Chairman Gerrish stated he has a problem with the parking requirements, and if two additional spaces are required, that in itself would exclude a substantial portion of the "R -1" property, and he has a problem with . the requirement for construction of an additional covered parking space. After further discussion and comments, Planning Director Eisner suggested that this matter be continued for two weeks to allow Ms. Stonier to amend the draft to include the Commission's recommendations. As an alternative, he suggested that the Commission send this ordinance to the City Council with a cover resolution and let staff come back to the Commission in two weeks with the alternate wording. RESOLUTION NO. 84 -978 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING MODIFYING TITLE 9, CHAPTER 4 OF THE MUNICIPAL CODE BY ADDING ARTICLE 40, STANDARDS AND CONDITIONS FOR SECOND DWELLING UNITS IN SINGLE FAMILY RESIDENTIAL ZONES; AND RELATED MODIFICATIONS TO ARTICLES 5., 6 and 26. On motion by Commissioner Carr, seconded by Commissioner Benhardt, and by the following roll call vote, to wit: Commissioners Benhardt, Carr, Fischer, Moore and Moots Chairman Gerrish Commissioner Olsen Resolution was adopted this 6th day of March 1984. Director Eisner advised that this matter will be reported to the as part of the transmission document. He stated it is his intent to the Commission in two weeks with a draft containing the alternate 67 . Planning Director Eisner briefly reviewed a proposal for housing units on a very small scale and a substantially higher density than we have seen, to serve people who work at the hospital or are associated with a patient at the hospital. It was the consensus of the Commission that any projects to be considered by them should go through the proper application channels. Planning Director Eisner gave a slide presentation showing various architectural design concepts and features. There being no further business before the Commission, the meeting was adjourned by the Chairman at 9:30 P.M.
