PC Minutes 1983-06-21ARROYO GRANDE PLANNING COMMISSION June 21, 1983 The Arroyo Grande Planning Commission met in regular session. In the absence of the Chairman and Vice Chairperson, Commissioner Moots was selected as Acting Chairman. Present are Commissioners Benhardt, Carr and Moore Chairman Gerrish, Vide Chairperson Cole and Commissioner Pilkington are absent. Public Works Director Karp is also in attendance. RE VEST FOR ONE YEAR EXTENSION - LOT SPLIT CASE .NO. 81 -363 (LOT LINE ADJUSTMENT), 1190 AND 1166 GRAND AVENUE. (HARRIS /COCKS /HARRIS). Public Works Director Karp briefly reviewed the staff report, dated June 17, 1983. He pointed out that the tentative map is in conformance with the latest approval granted by the Commission for a mini - storage facility, and staff recommends that the 12 month extension be granted. After a brief discussion, on motion by Commissioner Benhardt, seconded by Commissioner Moore, and unanimously carried, the requested 12 month extension was granted from September 25, 1983 to September 25, 1984. PUBLIC HEARING - VARIANCE CASE NO. 83 -92, REQUEST FOR PERIMETER CHAIN LINK FENCE AT PROPERTY LINE, SOUTHEAST CORNER OF VALLEY ROAD AND SUNRISE TERRACE DRIVE IN THE "C -N" NEIGHBORHOOD COMMERCIAL DISTRICT. (H. C. ELLIOTT, INC.). Public Works Director Karp briefly reviewed the plan submitted by the appli- cant for development of a parking lot at the southeast corner of Valley Road and Sunrise Terrace Drive. The plan proposes a slatted chain link fence on Valley Road and Sunrise Terrace, and the Zoning Ordinance permits construction of the fence at property line in these locations. Mr. Karp noted that the height of the fence, under the Zoning Ordinance, is limited to 3 ft. He further noted. that there is no indication in the application that the applicant is requesting to modify the maximum height or encroach on City_ right of way and, therefore, in his opinion, the request for a Variance is inappropriate. Mr. Karp also pointed out that a Use Permit to allow R.V. storage and overnight parking at this location was previously denied by the Commission.' Upon being assured by Public Works Director Karp that public hearing for Variance Case No. 83 -92 had been duly published and property owners notified, Acting Chairman Moots declared the hearing open. Ross Cox, 789 Valley Road, stated he owns the parcel adjoining the subject property,..and he is curious what is going to happen on this property. He advised the Commission that the applicant has taken all of the planters and foliage out and replaced them with blacktop; the ordinance states that the planters have to be put in. With regard to the request for a chain link fence, Mr. Cox pointed out that the ordinance states they have to have a 3 ft. fence and it has to be set back 10 ft. Mr. Karp stated, as he reads it, fences are allowed in the 10 ft. setback. Upon hearing no further comments, Acting Chairman Moots declared the hearing closed. COMMISSIONER PILKINGTON ENTERED THE MEETING DURING THE ABOVE DISCUSSION. The Commission indicated their concurrence with staff, and there was no indication in the application that the applicant is requesting to modify the maximum height of 3 ft. and, therefore, the Variance request is inappropriate. After a brief discussion, the following action was taken: RESOLUTION NO. 83 -943 V RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE DENYING A VARIANCE, CASE NO. 83 -92. On motion by Commissioner Moore, seconded by Commissioner Carr, and on the following roll call vote, to wit: AYES: Commissioners Carr, Moore, Moots and Pilkington NOES: None ABSENT: Chairman Gerrish and Vice Chairperson Cole ABSTAIN: Commissioner Benhardt the foregoing Resolution was adopted this 21st day of June 1983. PUBLIC HEARING - USE PERMIT CASE NO. 83 -349, REQUEST TO CONSTRUCT MORTUARY, 555 FAIR OAKS AVE., IN THE "P -C" PROF. COMMERCIAL DISTRICT. (WOOD/VOAKES MORTUARY). Public Works Director Karp advised that due to economic concerns, the pro- posed project was not developed within the one year period of the original Use Permit and, therefore, 'that Use PermitY has expired. The applicants are Arroyo Grande Planning Commission, 6 -21 -83 Page 2 now requesting that a new Use Permit be granted. Mr. Karp stated that it is the staff's recommendation that the Use Permit be granted as originally con- _ ditioned. He further stated that the Architectural Review conditions would stay in force unless the applicants wish to chage the design. Upon being assured by Public Works Director Karp that public hearing for Use Permit Case No. 83 -349 had been duly published and property owners notified, Acting Chairman Moots declared the hearing open. Jim McGillis, San Luis Engineers, stated he had worked with Mr. Machado on the project and may be able to answer questions the Commission may have. There being no further comments for or against the proposed Use Permit, Acting Chairman Moots declared the hearing closed. Commissioner Carr stated he was concerned about the Architectural Review and the setbacks referred to by Mr. Castro in the minutes of the Planning Commission Meeting of February 17, 1981.relative to the previously approved Use Permit. It was the consensus of the Commission that there was no problem with granting the Use Permit : if appropriate Architectural Approval is in force at this time. After a brief discussion, the following action was taken: RESOLUTION NO. 83 -944 U A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE, GRANTING A USE PERMIT, CASE NO. 83 -349.. On motion by Commissioner Benhardt, seconded by Commissioner Carr, and by the following roll call vote, to wit: AYES: Commissioners Benhardt, Carr, Moore and Moots NOES: None ABSTAIN: Commissioner Pilkington ABSENT: Chairman Gerrish and Vice Chairperson Cole the foregoing Resolution was_adopted_this__21st_day of June 1983. ARCHITECTURAL REVIEW CASE NO. 83 -284, VAN'S AUTO PARTS, NORTHEAST CORNER OF NELSON AND BRIDGE STREETS. (TOM BONDS). Public Works Director Karp advised that'at a prior meeting the Planning Commission made a determination that a Use Permit would not be necessary for the subject project and the application could be processed under Architectural Review. Mr. Karp referred to the proposed plans and reviewed recommended conditions listed in Architectural Committee Action, dated June 15, 1983. There being no discussion, Architectural Review Case No. 83 -284 was approved subject to the conditions listed in Architectural Review Committee Report, dated June 15, 1983. REQUEST FOR DETERMINATION OF USE - REQUEST TO CONSTRUCT TRIPLEX AT 138 JUNIPER STREET IN THE "P -M" PLANNED INDUSTRIAL DISTRICT. (DAL CAUDILL). Public Works Director Karp briefly reviewed Mr. Caudill's request to expand a non - conforming use by removing a work shop and storage building and replace it with a triplex in "P -M" Planned Industrial. District. Mr. Karp pointed out that residential development is not listed in the Zoning Ordinance as a permitted use even with a Use Permit. Mr. Caudill, applicant, stated that he owns an acre in the "P -M" zoning which adjoins the strawberry fields. He advised that there wer•.e four resi- dential buildings on the:property..when he.- purchased it in 1969. He further stated he feels the request would be consistent with what is already there as far as a residential area. Also, it is his understanding that there is a shortage of rental units in Arroyo Grande, and especially rentals that are close to a shopping center. He pointed out that even with a triplex on the property, he would only be using about 40% of the land. Commissioner Carr commented that he has reviewed the Ordinance and, in his opinion, housing is not a proper use for the "P -M" District, however, he would like.an.opportunity to look at General Plan and Zoning on the subject property. Arroyo Grande Planning Commission, 6 -21 -83 Page 3 Public Works Director Karp advised that if the Commission feels the property should be rezoned, he would pass it on to the new Planning Director to take a look at it, or Mr: Caudill could apply for zone change. After a brief discussion, on motion by Commissioner Carr, seconded by Commissioner Pilkington, and unanimously carried, the Commission determined that the proposed residential use is not appropriate for "P -M" Planned Industrial zoning. The Commission also requested that the Planning Director place a high priority to review the "P -M" zoning on this property and other "P -M" zoning. CONTINUATION (Public Hearing Closed) - REZONING CASE NO. 83 -169, PROPOSED AMENDMENT TO ORDINANCE NO. 140 C.S. CHANGING THE LAND•USE OF LOT 7, TRACT 604, OAK PARK ACRES,'IFROM MEDIUM HIGH DENSITY TO LOW DENSITY RESIDENTIAL. (SAN LUIS ENGINEERING, INC., AGENTS FOR J. E. FOREMASTER). • Public Works Director Karp advised the Commission that both of the rezoning proposals were included in their Agenda packets; one dated June 3, 1983, and one dated June 17, 1983. He pointed out that the previous sub- mittal, dated June 3rd, by.staff specifically changes the zoning for Parcel No. 7 to single family detached housing with 6,000 sq. ft. minimum lot size for internal lots and 7,000 sq. ft. for corner lots. The second proposal allows either single family detached housing or cluster housing, townhouses, condominiums and /or apartments. Mr. Karp stated that the proposal submitted by Oak Park Acres meets with staff approval if the Planning Commission agrees with the concept of providing the flexibility requested. The only•mod.i.fi.- cation he would recommend to that proposal would be the insertion Of the words: "7,00.0 sq. ft. for corner lots" after the words, "...sizes of not less than 6,000 sq. ft. ... " Commissioner Carr commented that the recommended wording is not all that clear. He suggested that the wording be•c}ianged t� clarify the intent. of the amendment. Mr. Karp advised that the applicant will have to submit a development plan for :approval.: .
