April 5, 1983
The Arroyo Grande Planning Commission met in regular session with
Chairman Gerrish presiding. Present are Commissioners Benhardt, Carr, Cole,
Moore and Moots. Commissioner Pilkington is absent. Also in attendance are
City Manager Mack and Public Works Director Kart?
MINUTE APPROVAL
The minutes of the regular meetings of March 1, 1983 and March 15,
1983 were approved as prepared on motion by Commissioner Benhardt, seconded
by Commissioner Carr and unanimously carried.
REVIEW COMMITTEE ACTIONS:
Architectural Review Case No. 83 -270, Tract No. 1050 "Farroll Heights ",
Farroll Avenue. (William Lackey).
Public Works Director Karp referred to the plans for various proposals
€o be considered for construction for Tract 1050. He noted that they are
all 2 and 3 bedroom units, and there is one model which is two - story, and
this is the only significant change of previously approved plans. He advised
that the two -story units are to be located along the Grover City boundaries
on the west and south. He further advised that the number of two -story
units would be up to 14 as a maximum,.or117 structures, to be built on Lots 1.thru 30.
Mr. Karp pointed out that because of a recent revision to the Planned De-
velopment ordinance, both the Planning. Commission and City Council are re-
quired to review all developments within the "P -D" zone.
After discussion, on motion by Commissioner Cole, seconded by
Commissioner Carr, and unanimously carried, Architectural Review Committee
Action, dated March 30, 1983,was approved adding Condition #3 as follows:
3. On Lots 1 through 30 a maximum of 14 units (7 two -story
structures)may be constructed.
It was further recommended that Architectural Review Case No. 83 -270 be
forwarded to the City Council for their review and approval.
Architectural Review Case No. 83 -271, Remodeling of Building at
Street. (Phillip Johnson).
Public Works Director Karp advised that the proposal is to modify the
building formerly occupied by Spinelli's at 102 E. Branch Street. He
stated that architectural plans have been reviewed by the Architectural
Review Committee and they recommended approval subject to the condition
noted in their report dated March 30, 1983. Mr. Karp noted that the
Fire Chief and Building Inspector have reviewed the proposal, which is
a type of mini -mall, and they feel it is a workable plan.
After a brief discussion, on motion by Commissioner Cole, seconded by
Commissioner Benhardt, and unanimously carried, Architectural Review
Committee Action, dated March 30, 1983 was approved.
Architectural Review Case No. 83 -272, Tract No. 954 "Villa Los Berros",
Valley Road and Los Berros Road. (Garing Farms).
Public Works Director Karp stated that the developer is requesting
modification to a previously approved plan for Villa Los Berros. He
noted the proposed changes as follows:
1. The architecture has been changed from wood to stucco
with Spanish style exterior.
2. Three more parking spaces have been added.
3. The shuffle board and putting green have been eliminated
and the barbecue pit has been enlarged and benches included.
4. The sidewalks have been realigned to fit in with the
barbecue area.
Mr.. Karp stated that the lot coverage will stay the same. He noted
that the revised plans were reviewed by the Architectural Review Committee
and they are recommending approval of the modifications.

After discussion, on motion by Commissioner Cole, seconded. by
Commissioner Benhardt, and unanimously carried, Architectural Review
Case No. 83 -272 was approved as recommended by the Architectural
Review Committee in their report dated March 30, 1983.
COMMISSIONER PILKINGTON ENTERED. THE MEETING DURING THE ABOVE DISCUSSION.
Architectural Review Case No. 83 -273, Remodel Office, El Camino
Real. (Manuel Sebastian).
Public Works Director Karp advised this item had been added to the
Architectural Review Committee's agenda just before their meeting and
the plans were not available to distribute with the Planning Commissioners'
agenda packets. He stated that a determination was made after review of
the Zoning Ordinance that to expand the use on the gas islands, a Use Permit
would be required for that use and, therefore, staff is recommending that
the Commission continue the architectural review pending the Use Permit
process, which will require a public hearing.
Mr. Sebastian, applicant, reviewed his plans for the property.
He pointed out that he wants to remove most of the front structure and
build a block wall along the entire length of the project. Also, he
stated he wants to tear down most of the warehouse and build the warehouse
underneath with an office up above. Mr. Sebastian further stated he was
a member of the Planning Commission when the area in question was annexed
into the City a couple of years ago and at that time he was concerned
about the bulk plants requiring a Use Permit. He stated he was told
at that:time that the existing use would be "grandfathered in ", and now
he is told that a Use Permit is required.
Mr. Karp stated that, in his opinion, adding another island with
pumps is an expanded use and, based on the Zoning Ordinance, staff is
recommending a Use Permit be obtained. Chairman Gerrish questioned
whether Mr. Sebastian is expanding a use or merely adding to an existing
use.
City Manager Mack inquired as to the specific land use, and if the
proposal is, for example, to put in a retail service station for auto-
mobiles which currently does not exist; in other words, is there any
basic change in the nature of the business? Mr. Sebastian stated that
he does not sell to the public; he leases the facilities to the customers.
He further stated that, basically, what he wants to do is separate the
large trucks and trailers that they service and move them over to another
island and, to do this, he has to make a bigger driveway. Mr. Mack
commented that, based on Mr. Sebastian's comments, he would conclude
that there is no basic change on the property; the property use is not
changing. He stated that, in his opinion, the Ordinance does not spell
out the process for bringing in a use; it is grandfathered in and it is
perfectly legal, but what happens when an applicant wants to expand that
use on the property. Mr. Mack noted he feels it is well within the
latitude of the Planning Commission to make a determination whether or
not a Use Permit is required.
After considerable discussion, it was the consensus of the Planning
Commission that the applicant is not changing a use that is already
permitted; he is merely streamlining it and eliminating a congestion
problem.
Public Works Director Karp advised that former Planning Director
Hays discussed the Architectural Review with Fire Chief Marsalek, which
prompted the memo, dated April 5, 1982, from the Fire Department stating
the requirement for a fence or similar barrier separating a bulk plant
operation from the area dispensing Class 1 liquids into fuel tanks of
motor vehicles of the public. Mr. Karp suggested that Mr. Sebastian
work with the Fire Chief to resolve this requirement of the Uniform
Fire Code.
After further discussion, on motion by Commissioner Moore, seconded
by Commissioner Benhardt, and unanimously carried, a determination was
made that a Use Permit is not required because of the pre- existing use
and the fact that the applicant is not changing the use; he is merely
eliminating a safety and congestion problem. With regard to architectural
review, on motion by Commissioner Benhardt, seconded by Commissioner Moore,
and unanimously carried, Architectural Review Case No. 83 -273 was approved

subject to the conditions listed in Architectural Committee Action, dated
March 30, 1983, and eliminating Condition #2 requiring a Use Permit.
CONTINUATION (Public Hearing Closed) - PREZONING CASE NO. 81 -151, ZONE
CHANGE FROM "A" DISTRICT TO "P-M" PLANNED INDU )RIAL DISTRICT - SHANNON
RANCH. (TONY DECKER).
Public Works Director Karp read a letter from Tony Decker, applicant
for the prezoning, dated March 15, 1983, requesting a continuance of the
Shannon, Ranch prezoning from April 5, 1983 to May 3, 1983. After a brief
discussion by the Commission, on motion by Commissioner Moore, seconded by
Commissioner Benhardt, and unanimously carried, Prezoning Case No. 81 -151
was continued to the Planning Commission meeting of May 3, 1983 as re-
quested by the applicant in his letter dated March 15, 1983.
COMMUNICATIONS
City Manager Bob Mack extended an invitation to the Chairman or his
appointee to participate in the selection process of the new Planning
Director. After a brief discussion, Planning Commissioner Carr volunteered
to review the applications for Planning Director.
ADJOURNMENT
There being no further business before the Commission; the meeting
was adjourned by the Chairman at 8:40 P.M. •
