ARROYO GRANDE PLANNING COMMISSION
The Arroyo Grande Planning Commission met in regular session with
Chairman Gerrish presiding. Present are Commissioners Cole, Benhardt, Moots,
Moore and Pilkington. Commissioner Carr is absent. Planning Director Hays
is also in attendance.
MINUTE APPROVAL
There being no additions or corrections, the minutes of the regular
meeting of July 20, 1982 were approved as prepared on motion by Commissioner
Benhardt, seconded by Commissioner Cole, and unanimously carried.
COMMUNICATIONS
Planning Director Hays reviewed that a little over a yearlago the Com-
mission approved a condominium project on Farroll Avenue, Tract No. 950. He
noted that the final map has never been filed and, due to the present economic
situation, the current owners are seeking approval to build the project in two
phases. Basically, what they are proposing to do is build 8 units in the first
phase, and 14 units in the second phase.
After review of the proposed phasing plan, Planning Director Hays
pointed out that all previous conditions of approval would apply, and he
recommended .c eptan.ce -_of the phasing concept with _the condition__.. .
that the proposal can be accomplished, from a building standpoint, without any
problems. Planning Director Hays advised that the final map will come back
to the Commission showing the phasing.
After a brief discussion, on motion by Commissioner Pilkington,
seconded by Commissioner Cole, motion carried with one "no" vote, accepting
the phasing concept for Tract No. 950 subject to the original conditions of
approval, and the condition that the proposed'phasing can be accomplished,
from a building standpoint, without any problems.
PUBLIC HEARING - REZONING CASE NO. 82-164, ZONE CHANGE FROM "RA-B3" RESIDENTIAL
AGRICULTURAL DISTRICT TO "R -1" SINGLE FAMILY RESIDENTIAL DISTRICT, STAGECOACH
ROAD. (JOSEPH ZOGATA).
Planning Director Hays advised that the application is to rezone approxi-
mately 15 -1/2 acres from "RA -B3" Residential Agricultural (40,000 sq. ft.
minimum lot size) to "R -1" Single Family Residential District. He noted that
the property is located east of Stage Coach Road and the City Limits form the
northerly border of this property. The General Plan designation for this
property is Low Density Residential, and the proposal is in conformance with
that designation. He further noted that the property surrounding this proposed
rezoning is all zoned "R -1, and the request would conform to the surrounding
development density and would be a compatible use. Mr. Hays pointed that all
City services are available to this site and since the rezoning should not
result in any significant environmental effects, he suggested that the Com-
mission recommend to the City Council that a Negative Declaration be filed on
this project.
Upon being assured by Planning Director Hays that Public Hearing for
Rezoning Case No. 82 -164 had been duly published and property owners notified,
Chairman Gerrish declared the hearing open.
Christine Phillips, 216 Pearwood Avenue, spoke in opposition to the
proposed zone change. Mr. Jim Garing, of Garing, Taylor and Associates,
stated his firm prepared the paperwork for the zone change for Mr. Zogata.
Mr. Garing briefly reviewed the proposal regarding water, utilities and
drainage.
Upon hearing no further comments for or against the proposed zone
change, Chairman Gerrish declared the hearing closed.
Commissioner Moore commented regarding the Environmental Checklist form
relative to grading, drainage, flood waters, etc. Planning Director Hays
advised that on rezoning cases, it is difficult to determine the net effect
without a specific proposal. He pointed out that the Commission will have
the opportunity to require certain mitigation measures on subdivisions and
other projects when they actually come in with a specific proposal.
Chairman Gerrish commented, in his opinion, this is a logical location
for rezoning since there is "R -1" zoning all around the site.

After a brief .. discussion regarding the environmental determination, on
motion by Commissioner Cole, seconded by Commissioner Pilkington, motion carried
with one "no" vote, recommending to the City Council that a Negative
Declaration be filed on Rezoning Case No. 82 -164.
After further discussion, the following action was taken relative to
the Zone Change request:

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMEND -
MENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO
GRANDE AS PROVIDED BY CHAPTER 4 ZONING, ARTICLE 32
OF SAID CODE.
On motion by Commissioner Cole, seconded by Commissioner Benhardt, and
by the following roll call vote, to wit:
AYES: Commissioners Cole, Benhardt, Moots, Moore, Pilkington
and Chairman Gerrish
NOES=: None
ABSENT: Commissioner Carr

CONTINUATION (Public Hearing Closed) - PROPOSED AMENDMENT TO THE ZONING ORDINANCE,
SECTION 9- 4.808(:a) "MINIMUM YARDS REQUIRED ", "R -G" RESIDENTIAL GARDEN APARTMENT DIST.
- Chairman advised -that this item will be continued to the next
regular meeting.=
REQUEST FOR:EYTENSION FOR FILING FINAL MAP, TRACT 954, "VILLA LOS BERROS ".

Planning Hays advised that the applicant has submitted a written
request for a -n -18 month time extension for filing his final map, however, just
recently the Commission and City Council adopted a new ordinance relating to
subdivision maps,- -the-lengthi of time the tentative approval is good, and the
number of extensions that maybe, granted. He stated that, at this point in time,
the applicant--is only eligible° =to - ask -- for - a 12 month extension and, at the end
of that time, they will be eligible for another 12 month extension.
After a brief discussion, a12 month extension for filing of final map
on Tract 954 was- granted on motion by Commissioner Pilkington, seconded by
Commissioner Benhardt, and unanimously carried.
There being no further business before the Commission, the meeting was
adjourned by the Chairman at 8:15 P.M.

ADJOURNMENT -
Planning Director Hays advised that no items•have been filed for the August
18th meeting and,-unless something comes in within the next day or so, that meeting
will not be held.
