The Arroyo Grande Planning Commission met in regular session with
Chairman Gerrish presiding. Present are Commissioners Cole, Moots,
Pilkington and Saruwatari. Commissioners Benhardt and Sebastian are
absent. Planning Director Hays is also in attendance.
MINUTE APPROVAL
Upon hearing no additions or corrections, the minutes of the regular
meetings of December 15, 1981 and January 5, 1982 were approved as prepared
on motion by Commissioner Cole, seconded by Commissioner Moots and unanimously
carried.
REVIEW OF PROPOSED PLAN REVISIONS FOR TRACT 954, VILLA LOS BERROS. (JAMES GARING).
Planning Director Hays advised that the Commission had previously approved
Tract No. 954, and the applicant, in the process of preparing a final map, has
run across some minor modification he would like to make to the lot lines.
Mr. Hays advised that the action required by the Planning Commission, if the
modification is acceptable, is merely to affirm the changes so when the final
map is filed it will be in conformance with what has been approved.
Jim Garing, applicant, advised that the subdivision consists of 8 lots
and a common area. He noted that the site plan will be coming back to the
Commission for Architectural Review and approval of the site plan and the
units. He stated they are now in the final design and in so doing, noticed
an inconsistency between the units. He pointed out that 6 of the units all
have a parking area in front, however, two of the units do not. In order
to provide that parking area, it alters the shape of the driveway. Mr. Garing
also noted that, as a matter of interest, they are proposing to provide two
additional parking areas in the common area. Planning Director Hays stated
that the line comes straight across, and the applicant is proposing to push it
14 ft. further out to provide two additional parking areas and, in his opinion,
the design would provide a more workable solution plus add two more parking
spaces that were not in the original design.
After a brief discussion, on motion by Commissioner Moots, seconded by
Commissioner Cole, and unanimously carried, the minor alterations were approved
on Subdivision Map for Tract 954.
PUBLIC HEARING - VARIANCE CASE NO. 81 -84, REQUEST TO REDUCE REQUIRED FRONT YARD
SETBACK FROM 15 FT. TO 9 FT., SO. ELM STREET IN THE "R -G" GARDEN APARTMENT
RESIDENTIAL DISTRICT. (DON McHANEY /JOHN WYNN).
Planning Director Hays advised that there are two separate applications
by the applicant; a Variance and a Use Permit. He explained that when the
original design of the project was made, the actual lot depth was 6 ft. less
than they had planned on and in order to stay with the same design, they
need a variance reducing the front yard setback from 15 ft. to 9 ft.
Mr. Hays further advised that upon reviewing the site plan, it became
apparent to him that the proposal did not meet the open space requirements for
the "R -G" District, which requires at least 40% of open space. He pointed out
that 6 ft. of the Elm Street frontage has been designated for the Elm Street
Plan Line and has reduced their open space to approximately 25%. He further
pointed out that the Ordinance is in conflict with Section 9- 4.813, which
requires only 250 sq. ft. of open area per unit. He stated, in his opinion,
the Commission needs to reaffirm the open space requirement, and he recom-
mended that the 40% be maintained.
With regard to the two applications before the Commission, Planning
Director Hays suggested that if the Commission is in favor of maintaining
the 40% open space, then they should consider a Variance for the reduced
open space and, if so, the matter would have to be readvertised. Mr. Hays
recommended that the Commission discuss both applications under the Use
Permit request.
PUBLIC I-IEARING - USE PERMIT CASE NO. 81 -330, 6 UNIT RESIDENTIAL PLANNED
DEVELOPMENT ON SO. ELM STREET IN THE "R -G" GARDEN APARTMENT RESIDENTIAL
DISTRICT. (DON McHANEY /JOHN WYNN).
Upon being assured by Planning Director Hays that Use Permit Case No.
81 -330 had been duly published, posted and property owners notified, Chairman
Gerrish declared the hearing open.

Mr. Don McHaney, applicant for the project, spoke in favor of the Use
Permit being granted. He advised when they entered into the design of the
development, they were not aware of the fact that Arroyo Grande has a plan
line for Elm Street that incorporates an additional 6 ft. of their frontage.
He stated as far as the open space, the original information he received
was they were allowed coverage up to 60 %, but he was not aware of the open
space requirement of 40% of the project. He pointed out that there is quite
a bit of open space in the drive area. He stated it would be a hard project
to attempt with 40% of the project in open space; and there is only one way
to put the drive in there to service the project.
Upon hearing no further discussion for or against the proposed Use
Permit, Chairman Gerrish declared the hearing closed.
Chairman Gerrish stated, in his opinion, the question for discussion
is the open space question that Mr. Hays brought up. The Ordinance states
that the maximum building site coverage in the "R -G" District is 60% which
includes parking areas and driveways. He pointed out that the conflict comes
under Sec. 9 -4.813 of the Zoning Ordinance regarding open area and density
per family unit, which states there will be a minimum of 250 ft. per unit on
site and, if we use the minimum of 250 ft., then Mr. McHaney is in compliance.
Planning Director Hays stated, in his opinion, the intent of the
District was to have 40% open space and the 250 ft. should have been changed
when the Commission changed the density factor.
After a brief discussion, it was the consensus of the Commission that
the 40% open space requirement is the intent of the District and should be
adhered to. Planning Director Hays stated that the applicant may want to
go back and look at this a little more and perhaps he can add a little bit
to his open space and apply for a Variance at the same time.

The Commission was in agreement to continue the Variance and Use Permit
to the next regular meeting.
PUBLIC HEARING - TENTATIVE TRACT MAP 1025, "VILLA CALLE ", 290 SPRUCE STREET,
A 6 UNIT RESIDENTIAL PLANNED DEVELOPMENT. (M.D.M. PROPERTIES).
Planning Director Hays pointed out that last year the Commission granted a
Use Permit to allow for a 6 unit condominium project on Spruce Street, and now
the applicant is following up with the subdivision map itself. He advised that
the Subdivision Review Board met last Wednesday and have recommended approval of
the tentative subdivision map subject to the 9 conditions listed in the staff
report dated January 14, 1982.
Upon being assured by Planning Director Hays that public hearing for
Tentative Tract Map 1025 had been duly published, posted and property owners
notified, Chairman Gerrish declared the hearing open. Upon hearing no comments
for or against the tentative tract map, Chairman Gerrish declared the hearing
closed.
After a brief discussion, the following action was taken:

PUBLIC HEARING - USE PERMIT CASE NO. 82 -331, PRIVATE RECREATION CENTER,
601 GRAND AVENUE IN THE "H -S" HIGHWAY SERVICE DISTRICT.
Planning Director Hays advised that the applicant is requesting a Use
Permit to relocate the International Kites and Candies Store to 601 Grand
Avenue. He pointed out that the Use Permit is necessary because the appli-
cant wishes to have video games in the store, which would classify it as a
private recreation center. He advised that the City does not have any specific
ordinance regulating video games at this time, and he suggested that the
Commission consider placing a limit on the number of video game machines at
the new location, and also they might want to consider a yearly review of the
permit. Mr. Hays also advised that the Public Works Director has recommended
that the front portion of the property be graded and paved to provide adequate
parking and insure that drainage goes to the street, and also that the frontage
on Grand Avenue be red zoned to eliminate parking on the street.
Planning Director Hays stated he had received some correspondence
relative to this item. He read a memo from Fire Chief Marsalek, dated January
18, 1982, wherein he related that an inspection had been conducted at the ex-
isting store and no violations or problems were observed. Also, an inspection
was made at the new location and apparently there are no problems at that
location. Mr. Hays read a letter from LaVerna M. West of Taft, California,.
dated January 19, 1982, owner of Parcel 06- 541 -02, stating she is opposed to
the issuance of the Use Permit.
Upon being assured by Planning Director Hays that public hearing for
Use Permit Case No. 82 -331 had been duly published, posted and property owners
notified, Chairman Gerrish declared the hearing open.
Judy Pfeifer, Launa Lane, stated she has two teenage sons that frequent
the Kites and Candies Store and she is in favor of the Use Permit being granted_
Mr. Butram, stated is co -owner of the Grand Avenue Motel, and inquired about
the type of activity and if there is a curfew for the children. Also, he was
concerned about the red zone and he felt that parking is needed on Grand Avenue
for the businesses.
Lee Dunham, 520 Grand Avenue, questioned the need for the red zone, and
stated they need the parking on Grand Avenue. Merilee Peck, stated she has a
son that goes to the International Kites and Candies Store. She stated she
feels there should be an Ordinance to regulate this type of use.
Richard Weatherspoon, Rt. 1. Box 11, stated he originally opened the
Kites & Candies Store and it is no more or less that a TV set and is a
family oriented type use. Mr. Weatherspoon stated he feels the Use Permit should
be approved. He further stated that by limiting the number of machines that can
be put in an establishment, limits the amount of income that Mrs. Zumbrum can
derive from her business. He pointed out that size of the building more or less
limits the number of machines that can be put in there.
Niia Zumbrum, applicant for the Use Permit, stated that the problems
she is having in her store now are congestion problems with the bicycles, and
the noise problems for the adjoining merchants. She further stated that the
congestion and noise will not be a problem at the new location. She also
commented that, in her opinion, it is unfair to limit the number of machines.
Susan Hiashi, 516 Grand Avenue, stated in her opinion she should be allowed as
many machines as she can accommodate as long as she can control the children.
She also stated she doesn't want the parking taken off of Grand Avenue; they need
the parking on that street. Mr. Baker, 815 Pismo St., stated he is co -owner of
the Grand Avenue Motel, and he was concerned about the hours, but if they are
going to close at 9:30, he would not oppose the use.
Upon hearing no further comments for or against the proposed use, Chairman
Gerrish declared the hearing closed.
Chairman Gerrish stated, in his opinion, it is an excellent location as
opposed to their present location. Also, he is not concerned at this time about
limiting the number of machines they have in there because the building is only
20' x 24'; however, he felt there should be some sort of time restriction that
requires them to close at 9:30 P.M. Planning Director Hays advised that there
is some paving in the parking lot now, and there are numerous holes that could
probably be patched.

REVIEW;- REQUEST FOR USE PERMIT FOR CONVERSION OF A 28 UNIT APARTMENT COMPLEX
TO CONDOMINIUMS, 1173 FAIR OAKS AVENUE. (W. VON BISKUPSKY).
Planning Director Hays advised that the applicant has requested that
this matter be continued to the next Planning Commission meeting. due to a
conflict of his schedule, which prevents him from attending tonight's meeting.
Chairman Gerrish announced that this matter will be placed on the next agenda.
DISCUSSION RE: REDEVELOPMENT OF PROPERTY AT 227 BRIDGE STREET. (CENTRAL COAST
Planning Director Hays advised that representatives of the Church have
approached him informally to discuss a couple of situations that they are facing
right now, The Commission is aware that they are proposing to construct a new
school facility across from the Oak Park Acres Development and they will be
moving much of their activity from their present location, which is located
just north of the Cheverlot Agency. They are considering moving their entire
operation to the new site, leaving the property at 227 Bridge Street for some
type of redevelopment. Mr. Hays pointed out one of the problems is that part
of the property is zoned "H -S" Highway Service District, and the rear portion
is zoned "R -3 ". He stated that the representatives have approached him for
discussion as to what the City may envision as acceptable in that area.
Various representatives of the Church spoke with regard to several
development possibilities for the property at 227 Bridge Street. The
Planning Commission provided their input as to what they thought would be
desirable for that area. Also, it was suggested that they might want to
get some input from the Downtown Merchants and might provide an opportunity
to do some master planning for that part of town.
REVIEW - LOT SPLIT CASE NO. 81 -366, McKINLEY STREET. (ROGER FULLER)
Planning Director Hays advised that a few months ago the Commission
approved a lot line adjustment for Roger Fuller on McKinley and May Streets
and the applicant's engineer is requesting clarification of the Commission's
action. He explained that the map submitted showed a dashed line across the
property, and this was not to have been a part of the subdivision. Jim
McGillis, Engineer for the applicant, stated that they wanted to :clarify the
fact that they didn't want to erase that line.
After a brief discussion, the Commission reaffirmed their action so
that Mr. McGillis could go ahead with preparation of the final map.

Commissioner Saruwatari requested to be replaced on the Architectural
Review Committee because she did not have time to attend the meetings.
Chairman Gerrish appointed Commissioner Moots to the Committee temporarily
until he could find a replacement.
Commissioner Cole inquired as to whether or not some kind of heater
could be provided to generate a little more heat f the c d ars.,►in the
back.
