ARROYO GRANDE PLANNING COMMISSION
November 17, 1981
The Arroyo Grande Planning Commission met in regular session with
Chairman Gerrish presiding. Present are Commissioners Benhardt, Cole,
Moots, Pilkington, Saruwatari and Sebastian. Planning Director Hays is
also in attendance.
MINUTE APPROVAL
Upon hearing no additions or corrections, the minutes of the regular
meeting of November 3, 1981 were approved on motion by Commissioner Cole,
seconded by Commissioner Benhardt, and unanimously carried.
COMMUNICATIONS
Planning Director Hays explained that there is an existing parking
situation at the corner of Grand Avenue and Halcyon Road, where there are
several buildings all under one ownership. Mr. Hays advised that there
are 23 parking spaces on the property, however, the number of spaces are
not sufficient to meet the requirements of the ordinance because of the
type of uses. Mr. Hays stated he had advised Mr. Polin that there is a
provision in the Zoning Ordinance whereby he could apply for a waiver of
the parking requirement.
Chairman Gerrish pointed out that for 4400 sq. ft. of building space,
22 parking spaces would be needed in the Highway Service District, however,
since one of the uses currently occupying one of the buildings is a
restaurant, more parking spaces are required for this type of use.
After a brief discussion, on motion by Commissioner Sebastian,
seconded by Commissioner Benhardt, and unanimously carried, a Waiver was
granted from the parking requirements as requested by Mr. Polin.
REVIEW AND COMMENT ON PROPOSED ENVIRONMENTAL REVIEW PROCEDURES AND GUIDELINES
FOR THE CITY.
Planning Director Hays referred to the draft of proposed Environmental
Review Procedures and Guidelines. He advised that the City is responsible
for complying with the California Environmental Quality Act and procedures
must be adopted to be consistent with this Act, and the proposed procedures
would bring the City into compliance with the latest requirements.
He pointed out that the major changes are that the Planning Commission
will now only make final environmental determinations on thos projects on
which they are the decision making body (i.e., Use Permits and Parcel Maps),
and on items where the Council is the decision making body, the Commission
will make a recommendation to them. Mr. Hays also pointed out that when
the Notice of Public Hearing is published, it is also going to contain his
recommendation regarding the environmental determination, and this determin-
ation may be contested at the hearing by the public. In other words, the
public can come .. in and see the documents and be aware of what is going to
happen prior to the meeting.
Commissioner Sebastian requested that this item be continued and
further discussed at the end of the meeting.
PUBLIC HEARING - LOT SPLIT CASE NO. 81 -371 (LOT LINE ADJUSTMENT), 461 AND 471
WOODLAND DRIVE. (S. A. & D. D. MACHADO /A. S. & M. L. MICHEL).
Planning Director Hays advised that the lot line adjustment is to change
the existing lot line between two existing properties, shifting it over
slightly to the south, and the application was made to correct the encroach-
ment over an existing lot line. Mr. Hays pointed out that the only condition
placed on the lot split by the Minor Subdivision Committee was that a mylar
copy of the recorded map be furnished to the City.
After a brief discussion, Lot Split Case No. 81 -371 was approved on
motion by Commissioner Sebastian, seconded by Commissioner Pilkington, and
unanimously carried, subject to the condition noted in Minor Subdivision
Committee Action, dated November 12, 1981.

PUBLIC HEARING - SUBDIVISION REVIEW, TENTATIVE SUBDIVISION MAP, TRACT NO. 984
"SUNNY GARDENS ", HUASNA ROAD. (IKEDA BROS.).
Planning Director Hays pointed out that on this particular item, the
Commission had already approved the Negative Declaration when they approved
the General Plan Amendment and Zone Change. He advised that the site totals
approximately 11.22, acres with a total of 36 lots. The applicant proposes
to develop the subdivision in three phases, with construction of the appropriate
improvements as required. Mr. Hays noted that the subdivision will provide a
pedestrian access to Strother Park between Lots 4 and 5, and that a decorative
masonry wall will be constructed between the subdivision and the park and along
the area that fronts on Huasna Road.
Upon being assured by Planning Director Hays that public hearing for
Tentative Subdivision Map, Tract No. 984, had been duly published, posted and
property owners notified, Chairman Gerrish declared the hearing open.
Mr. Jim McGillis, 136 Bridge Street, Engineer for the applicants, stated
they concur with the staff report and are in agreement with the proposed
conditions.
There being no further comments for or against the proposed subdivision,
Chairman Gerrish declared the hearing closed.
Commissioner Sebastian stated that in looking at Lots 19, 20, 21, 22 and
23, they appear to be under -width according to our Ordinance, and we are
looking at the very minimum 6,000 sq. ft. lots and taking a 10 ft. easement
off of that and, in his opinion, these five lots should be worked into four
lots so people could have something that meets our minimum requirements.
Mr. McGillis stated that those lots back on to the creek and, therefore,
really open up and give a lot of back yard space that is useable. He pointed
out that the narrowness of the lots is up in the front yard area, and also
that there are much larger lots in the project, up to 8;000 sq. ft.
After further discussion, the following action was taken:

PUBLIC HEARING - PROPOSED AMENDMENT TO ORDINANCE NO. 140 C. S., TRACT 604,
"OAK PARK ACRES ", TO ALLOW SPLIT OF LOT 13. (E. MENARD /R. KVIDT).
Planning Director Hays advised that the applicant has submitted a request
to amend a portion of Ordinance 140 C. S., which was the original ordinance
that approved the Oak Park Acres development. He stated that Ordinance 140
C. S. now stipulates that Parcel 13, which is the Greenbelt Open Space parcel
for Oak Park, be retained by the developer. Recently, Noyes Road was re-
aligned, which now causes it to bisect a small portion of Parcel 13. The
applicant owns property adjacent to this parcel that has been severed by
the road and wishes to purchase it. In order to split this parcel, Ordinance
140 C. S. must be amended as proposed by the applicant. He is proposing that
the property continue to be used for open space within his ownership.

Upon being assured by Planning Director Hays that proposed amendment to
Ordinance No. 140 C. S. had been duly published, posted and property owners
notified, Chairman Gerrish declared the hearing open.
Reuben Kvidt, 1035 Acorn Drive, advised that when the Ordinance was
written, they-didn't intend to split off any part of the greenbelt, however,
in the realignment of Noyes Road, a small island was created and Mr. Menard
indicated he would like to have that property for grazing his cattle.

Larry Rohloff, Engineer for the applicant, spoke in favor of the proposed
Ordinance amendment, pointing out that the applicant does not intend to
modify the usage and it will remain in open space.
Upon hearing no further comments for or against the proposed amendment,
Chairman Gerrish declared the hearing closed.
Chairman Gerrish inquired if the Commission approves the split and the
land transfers ownership, if it would still be covered by Ordinance 140 C.S.
Planning Director Hays stated that this particular piece of property would
still be covered by Ordinance 140 C.S. He further noted that the applicant
will still have to come in with a parcel map to accomplish the split.
After further discussion, the following action was taken:

PUBLIC HEARING - LOT SPLIT CASE NO. 81-367, PROPERTY LOCATED SOUTHERLY OF EAST
Planning Director Hays advised that this matter apparently is in the final
stage of being resolved at the Council 'level, and recommended that this item
be continued to January 5, 1982. The Commission concurred with the recommendation,
and Chairman Gerrish announced that Lot Split Case No. 81 -367 would be continued
to the Planning Commission meeting of January 1, 1982.
P.ECONSIDER CONDITIONS OF APPROVAL AS DIRECTED BY THE CITY COUNCIL ON TENTATIVE
SUBDIVISION MAP, TRACT NO. 982, 143 TALLY HO ROAD. (L. C. LaVine).
Planning Director Hays noted that at the Planning Commission meeting of
October 20, 1981, the Commission approved this Tentative Subdivision with
certain conditions. The Director of Public Works had suggested certain
additional conditions to mitigate potential traffic and drainage problems,
however, the Commission decided to eliminate these recommended conditions.
He stated that upon further research of the matter, he had discovered an
Ordinance which requires a drainage study and appropriate improvements to be
constructed for this particular area. Since these conditions were deleted
from the Commission's approval, he brought the matter to the attention of
the City Council at their last meeting. He stated he was instructed by the
Council to bring the matter back to the Commission to add the two conditions
to conform with the Ordinance.as follows:
1. That prior to recordation of the map, a drainage study be done to
analyze the sizes of the existing facilities to which the tract
will drain, and that conditions be attached to the map if drainage

constrictions exist anywhere between the tract and Tally Ho Creek; and
2. That appropriate improvements required to pass the 100 year flood
to the point of discharge into Tally Ho Creek be conditions to the
approval of the tract map.
Planning Director Hays advised one of the conditions of the Commission's approval
was that a drainage study be done, however, that doesn't necessarily require the
applicant to construct the necessary drainage facilities.
Commissioner Sebastian stated he understood what
were, however, all the applicant wants to do is to

the conditions are unreasonable, he could appeal
or City Council.
Jim McGillis, engineer, stated he is speaking as a friend of .the appIicant,
and Mr.. LaVine thinks the conditions are unreasonable, and that he is getting
stuck because of the poor design of the La Barranca Tract. He further stated
that as far as Mr. LaVine is concerned, his position is that he is not going
to pursue the matter any further.
After discussion, on motion by Commissioner Sebastian, seconded by
Commissioner Cole, and unanimously carried, the matter was continued to the
next Planning Commission meeting of December 1, 1981 so that the Commission
can review the ordinance.
FURTHER DISCUSSION - PROPOSED ENVIRONMENTAL REVIEW PROCEDURES AND GUIDELINES.
The Planning Commission discussed the present environmental review
procedures as opposed to the revised procedures. After considerable dis-
cussion, the Commission indicated their agreement with the .roposed procedures
and recommended approval to the City Council.
