A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE
URGING THE STATE LEGISLATURE TO REVIEW AND HOLO HEARINGS ON
THE STATE OEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT'S
HOUSING ELEMENT GUIDELINES, AND FINDING THAT UNTIL SUCH TIME
AS THE STATE LEGISLATURE OR COURT OF LAW DETERMINE OTHERWISE.
THE HOUSING ELEMENT GUIDELINES ARE AOVISORY.
WHEREAS, when Fai r Share Al locations derived from the State Guidel ines are
viewed from a new constructions' point of vIew, all new multiple residential develop-
men5would have to be reserved for Very Low and Low Income Households; and
WHEREAS, to overcome the problem stated above the City of Arroyo Grande
would have to drastIcally amend its Housing Policies to a degree which, in all proba-
bilit~ would be incongruous with both expressed and percleved desIres of the City'S
residents; and
WHEREAS, neither the State guidelines nor the resultant Fair Share Allo-
cations allow for the consideration of land, cost or other economic concerns related
to the character of lands available for development or the disparity between the
need to preserve prime agricultural lands and the use of ~ose lands for high density
development; and
WHEREAS, the City of Arroyo Grande finds little assurance that the State
Department of Housing and Community Development would not translate goal year per-
centage allocations into minimum yearly number of units; and
WHEREAS, the City of Arroyo Grande stringently and vehemently objects to
the further erosion of local governments' ability and right to control their own
destiny;
NOW, THEREFORE, THE CITY COUNCiL OF THE CITY OF ARROYO GRANDE DOES HEREBY
RESOLVE AS FOLLOWS:
1. The City of Arroyo Grande Is of the opinion after close review of Government Code
Section 65302(C) and Health and Safety Code Section 50459 (formally 4(134), that the
State Department of Housing and Community Development's interpretation of said statutes
are incorrect and unlawful;
2. The City of Arroyo Grande finds that it Is time for the State Legislature, as a
whole, t9 review and hold hearings regarding the State Oepartment of Housing and Com-
munity Development's Housing Element GuidelInes, their meaning, their effectiveness.
their need and the consequences they hold for local governments;
3. The City of Arroyo Grande finds that, until such time that the State LegIslature
or a Court of Law determine otherwIse, the Housing Element GuIdelines are advisory.
On the motion of Council Member de Leon, seconded by Council Member Pope, and on
the followIng roll call vote, to wit:
AYES: Council Members Gallagher, de Leon, Pope, Smith and Mayor Millis.
NOES: None.
ABSENT: None.
